3. Beneficiary In Representative Payment
Pay accumulated funds of less than $4,000 without development unless
otherwise indicated. Funds amounting to over $4,000 require evaluation
of the payee's ability to handle this large amount of funds if the
payee is not the beneficiary's:
a. Natural, step parent, or adoptive parent with custody of the
beneficiary;
b. Spouse with custody of the beneficiary;
c. Child with custody of the beneficiary;
d. Legal guardian;
e. Bank or trust company; or
f. Social agency or a public or nonprofit institution or organization
whose principal activities include direct care and maintenance or
treatment of children or incapable adults.

I am trying to figure out ,since the children live with me, all of them,
and their mother, if I can use these funds to help buy a new car. If all of
their needs are being met; I am not talking about a Escalade but damn our
cars are 140K milers and mom is the only one able to work I am dreading this
winter and her getting stuck somewhere.

You could make the argument that transportation is absolutely
necessary to "maintain the overall well being and stability of the
family unit" including transporting the children beneficiaries.
It will be a judgment call on the part of the rep payee authorizer.

For SS purposes, she needs to have a car to care for the kids. So, it

I think where people get fouled up is in a quick reading of that,
they tend to think the leftovers can be used for people in the family
who are not LEGAL DEPENDENTS. In the original poster's situation, he
wants to know if he can buy a new car for his wife based on this bit
from the POMS, IIRC. The answer is NO; BUT! He CAN buy a new car
because the children must have a car to get around in, go to doctors
etc. It just doesn't have anything to do with THIS paragraph.

The reference to this particular paragraph is in response to the
poster who asked where in the POMS is the allusion to using a
beneficiary's funds to support other family members.
The paragraph that we cited in earlier post and which may be used as
an argument for the car is also contained in that POMS section.
