Fury as Martin farm burglar is consulted over release date

THE burglar who was shot by Tony Martin as the Norfolk farmer
defended his home is being consulted by the Home Office about
how long his assailant should stay in jail.
Brendon Fearon has been declared a "victim of serious crime" by the
Home Office counselling service and asked for his views on Martin's
release date, The Telegraph can reveal. Martin is serving a life sentence
for wounding Fearon and killing his teenage accomplice, Fred Barras,
with a shotgun in an attempt to defend his property.
The Home Office has ruled that as a "victim" Fearon, who has 34
convictions for burglary, theft and handling stolen goods, and is
currently serving three years for the break-in, must be consulted
about Martin's parole.
Last night, the consultation decision was criticised by MPs. Ann Widdecombe,
the shadow home secretary, said that it was "madness". "Whatever the rights
and wrongs about the degree of force Tony Martin used, it's turning common
sense upside down to consult a burglar about the liberty of his victim."
Gerald Howarth, a member of the Commons home affairs select committee,
called it "utter lunacy". "There's no doubt in the mind of the British public that
the criminals in this case are the ones who broke into Mr Martin's premises
and the idea that one of them should have any input into his parole whatsoever
is a farce.
"I will be writing to the Home Secretary to ask him to make sure that on no
account should this man's views be taken into consideration." In a leaked
memo last year Tony Blair, the Prime Minister, referred to the Martin case as
an example of how the Government was being seen as "out of touch" on
law and order.
Mr Blair wrote: "The Martin case - and any lack of response from us that
appeared to empathise with public concern and then channel it into the
correct course - has only heightened the problem [of being seen as out
of touch]." Fearon revealed that he had been asked about Martin's
parole in a letter he sent to the Norfolk farmer.
It said: "I have since been visited by the Victim Support Group in relation
to my feeling about you gaining parole in the future. I was, therefore, forced
to think about how remorseful you may be. Judging from the cold words of
your distorted truth in the paper reviews, my thoughts are not overly optimistic."
Fearon suggests that Martin will only be at peace with himself once he has
admitted his crimes, adding that he himself has done just that. He says:
"I feel you will gain your sense of truth in time, as you and I know what
happened that fateful night. Reconciliation will not occur until you face up
to your doings as I myself have done so."
However, Fearon, 30, who was jailed in January last year after admitting
conspiring to burgle Martin's home on the night of August 20, 1999,
undermines his claim to have come clean by adding: "We was [sic]
not there to take your belongings merely to escape your dogs and
didn't mean to be intruders."
Referring to Barras, who had 29 convictions for crimes including burglary
and assaulting police officers, Fearon insists: "Whatever the reason may
have been for us being there, that shouldn't have led to a little boy dying
as there is no making amends for that little boy.
"What is so sad is that you haven't even stressed your sorrows for
taking a human life and given the little boy's family a second thought as
they have received a life sentence which there is no going back from
(so sad)." He ends by saying: "I hope you feel remorse as it's the only way forward."
The typed letter was written by Fearon in his cell at HMP Stocken in
Leicestershire, only 30 miles from Gartree jail where Martin is held. Martin,
who is appealing his convictions, is understood to have been upset
by it and has not replied.
Fearon, whose brother Neil was jailed last year for five years for cheating
elderly women out of £40,000, was the leader of the expedition to raid Martin's
farm in the village of Emneth Hungate. Together with another man, who did
not enter the property, Fearon and Barras drove 60 miles from their home in
Newark, Nottinghamshire, to the isolated farmhouse hoping to find antiques.
Martin, who claimed he was lying in bed upstairs, heard them break in through
a window and fired his pump action shotgun repeatedly into the downstairs
darkness, hitting both intruders. Barras managed to crawl outside before
dying while Fearon staggered to a nearby property where the owners raised
the alarm.
When interviewed by police he changed his story repeatedly rather than admit
why they had really been at the house. At Martin's trial a year ago Fearon
claimed that he and Barras had broken into the property "almost accidentally"
while trying to escape the farmer's rottweiler dogs and said that he had
suffered post-traumatic stress as a result of the shooting.
A Home Office spokesman said: "Under the Victims' Charter all victims of
serious crime are asked to offer their views on the offender's release conditions.
If particular concerns are raised the offender may be subjected to conditions
on their parole such as a restriction or exclusion order."
The charity Victim Support, which is Home Office funded, said: "We liaise
with the Probation Service to help canvass victims on offenders' parole."

