OCALA, FL -- Two supervisors in the Marion County sheriff's office were
fired, the agency's top attorney was asked to resign and a fourth employee
was suspended for 30 days.
Lt. Robert Proctor, 44, was fired Thursday, almost two weeks after he was
arrested Feb. 19 and charged with sexual battery on a fellow deputy and
violating the department's code of conduct.
Capt. Kenneth Futch, 39, was fired on the grounds that he sexually harassed
the same deputy and violated the department's code of conduct.
Carrie Proctor, the sheriff's senior legal counsel and Robert Proctor's
wife, was asked to resign because Sheriff Ed Dean said she withheld
information about at least one of the cases.
Lt. Bruce McCormick was suspended for 30 days without pay for exercising
poor judgment in the supervision of the deputy.
Despite the disciplinary action, Dean said that the sheriff's office has
changed considerably since 1998 when then-Sheriff Ken Ergle was arrested on
charges he stole more than $150,000 from his own department. Ergle was
later convicted.
"The integrity of officers is paramount to effective protection of the
citizens," Dean said. "I do believe that the integrity of an organization
and its people should always be measured by how they respond to an
incident."
Proctor, commander of the Marion County's southwest district, allegedly
raped the victim on Jan. 31 after she arrived at his house to take him to
work. After entering the house, the woman saw a pornographic video being
played in Proctor's bedroom and Proctor asked her to enter the room.
Proctor then sexually assaulted her, the police report said, adding that
during the ride to work afterward, he told her he "did this all the time."
In her interview with investigators, Carrie Proctor said her husband told
her the sexual encounter was consensual. Carrie Proctor, who was friends
with the victim, also told investigators the woman had affairs with other
married officers, according to the internal affairs report.
She also acknowledged to investigators that she had withheld information
from superiors about possible inappropriate encounters between the victim
and Futch.
According to his statements to internal affairs investigators, Futch, who
is married, said he had a relationship with the victim over many months. It
began in 1999 and included kissing and fondling, but no sex.
Robert Proctor's attorney, William DeCarlis, said his client is innocent
and that the sexual encounter was consensual. Proctor will appeal his
termination, DeCarlis said.
The victim's attorney, Charles Holloman, denied the encounter was
consensual. Assistant state attorneys plan to prosecute the case.
"He raped her like a common thug," Holloman said. "If you believe his
story, at best he's an adulterer. We're hopefully going to prove he's a
rapist."
