Cities to each pay an additional $50,000 stemming from fatal shooting case

A Chicago insurance company agreed to pay $2 million for claims against
Mascotte and Groveland in a lawsuit over the shooting death of a Mascotte City
Councilman, Corgis Insurance spokesman John Novaria said.
The Mascotte City Council voted unanimously to pay $50,000 in addition to the
insurance company settlement stemming from the death of Steve Allred at its
regular Council meeting Monday night.
Groveland City Council has also agreed to pay $50,000, but has not yet received
the legal paperwork, Groveland City Manager Jason Yarborough said.
“I asked the total the insurance could pay and for the cities to pay $50,000
each more to show wrongdoing,” Allred’s first wife Donna DuBois
representing his estate said. “Is that a just price? I have three sons
without a father and no one ever said they were sorry. It is a matter of
principle. They were wrong.”
During a traffic stop at Villa City and Lake Catherine roads in Groveland on
Feb. 24, 2002, police from the two cities opened fire on a Ford Bronco killing
the passenger Allred, 42, and wounding the driver David Schoenberger, 35, at
the time.
Police reports stated that the Bronco knocked down an officer as Schoenberger
sought to flee.
Schoenberger also has a lawsuit pending, Yarbough said. Yarborough declined to
further discuss the settlement. Schoenberger was sentenced Sept. 19, 2002, to
community service for felony fleeing and eluding at high speed and probation
for driving under the influence and driving while his license was suspended or
revoked.
Speaking at the Mascotte meeting before the Council voted on the payment,
DuBois called City Manager Glenn Irby “cold and offensive” for the way he
handled the settlement.
“I don’t know of any lawyer that wouldn’t allow you to say you were sorry
for what happened,” DuBois said. “I am offended and my children are
offended.”
Mayor Stanley Sloan said he wished to express his sorrow whether in public or
in private to DuBois and her family. Karen Allred, Steve Allred’s widow, also
represents his estate. She no longer lives in Lake County and no one answered
the phone at her residence.
Three of the four officers involved, Guillermo Gonzalez of Mascotte, Shane
Mowery and reserve officer Sander Smith of Groveland faced a grand jury and
were never indicted. The fourth officer, James Barger of Groveland, did not go
before the grand jury.
Mascotte Police Chief Steve Allen said that the city’s police cars have been
equipped with video cameras. “Gonzalez does a good job.” Allen said.
“He’s a good officer.”
