An Instagram famous bikie has been booted out of his motorcycle club over claims he was associating with a police witness.

Melbourne-based bikie Toby Mitchell was kicked out of the Mongols following a unanimous vote on Friday night.

An insider claimed Mitchell had angered senior Mongol figures including alleged club president Nick 'The Knife' Forbes.

Mitchell was voted out over accusations he was 'running with dogs' that included a police witness in the manslaughter case against club member Lachlan Floyd.

Floyd was jailed for six-and-a-half years over the fatal shooting of his ex-girlfriend's partner Stuart Townsend in February 2016.

'Mitchell was booted last night for running with dogs even after being repeatedly warned,' a senior Mongols insider was reported as saying in the Courier Mail.

'There was a 100 per cent vote against him, even from people who are loyal to him.

'He thought he was bigger than the club but we don't tolerate bad behaviour and he's gone bad.

Mitchell has more than 300,000 followers on Instagram and he regularly updates his social media account with photos of gym workouts, luxury cars and encounters with celebrities including boxer Anthony Mundine and AFL legend Sam Newman.

Mitchell has never been far from the headlines since being shot multiple times back in 2011.

It was just a month from Christmas when Mitchell was shot six times outside a Brunswick gym while sergeant-at-arms for the Bandidos bikie gang.

He spent weeks in intensive care, underwent 30 operations and lost a kidney, gall bladder and most of his liver.

He was shot again in 2013 in another attempt on his life.

In 2017, Mitchell was arrested over a Christmas brawl which saw him deck a drunk who was silly enough to disrespect his female companion.

Mitchell again received bail just before Christmas.

The bikie found himself behind bars after an embarrassing video emerged showing him being knocked-out by a homeless man in October 2020.

The video showed a 'street kid' dressed like a 'lumberjack' knock Mitchell on his behind after the bikie had enjoyed a boozy night out with mates.

Mitchell had picked a fight with the homeless man for no apparent reason before trying to punch on with the stranger.

The incident had seen Mitchell released on bail just before Christmas, but he was forbidden from mingling with other Mongols and confined to his swanky quarters between 8pm and 6am over the Christmas period.

Bikie boss Toby Mitchell bashed his socialite mate because MAFS star Stacey Hampton claimed he was talking smack about him, the victim claims.

The Mongols president admitted to drunkenly slapping Anthony Hess, 39, in the head three times outside a Melbourne cafe on October 4.

Embarrassing CCTV footage shows him suddenly attacking Hess before slipping over in his designer slides and needing three friends to haul him to his feet.

Hess at the time told Daily Mail Australia the scuffle was over a 'misunderstanding' and he wanted the charges dropped.

But he now reveals the whole debacle was started by the Married At First Sight fan favourite Hampton stirring up trouble.

He claims his one-time inseparable best friend told Mitchell he had called him a 'dog' and a 'c**t' behind his back, sending him into a rage.

The pair, who have been close friends for eight years, were drinking outside Gilson cafe in South Yarra with other Mongols including top lieutenant Mark Balsillie.

'We were all drinking and having a good time, everyone was in good spirits and enjoying the restrictions lifting and the nice weather,' Hess said.

Mitchell then called Hampton, whom he was friends with via Hess, on FaceTime and the trio briefly caught up on the video chat.

The career criminal then wandered away from Hess and continued to talk to Hampton, before things turned ugly moments later.

'Toby came up behind me and said "Stacey said you called me a dog and a c**t" and then immediately hit me in the side of the head,' Hess claimed.

'I'm still shocked he believed someone he met one or twice through me, over someone he's known for eight years.

'Stacey has been spreading rumours about me to my friends for months, she's obsessed.'

Hampton and Hess had been feuding for several months after their very public friendship ended with an ugly falling out in July.

The reality TV star did not respond to requests for comment from Daily Mail Australia.

Hess said after Mitchell hit him he ran out of the cafe onto the road, tripped and fell on to a car.

'The driver drove me to the hospital, even though I insisted I was okay,' he said.

