The family of Kendra S. James filed a federal lawsuit Tuesday against the
Portland Police Bureau, the city of Portland and three officers involved in a
traffic stop that led to her fatal shooting.
The lawsuit alleges Officer Scott McCollister used excessive force and caused
her "wrongful death" on May 5 when he shot and killed James, 21, as she tried
to drive away from the traffic stop on North Skidmore Street. It seeks $10
million in economic and punitive damages.
"McCollister's intentional and wrongful act of shooting and killing (James) was
entirely unjustified under the circumstances then existing," the suit states.
"McCollister violated decedent's Fourth and Fourteenth Amendment rights by
using excessive and deadly force when it was not necessary to prevent (her)
escape."
Attorneys Ken Walker and Ernest Warren, representing James' father, Kenneth
James, and James' estate, filed the action in U.S. District Court in Portland.
Members of the Albina Ministerial Alliance, who have been outspoken critics of
the fatal shooting since it occurred, assembled outside the courthouse to show
their support.
Contacted by phone later, Kenneth James said he expects the legal action to
draw more attention to the faulty police actions leading up to the shooting.
But he said nothing will bring back his daughter and he remains disappointed no
criminal charges were filed against the officer who shot her.
"The money has nothing to do with it," Kenneth James said. "I'll never be
satisfied."
In late May, a Multnomah County grand jury found no criminal wrongdoing by
McCollister. He told investigators he feared for his life when he shot James
because he was partially in the car and trying to get her out when she put the
car into drive.
Portland police had no comment about the lawsuit, said Sgt. Brian Schmautz,
bureau spokesman. Robert King, president of the Portland Police Association,
has repeatedly defended the actions of the officers involved, saying James, who
had cocaine in her system, contributed to her death by failing to heed
officers' orders.
The lawsuit comes about a month after McCollister, 28, received a 51/2-month
suspension from Chief Mark Kroeker. Although Kroeker said McCollister's use of
deadly force to protect himself didn't violate bureau policy or state law, he
said the officer never should have put himself in the position in which he had
to unholster and fire his 9 mm handgun.
The legal action also faults McCollister and fellow Officers Rick Bean and
Kenneth Reynolds, who assisted in the traffic stop, for failing to develop a
tactical plan to take James into custody and for failing to provide emergency
medical care to James once she was shot.
"McCollister's act of shooting decedent Kendra Sarie James was without legal
justification or provocation. Decedent had an outstanding misdemeanor arrest
warrant, but even if decedent did have a warrant, McCollister was not justified
in using deadly force to arrest or to prevent the decedent's escape," the suit
says.
The James family lawyers are seeking a jury trial. Warren said Tuesday that
he'd argue at trial that the forensic evidence from the case -- including the
lack of gunshot residue in or on the door frame of the car and the bullet's
trajectory path -- did not support McCollister's account of the shooting.
The family is seeking $2 million in economic damages for the loss of James'
"earning capacity during her life," $5 million in noneconomic damages for the
loss to her father and surviving children, and $3 million in punitive damages
for defendants' "reckless and callous indifference to the value" of James'
life.

It also isn't the cops responsibility to get the addict the help that
they need. That responsibility falls on the addict themselves. If they
ether can't or don't want to get the help they need, then it is up to

I would think that after having been through a similar situation
yourself, that YOU would see that hind sight is 20/20. But you are

When a child is over the age of eighteen there isn't much you can legally do.
The addict has to want the help and admit themselves to a facility. Addicts
don't feel they have a problem because they aren't in their right mind. It's a

I'm not sure what my beliefs are Brandi. I did see John Edwards, the
psychic from NY, once and he gave me a very accurate reading, but I'm still
not sure what my beliefs are. I know that I will never get over it, and
have quit asking that of myself. I don't know if it's possible to live with
it. I'm still working on that part. As far as religious beliefs, I really
don't know what to believe. I do find great joy in my grandkids and kids.
I still miss y son, tremendously, though. I still have nightmares about the
night he died. I still have many questions that will probably never be
answered, but most of all, I still hate the lies that were told to cover up
the true story about the night he died. Thats what keeps me going in this
lawsuit. That's also what keeps me from being trusting of LE, again. I
suspect, that the Diallos are feeling much the same way that I do. Until,
the lies are revealed, you have no way to go on with your life. It's not
something that I enjoy, and I do wish that I felt differently. I would
much prefer that this was not the way that things were, but it is, so I do

A quick stroll through google revealed that you have used this " You

it, but google doesn't lie. So to set the record straight, I did say
it. I am man enough to admit when I am wrong. I'm not going to side
step the issue, or ignore it in hopes that everyone will just forget
about it. So please accept my apology. I didn't intentionally lie.
I just didn't recall saying it.
But take note at how many times DJ and Viken have accused me of things
over the past two years or so. This is the very first time they have
EVER produced anything that would prove I did what they accused me of.
And DJ didn't fuck around and waste any time posting it either. Which
goes to show that if they REALLY had proof of anything I did, they
wouldn't waste any time proving it.
There was some truth to the comment though. She does have several
different versions of what happened that night.
I'm not sorry that I made the comment. I'm sorry that I denied having
said it, when in fact I did say it. But I'm only human and I am allowed
to make mistakes. The difference between DJ and myself is that when
confronted with the truth, I face it head on and own up to it. Whether
it was accidental or not. She doesn't. She will go to her grave lying
and covering up her lies.

He seems to have made one to everyone else but not to you. I suppose
that arguably he could have managed one, but he did seem to offer some
reasons - maybe sufficient, maybe not - to refuse to give one. While
certainly not claiming any right to speak for Fuqit or to know what's
going on in his head, I suspect that the apology might have been more
forthcoming if you hadn't first tried to play your usual game of
evading the issue by making such replies as "it wouldn't be a post
that I would care to look at again" in regards to a post that you
nontheless didn't mind quoting from. You had to be shamed and
ridiculed into doing the proper research and finally coming up
with the proof.
Bottom line:
The lesson to be learned here is this - If you want to be perceived
as having any sort of ethics at all, then be prepared to take
responsibility for the words you choose to post. Be prepared to
back up your assertions and accusations.
It's an important lesson, not only in Usenet but in life.
