Burger Asks Competence Tests for Trial Lawyers
New Orleans (AP) Chief Justice Warren Burger, already under fire for
questioning the competence of half the nation's trial lawyers
esclaated his attack Sunday by declaring that all lawyers should have
to earn the right to appear in court.
Calling trial lawyer incompetence "one of the most serious problems
facing our profession," Justice burger told the American Bar
Association convention.

The ABA's governing body will consider a resolution this week
from the Illionois bar Association demanding that Justice Burger
either "publicly repudiate" comments that he made last July about
trial lawyer incompetence or provide proof of their accuracy.
The resolution was sparked by testimony that Justice Burger gave to
the Royal Commission on Legal Services in London in which he estimated
that one half of U.S. trial lawyers are unqualified to represent their
clients.

On Feb 12 1978 Burger did a "State of the Judiciary" address
at the ABA convention in New Orleans. He referred to his
London comments the previous July. The ABA membership
became QUITE upset and began to "circle their wagons".
On Feb 13 some in the ABA tried to start a resolution
demanding that Burger retract his July comments
about incompetent lawyers, and the ABA countered
by saying that only 20% of US trial attorneys are
incompetent. ( ! )

On Sunday Feb 12th, 1978 Chief Justice Warren E. Burger
addressed the American Bar Associaation in New Orleans.

With the Christmas season upon us again, my stepdaughter was launching

was at my wits end. I took the kid home and filled the bathtub with
water. Then I dunked the brat's head under the water and counted out
a full minute, with her flailing her arms. I brought her up and she
gasped for air. When she'd caught her breath, I asked her, "When you