He chalked the incident up to a drunken 'misunderstanding' between mates on 'another wild night' and thought nothing more of it.

'I was just a drunk hot mess and things had become a bit crazy but I didn't except the police to be involved and Toby to be charged,' he said.

'I asked the police not to charge Toby as we were both drunk and the situation escalated.'

Hess did not make a police statement and jumped on a flight to Los Angeles the day after Mitchell was arrested to avoid being questioned by detectives.

Hess, who was given special permission to leave Australia despite the travel ban, said he was staying in the U.S. for some time to 'let the whole thing blow over'.

Detective senior constable Lauren Kane claimed in October that Hess refused to make a statement because he was 'in fear for his life'.

Police instead seized his medical records, which indicated he was treated for a suspected facial fracture at The Alfred Hospital.

Mitchell pleaded guilty to assault in exchange for charges of affray and intentionally causing injury being dropped.

He also pleaded guilty to a second assault charge over another punch-up in Southbank on November 15 where he was knocked out.

More humiliating video showed the brief fight where a 'street kid' dressed like a 'lumberjack' knocked Mitchell on his behind - just as the Hess incident ended.

Mitchell was banned from associating with his fellow Mongols or going within 150m of the cafe as a condition of his bail

Mitchell threw a haymaker at the man after picking a fight for no apparent reason, but was punched square in the face and went down like a sack of potatoes.

Police in an earlier court appearance mocked the supposedly fearsome bikie as having a 'glass jaw' in being defeated so easily.

The bikie looks set to walk from the embarrassing fracas with little more than a fine if he behaves himself over the next six months and seeks alcohol and anger management treatment.

Magistrate John Bentley agreed to defer sentencing Mitchell until September after Corrections Victoria asked for a month-long adjournment to properly assess him for a community correction order.

Mitchell, who often taunts police and shows off his flashy lifestyle on social media, celebrated his release on bail after his arrest Instagram within hours.

He then shared a video of the view from his South Melbourne flat with the caption 'from a jail cell to a dream in a day'.

Rap song F**k Tha Police by American group N.W.A played in the background. Another photo showed a wad of cash returned to him in a sealed evidence bag.

Hess famously defeated Roxy Jacenko in court a year ago when the PR queen tried to slap him with a restraining order.

She accused him of writing 'Roxy is a c**t' on the wall of her Paddington office after a heated argument at one of her speaking events, which he denied.

That drunken fag that touched me and wouldn't shut his yap at the PNE line up for Vince Neil twitched on the ground for 15 minutes. No charges but I wasn't allowed into the show which was a bummer. Melbourne bikie boss to undergo anger management, alcohol counselling

The Melbourne president of the outlawed Mongols motorcycle gang has been told he must receive alcohol and anger management counselling.
Toby Mitchell pleaded guilty to assaulting a man at a South Yarra cafe in October last year.
The victim was left with a suspected facial fracture but did not make a statement to police.

Just one month after the South Yarra incident, Mitchell was accused of attacking a stranger along Southbank.

CCTV footage showed Mr Mitchell walking with a group of friends along Southbank promenade and engaging in a verbal altercation with a man sitting on the ground who he then punched in the face twice.

Mr Mitchell was pulled away by his group of friends, but he approached that man again and was then was struck unconscious.

The Mongols leader was charged with affray and committing an indictable offence while on bail.
In November, the bikie boss pleaded guilty to the two assaults but was again granted bail.
His lawyers argued the 45-year-old would not cope in jail because of organ damage caused by being shot in 2011 and 2013.

Today, a Magistrate gave Mitchell six months to show he can improve his behaviour through alcohol and anger management counselling.
In another legal win for the Mongols president, the Magistrate relaxed his bail conditions which initially prevented him from associating with fellow Mongols, and he no longer has to abide by an 8pm curfew.

The lawyer argued his client should be spared jail because the incidents though criminal were relatively minor.

He also said his client had pleaded guilty and had serious medical issues that would make jail more onerous.

Mr Mitchell has organ damage and takes 27 medications after he survived a 2011 shooting, the court was told .

