Considering Obama's penchant for presidential directives, and his
anti-conservative agenda, no doubt he will try to choose the make-up
of the Supreme Court. But even in relatively uncontested years, there
is a process that involves approval by the U.S. Senate. Must be there
will be all kinds of delays that will be barriers, including outright
rejection of nominees. So my guess is that Obama will try to put
someone up that is very desirable to all. A different tactic might be
to name someone from his administration, like Eric Holder, who would
not be acceptable, but be able to voice political views; then name
someone he really wants.
It looks like more than one of the justices will be replaced, meaning
that the Supreme Court is going to be an important political and
social focus for the next president. Could be this will be brought up
by Democrats, will voice more in their progressive agenda, and at the
same time be pointing at the miscarriage of justice republicans will
dial in.