A Baltimore man was shot and killed and two other men were wounded
early yesterday when they encountered the armed owners of a
Glyndon concrete plant during what police said was an attempted burglary.
The owners of Back River Supply Inc. -- brothers Dominic A. Geckle, 31,
and Matthew J. Geckle, 36 -- were keeping an all-night vigil with shotguns
after being burglarized Friday and Saturday nights, said Cpl. Vickie Warehime,
a Baltimore County police spokeswoman.
Jonathan B. Steinbach, 24, of the first block of W. Biddle St. was pronounced
dead at the scene. Steinbach was the owner of Midtown Tanning Salon in the
1000 block of Cathedral St. in Baltimore, and was in the process of starting a
career in real estate, business associates said.
The two wounded men -- both Baltimore County residents in their 20s -- were
being treated at local hospitals. Police were withholding their identities last night.
Police questioned the Geckle brothers for several hours yesterday and released
them, pending an investigation by the Baltimore County state's attorney's office.
"It is still not known if the [three] were armed," Warehime said, adding that no
weapons had been recovered as of last night. Police are trying to determine
whether the three men are linked to the two earlier break-ins.
Warehime said police were called to the plant in the 12200 block of Owings
Mills Blvd. about 1:20 a.m. after one of the brothers reported a shooting.
Steinbach and another man were found inside the plant. The third man had
fled, but was admitted to Greater Baltimore Medical Center at 8 a.m.
yesterday for treatment of gunshot wounds, Warehime said.
Saturday morning, Dominic Geckle reported that someone had entered
the plant the previous night and stolen office equipment and tools, all
valued at $8,600, according to the police report.
On Sunday, the Geckles reported that someone had stolen more office
equipment and a .22-caliber rifle, all valued at $900, on Saturday night.
In yesterday's incident, at least one of the brothers apparently shot at the
three intruders after a "nonphysical confrontation," said Bill Toohey, a
police spokesman.
The state's attorney's office will investigate to determine whether criminal
charges should be filed and whether the shooting was in self-defense.
Maryland law permits the use of deadly force in self-defense, to defend others,
to protect one's property or when a person is in imminent danger of bodily harm
or death and there is no way to escape, said Byron L. Warnken, a criminal
law professor at the University of Baltimore School of Law.
Steinbach's death stunned business associates, who described him as a
young professional headed for a lucrative career.
"It doesn't make any sense to me," said Steinbach's real estate agent,
Craig Elliott. "He was definitely an entrepreneur trying to make a business for himself."
Elliott said Steinbach used to work for an architectural firm, but quit a
few years ago to open his tanning business and launch a career in real
estate. Steinbach grew up in Carroll County, but recently bought a $60,000
condominium on West Biddle Street and two Italian ice stands in
East Baltimore, Elliott said.
Steinbach, who had no Maryland criminal record, was the father of a
young son, friends said.
"This kid was on the ball ... smart, ambitious and very enterprising,"
said Nicholas Piscatelli, who owns the building that houses Steinbach's
tanning salon.
The owners of businesses located next to the concrete plant expressed
little sympathy for Steinbach yesterday. Frustrated by crime, they said they
stand behind the Geckles.
"The guys deserve a medal," said Mark Caropreso, the owner of Mark's Motors Inc.
"It sends a message out: You want to step on someone's property, you
deserve everything you get."
Some legal scholars said yesterday that the Geckles might face charges.
"You have to honestly believe there is imminent danger -- right now -- to
yourself or others," Warnken said.

A grand jury likely will be asked to decide whether criminal
charges should be filed against either of the brothers involved
in the shooting of three burglary suspects, a Baltimore County
assistant state's attorney said yesterday.
S. Ann Brobst, who is in charge of the case, said the incident
was "extremely serious" and presents "a lot of complicated issues."
Brobst said that she will begin reviewing the case after homicide
detectives complete their investigation, but that it could be weeks
before a final decision is made.
"I think this is the type of thing we want a grand jury to review,"
Brobst said, noting that jurors likely would have to sift through
"basic self-defense principles."
The incident occurred when at least one of the owners of the
Back River Supply Inc., in the 12200 block of Owings Mills Blvd.
in Glyndon, apparently shot three suspected burglars, one fatally,
early Monday morning. The brothers - Dominic A. Geckle, 31,
and Matthew J. Geckle, 36 - were keeping an all-night vigil with
shotguns at the concrete plant, which had been burglarized
twice during the weekend.
Baltimore County police have not identified the brothers, whose
names were obtained by The Sun through public records. Neither
one has a Maryland criminal record.
Jonathan B. Steinbach, 24, a businessman in Mount Vernon,
died of gunshot wounds at the scene. Yesterday, Baltimore County
police issued arrest warrants for the two wounded suspects.
Justin Storto, 21, of the 8700 block of Lisa Lane in Randallstown, is
charged with one count of second-degree burglary. Storto was
released from Maryland Shock Trauma Center late last night, a
hospital official said. Police had said Storto would be arrested when
he was released. Enrico L. Magliarella, 24, of the 600 block of St. Georges
Station Road in Reisterstown, is charged with two counts of second-degree burglary.
Police allege that Magliarella stole tools from the plant Saturday morning
and returned with Storto and Steinbach to burglarize the business Monday
morning. Magliarella is also at Shock Trauma, where he is in critical condition.
Both Magliarella and Storto have been arrested on theft charges during the
past year, according to court records.
Cpl. Vickie Warehime, a police spokeswoman, said police have found no
evidence that links Steinbach to the two earlier burglaries. His mother
and friends say Steinbach spent the weekend with his girlfriend.
"There [are] a lot of unanswered questions, and I want to get to the truth,"
said his mother, Janet Steinbach.
Steinbach said her son, who owned the Midtown Tanning Salon on
Cathedral Street in Baltimore and who had no Maryland criminal record,
used to be friends with Storto's older brother. She said Steinbach's girlfriend
told her that Storto called her son at 10 p.m. Sunday at his West Biddle
Street condominium and then picked him up.
According to police records, the brothers said they did not know any of
the burglary suspects.
An autopsy was conducted on Jonathan Steinbach yesterday, but police
and the state medical examiner's office refuse to say how many times or
where he was shot. Emergency personnel at the scene said it appeared
he was shot at least twice - in the abdomen and the head.
"Even if they were protecting property, I don't see why they had to take
such extreme measures, especially with a shotgun," Janet Steinbach said.
"They were just vultures, like vultures sitting there waiting for these kids. ...
All I know is they were laying there waiting and didn't bother turning the lights on."
Warehime said yesterday that a preliminary investigation determined that no
lights were on at the plant when the three men were shot. She also said police
have not recovered any weapons - except the two shotguns linked to the
brothers - from the scene.
Brobst said those issues, as well the concerns raised by Steinbach's
mother, will factor into any grand jury investigation.
Legal scholars say the case could hinge upon how the "castle doctrine" is
interpreted. The doctrine states that a person does not need to retreat from
an intruder when in his own home, but it is not clear whether the principle
applies to a place of business.
"A home in Maryland has an exalted status in terms of self-defense principle,"
Brobst said. "The business does not hold as high a status."
Brobst said the state's attorney's office has received several calls from
residents with differing opinions on whether charges should be filed.
A spokesman for the Maryland Rifle and Pistol Association, the state
affiliate of the National Rifle Association, said the organization supports
the Geckle brothers.

