eBay Hi-Jinx: Watch Out For This Seller!

Timeline:

November 8th: I win this Auction:

November 26th: I receive it and realize it's an Action Man Scramble
Helmet with the logo scratched off. And he charged me three times the
actual shipping cost... I contact the seller. After 3 emails, I
finally get a correct address to return it. He won't give me his
actual name, so I send it to its_tyme_2play in Pensacola, Florida. I
send it by insured mail and keep the Customs Forms.

December 16th: Nearing the end of the time to register a dispute with
Paypal, I send an email on asking if it has arrived and reminding the
Seller that the deadline for filing a dispute is approaching. No
answer.

December 20th: Another email sent asking if it has arrived. No
answer.

December 22nd: I file a Dispute.

December 23rd: The seller responds, asking for tracking. I explain
there is no tracking, but I have the Customs Forms and proof of
shipment. I give the information. Seller suggests that it may be
lost.

December 28th: Unbenownst to me, this Auction by the Seller ends. It
is a Buy It Now.

December 29th: I discover this at Auction by the Seller.

This leads me to do a search of ended auctions and I find the one
mentioned above that ended on December 28th. As I had no contact from
the Seller, I assumed that neither had Paypal. I escalate the dispute
to a claim, citing my suspicions of fraud. I contact eBay and inform
them of the auction. eBay responds by email stating that the issue is
now under investigation, and advise me to leave Feedback immediately
reflecting my concerns. I do. I submit my proof of shipping to
Paypal.

Then the emails start. The Seller starts off aggressive, and accuses
me of being deceitful, ignorant and untrustworthy. He claims that he
got it back on the 27th and listed it on the 28th.

Does Florida have mail delivery on Sunday?

I responded that when eBay and Paypal finished the investigation and
could convince me he acted in good faith then I would retract the
negative. I also added that if eBay and Paypal were not informed that
he had received the item then a Negative Feedback would be the least
of his problems...

He blasted back that I was crazy, and that he had been in close
contact with me right from the start. Now, I can say from the non-
response to my emails on December 16 and December 20 that he was not
speaking the truth... He threatened that I would have to wait a long
time for my money.

I responded telling him that I was in no hurry to get reimbursed, and
thanked him for putting it in writing, twice, that he had received the
item, and reiterated that if he was being honest then he had nothing
to worry about, but if he lied about contacting eBay and Paypal about
receiving the item...

So now I wait for Paypal and eBay. If they find that he had listed
the item and hadn't contacted them first, I will proceed with
contacting the RCMP and RECOLL and informing them of a case of on-line
fraud. I will also contact ECONSUMER relating the particulars of the
case.

If he did contact them, then I will retract the Negative Feedback --
but first he'll have to apologize for calling me crazy and say
"Please, Mr Joe90, sir..."

For the time being the seller is still selling his wares...

of them!!!

Somehow, I doubt that I'll have to retract anything...

This is sort of a related question.

I had bids going on two different auctions by the same seller.
Bids got too high for my wallet and I watched someone else win both
items.

As soon as the auctions ended I get a "second chance" email from the
seller.
There wasn't enough time for the winning bidder to drop out,
so...................

Do you think this guy was shill bidding in his own auction?

If you're saying that the seller is "You Know Who" then you should
report it to eBay...

I had a similar experience. What I did was find the bids from the
winning bidder, and figured out what my winning bid would have been
without the shill. I offered to buy the item at that price, and not my
"second place" amount. I was politely declined, and the report to eBay
went no place.

Shills are NOTORIOUS on eBay. Sellers use them all them time. I would
suspect, based on your description, this was a shill. Report it to
eBay, but they won't do a damned thing about it. The higher the bid,
the more they make.

You are not the only one that has got the run around from this seller.
A few years ago I purchased a set of arctic boots from this person, it
took 4 weeks & numerous emails to get them. I was just happy that I
received them in the end. To date this sell has changed their
screen / store name 3 times, 1. Scoobydoo something, 2. HotWheelsGuy,
3. its_tyme_2play. Let us know how it all pans out in the end.