“He should have been bailed at the police station, but he was paraded through the courts,” Mr Sheales said.

He said his client’s notoriety because of his past had become a “burden” to him.

But magistrate John Bentley said the former kickboxer needs to address his anger management issues and that his association with outlaw motorcycle gangs was also a prevalent feature.

The bikie was initially charged with affray, intentionally cause injury and other offences which were dropped.

Mr Mitchell will be assessed for a community corrections order and will return to court on Monday.

Melbourne bikie boss Toby Mitchell was “out for blood” during an attack where he punched a man and slapped another in two separate fights, a court has heard.

The 45-year-old Mongols president pleaded guilty to two counts of unlawful assault over incidents at Southbank and South Yarra in Melbourne Magistrates Court on Thursday.

“It clearly shows he’s out for blood,” police prosecutor Geoff Adams said of the Southbank assault.

Footage captured the fight at Southbank on November 15 and shows the bikie punching the man in the face after a brief exchange, despite a group of men trying to hold him back.

He is seen hitting the victim twice in the body, before the group drags Mr Mitchell away.

The Mongols boss breaks free and takes a swing but misses.

The other man then fights back and the bikie is knocked to the ground with Sergeant Adams labelling it “sheer luck” he was rendered unconscious due to a “glass jaw”.

The second victim never came forward to report the assault

The prosecutor pushed for Mitchell to be jailed to show the behaviour was completely unacceptable in the community.

“The accused just believes that he can go about his life and not worry about the law. He is acting as though he is the enforcer,” Sergeant Adams said.

“He would have continued to fight.”

A month earlier Mr Mitchell had been charged over a separate fight where he slapped a man he knew outside Gilson cafe in South Yarra on October 4.

Mongols bikie boss knocked out in fight, court told, and bailed again

Mongols bikie president Toby Mitchell has been granted bail after being charged over an early-morning fight in which he was knocked out.

Mr Mitchell exchanged punches with an unknown man in Southbank about 3am on November 15 while on bail for other alleged offending, Melbourne Magistrates Court heard on Wednesday.

Police say CCTV footage of the fight shows Mr Mitchell and the other man exchange words and then fight for about 40 seconds.

Detective acting Sergeant Jordan Collinson said Mr Mitchell broke free from his companions' attempt to keep him away from the other man and struck him in the face and body.

After the pair were briefly separated, the other man punched Mr Mitchell to the face and knocked him to the ground, the court heard.

Mr Mitchell appeared to be unconscious, Detective acting Sergeant Collinson said, and was dazed when helped to his feet and walked away.

Police have not identified the man who punched Mr Mitchell and no one reported the incident, the court heard.

Mr Mitchell, 45, is charged with affray and committing an offence while on bail, and the new charges have been laid on top of ones stemming from an October 4 incident, where he allegedly hit a man three times outside a South Yarra cafe. He faces affray and assault charges over that incident.

He was last month granted bail on the charges from the South Yarra incident and on Wednesday magistrate John Bentley granted bail again but ordered Mr Mitchell to abide by a curfew so he stays home between 8pm and 6am.

"I don't want to see him in this court again because he's out drinking in Southbank," Mr Bentley said.

He said Mr Mitchell was a person of notoriety who attracted attention in public.

The magistrate also refused an application by police to revoke Mr Mitchell's bail on the charges stemming from the South Yarra incident.

Defence counsel Damian Sheales said Mr Mitchell was in hospital early this week preparing for a surgical procedure stemming from when he was shot by an unknown gunman in Brunswick in 2011.

Mr Mitchell suffered from a series of medical complications stemming from being shot, Mr Sheales said, and needed to take at least 15 different types of medication daily.

Police had opposed Mr Mitchell getting bail and argued he was an unacceptable risk and a danger to the public.

Mr Sheales said the alleged offending was not a serious example of affray.(Greg-Guess not since Mr.Mitchell got knocked out and his companions did not attack the other man.)

Mr Mitchell, who listened to the hearing on a telephone from a police station, must not associate with his Mongols clubmates while on bail.

He is due to next appear before court in March.