Completely understandable. Why I don't mind fun being poked at the "Beltway
bandits" there is a point at which pride in my state will take over. In your
case national pride is the factor and someone insulting that and using "you"
as a scapegoat does trash the nerves so I understand and to a great degree
heartily agree with you.

What I hate about this state is Emperor Parris I's crusade against firearms,
and now, Body armor.
Excuse me, if I work in a 7-11, I want body armor, and I want it NOW,
not after waiting for the State Police to finish checking up on me.
As for the Concealed Weapons Permit thingy, all of them IIRC have
to go thru the MD State Police. You have absolutely zero chance of
getting a CCW unless you're a politician, someone important (read: celebrity),
or have lots of money.

is that even if I moved to Western maryland or the Eastern Shore (where they
are very conservative), Montgomery County, PG County, Baltimore County,
and Baltimore City would still overrule my area's senators and push
anti-freedom bills through the senate.
Maryland is a perfect example of why the Electorial college
system is so damn important. Here, just 6 of the state's
60 federal districts can overrule the other 54.
Virginia is an option, but I'm leery of going there because
of the soccer moms' growing influence in Northern Virginia.

Incorrect. I knwo people who have CWPs. Most of them are not all that rich
(now some of them are holding government jobs with sensitive informaion in
their heads which would make most people a bit nervous and makes them
elligible). Also private detectives, off duty and retired police, MPs,
certain other military members, and in fact anyone who can present a valid
reason to the stte can get one. It ain't ALL that strict but it is limited
in scope and a tad expensive (though if you can afford to buy multiple Glock
17s its just a drop in the bucket).

How do you think I like it in Howard County? We are large enough to fight
back but barely. As such I have a certasin distaste for Montgomery and PG

Ummmm, only 8 Federal districts. There are 60 in state voting districts as

That's why you load the fuckers up with marbles. They are both 69Cal so they
both make perfect barrel filers though a marble at 300 fps is a little bit
more painful than a paintball.

Oh they exist but I'm working on a special semi-auto sniper paintball rifle,
its got a 21 inch rifled barrel along with scope, red-dot sight and an
electronic trigger. Oh yeah and I'm re working the compresion settings to
bring the muzzle velocity up to 900fps. It'll be competition illegal but fun
to lob paintballs a 1/4 mile downrange onto target.

Of course, you rock and roll on full auto in brief burst to ensure you paint
the targets whole face just to humiliate them and make them sit like little
bitches wiping paint off their masks while you calmy stroll into their base

No the old fasshioned way is Murderball (two teams and extreme violence)
after the bones are healed you'll just look back and laugh at the
disagreement.
Or there's milling (hitting each other for 3 minutes without making any
blocks or dodges) admittedly you wear sparring gear but it gets the
aggression out of the way.
Lastly theres Knuckles (Not the school game) you and the person you are
arguing with take it in turns punching each other in the face. First one to
break their knuckles (or fall unconscious/fail to stay standing) is the
loser. (strangely enough incidents of arguements drop dramatically
everytime this is introduced to a new squad).
