I just sent the following to your ISP as a forward of your last Spam
harassment hate e-mail.
This is SPAM, harassment and hate mail in clear violation of your AUP
/ TOS several state and federal laws. I have advised your user not to
be sending me any e-mail as he is probably jeopardizing his parents
commercial account. This appears to be the work of a teenaged child to
me.
This all started when your client started posting to the
alt.social-security-disability newsgroup telling everyone there to
throw away and not use the official government forms for filing their
claims and sending notices to SSA and not to use a lawyer when needed
in the claims process.
If you can not or will not prevent your customer from violating your
own AUP / TOS agreement and law against spam and harassment I can and
will but for me to do so My lawyer insist Charter.net be included in
the lawsuit. It's you choice. Let me know rather to advise my lawyer
to go ahead and file suit.
For your convenience I have copied and pasted portions of your TOS /
AUP after the header information and before the body of the harassing
spam from your customer that I feel your customer is violating. Please
contact me by Phone or e-mail should you need further information.

I just sent you another hate mail. I have also archived copies of the
ones you sent me.
I have been following the threads on this group for several months
now, mostly to check Medicare increases and COLA for 2008.
I have read more and more recently the sad stories of SSDI applicants
who are not approved, and their plight lasting years and years of
appeals. Most of those that I read appear to be in a worse condition
than I am.
So I thought I might share my experiences, to help those that are in
need of benefits.
When I first was in need of applying, I read that something like only
11% of first time applicants were approved. It was 2003, and I was
only 48, so that was another "black mark"; being under the age of 50.
I had some experience in the law, having been a paralegal for 3
years,
and I understood the importance of detail.
#1. Here is my number one advice. Don't use their forms. I called
them, and said can I create my own form, and just copy your questions
into it? They said yes. Their forms have one or two lines available
for very important open-ended questions, like "Please describe what
you do on a typical day" and "Describe any changes in your routine
since your condition began." So I created a Word document, and used
two pages just on those two questions alone.
#2. When given the opportunity to describe your condition, and its
effects, do not hold back, even if it is embarrassing to you. Those
that are going to approve/disapprove your application listen to you
more than they do your doctors. If you have difficulty with a bowel
movement, say it! If you can't reach the toilet paper without
experiencing pain, say it! If someone needs to help you out of bed,
or hold your hand while walking up or down the stairs, say it!
#3. Your application needs to be written very very well. If you
don't write well, then have someone help you. You might consider
using a recorder to answer the questions, and have someone else
transcribe the answers. SSDI can only go on what is written down,
not
what you had hoped to convey. "I have a life-threatening condition"
will never work.
#4. Include every thing that ever happened to you, in your entire
life, don't worry whether it is relevant or not. I was in the USMC
30
years ago, and I sought treatment for my neck pains. There is no
record of it, but it was true. I saw a chiropractor 25 years ago,
there were records, and I suspect they either found them, or just
believed me. Include every single doctor you ever saw, for anything.
#5. No matter what your condition is, that disables you, include
every other pain or condition you have. For example, if you are
blind
in one eye, and have osteoarthritis in your feet, say it! Don't
assume that the condition that YOU THINK disables you will be
sufficient for benefits; it may very well be that it does not, but a
combination of other problems might be!
#6. This is a tough one, but in my opinion DO NOT use an attorney.
They work on a contingency basis, and your case might not be at the
top of their list. And most law firms will assign the junior lawyers
to your case. And they know SQUAT! They are using you for training.
They are best at getting benefits for applicants who would have
qualified easily without their help. Find someone else who applied
for SSDI, and was successful, and ask for their advice. It is not
really a matter of law; certainly not a matter that "lawyers" were
prepared for in law school.
#7. This seems obvious, but apparently is not, from the posts I have
read. DON'T WORK! Once you are committed to applying, for the
assumed reason that your disability precludes you from working, DON'T
WORK! At least in my case, I could work a few days a week, but not a
whole week, therefore I could not hold a job. You have to be not
working for 6 months before you can apply for SSDI. Plus you have to
have the necessary work credits to qualify. Do your homework.
I am sure I can think of more things. I would be happy to help
anyone
on their original claim. I don't have any experience on appeals.

My comments in the group were for the group as a whole. your advice
although well meant is bad advice and I felt the need to make that
point very clear. Had I and others done less than point out how bad
your advice was someone could have believed it was the best way to go
and hurt their chances of getting the help they desperately need.
People that made it through the system without any help come in the
SSDI newsgroup a lot spewing their hatred for lawyers and trying to
get others to go through a long drawn out process without the legal
help many of these people need to get qualified. Those that get turned
down at their ALJ hearings because they followed such bad advice have
to either start over from scratch and lose part of the benefits they
should get because their credits have dropped off or they have to go
through a very long drawn out appeal process that can take many years.
I'm sorry if your feeling got hurt but the damage your bad advise
could cause warranted my response. You have the VA to turn to as I do.
Many of these people don't. What you failed to notice is you not only
said it was your experience but made a point of telling others your
way is the very best way when in fact you got lucky.