Australia's famed Gold Coast attracts the heavily-tattooed types and gym lovers, the picturesque surroundings and expensive lifestyle providing the ideal backdrop for a prominent Instagram page and following.

But beneath the sand and surf is a seedy underworld.

This week's pre-planned assassination of senior Finks bikie Shane Bowden, 48, in his black BMW was a timely reminder of just how ruthless that underworld can be.

While there has been talk that his death could spark a war between the Finks OMCG and the rival Mongols OMCG, a longtime anti-bikie policeman believes thins will not reach out of control levels.

But Jim Keogh, the former head of Queensland's Rapid Action Patrol (RAP) squad, is adamant police must do more to stamp out the gangs - before they run riot again on the infamous Glitter Strip.

'Shootings such as this, and the number of shots (fired) are of great concern to the community,' Mr Keogh told The Courier Mail this week.

'We had the Broadbeach brawl. We had the incident at Robina, we had a number of issues but none of such brutality.

'From a police perspective you've got to maintain a strong presence and win each battle to control the war.'

Indeed Queensland Police are heeding Mr Keogh's advice more than ever before.

Just this week Tayne Clarkson, the president of the Gold Coast chapter of the Finks, was jailed on drug supply charges.

The 21-year-old had fled to New South Wales in July from Queensland, where he was wanted over an alleged violent home invasion.

Clarkson pleaded guilty to drug supply charges and was this week sentenced for a minimum of four months.

While he will return to Queensland in November, his inability to be on the ground in the next few months means should anything kick off, club control will be transferred to another senior member.

With Clarkson unavailable on the Gold Coast, former Finks president Ben Williamson could be among those to step up.

Williamson has history in taking on rival gangs, having been charged with bashing a Hells Angels member with a baseball bat in 2015.

Bikie gang hierarchies are notoriously fluid, with chapter, state, and national leaders often making grabs for power and control.

Bowden for example had only returned to the Finks ranks in July after seven years as a Mongols member.

Before that he was front and centre for the Finks as they fought to maintain control of Queensland's sunny streets in the infamous 'Ballroom Blitz'.

Up to 40 Finks members stormed into a kickboxing event in 2005 to tackle a large contingent of Hells Angels rivals, in particular targeting Christopher Wayne Hudson.

Hudson - who a few years later carried out the Melbourne CBD shootings - was held down and bashed, before being shot, by Bowden and his good mate Nick 'The Knife' Forbes.

Bowden was sentenced to six-and-a-half years in jail, while Forbes served five years.

In the aftermath the pair defected to the Mongols and while he flipped and flopped between OMCGs over the years, Forbes has risen through the ranks to become the Mongols national president.

'He's idolised by these young bikies, I wouldn't be surprised if they're trying to get a stronger foothold here on the Coast,' the source said.

'There is definitely a big push for new members, a big drive.'

In Victoria, renowned hardman Toby Mitchell took up the ranks as the state president last year.

He has seemingly ruled with an iron fist since, kicking Bowden out of the club shortly after he was released from prison in June.

Mark 'Ferret' Moroney - a longtime member and former NSW boss - was also told his time as part of the OMCG was up.

It is not suggested any of the Mongols OMCG members mentioned were involved in Bowden's death.

Bowden had previously been shot in the leg during the drive-by attack in Melbourne in July and was awaiting more surgery to aid in his recovery.

His ex-girlfriend Trudi McPhee believes those responsible for that attack are the same 'cowards' who carried out Monday's early hour assassination.

She also warned that Bowden's killing could spark an all-out bikie war on the streets of the Gold Coast.

'As I sit here today I still don't think it's real. I don't think anyone deserves to die like this,' Ms McPhee said.

'It's pretty cowardly. If he had a gun, which he didn't because he couldn't or he'd do five years, he would've shot back. (Greg: It's awesome that Oz has a law that ppl who have done serious time if they carry a gun have to do a nickel. The gun punishment laws in Canada are a joke. 'Of course the cowards knew they couldn't go up and confront him face-to-face as he was a handy boxer and they wouldn't have stood a chance.
