DDS has the responsibility to prepare and mail a medical denial
letter. Local office has the responsibility for denials based on work
activity. Denial letter from the DDS should be prepared and mailed
the same month as the denial decision unless the decision is at the
end of the month in which case it could be sent the next month. Local
office is instructed not to notify you over the phone because they
don't know which cases will be randomly selected for QA review.
However, some local office employees have been known to ignore this
instruction.
You might want to ask the local office where the case is located,
i.e., still in the DDS or was it sent to DQB for QA review? If it's
still in the DDS, you could ask the local office for the DDS' phone
no. and call them directly. If you contact the disability examiner
handling your case, (s)he may not reveal the decision but should tell
you whether a decision has been made. If not, (s)he should be able to
give you a general idea as to what is holding up the case, e.g., still
waiting for a report.
If the case was sent to the DQB for QA review, getting through to
them is very difficult and even if you do, they won't give you any
satisfactory response.
The person who first handled my case at SSA ...sent it off to DDS and
they called me . I was instructed for two exams , and she said depending
on the outcome of those exams (mental and physical) she might send me
for a third exam (eye doctor) ,but all depends if they find me disabled
on the first two exams I take. That was completed in mid april and havnt
got another letter from DDS for the eye exam doctor or any other request
for medical records .Thats the only hope I think Im in .
Your friend's case is unusual. In that type of case, you at least
know that you have been allowed and they tell you how much is being
deducted before full pmts. start. This happens all the time in SSDI
cases involving worker's compensation deductions. I guess there are
exceptions to every procedure.
I'd still try to find the location of the folder and if the local ofc.
tells you that it's in the DDS, contact them.
Hold them to it. Give them 10 days and get back on the horn if
there's no response.
Meanwhile, I would still go after the DDS. They told you that they
wanted two exams and possibly a third one, if necessary. I would ask
them if they need that third exam and that you're ready, willing, and
able to comply.
If you received money from Social Services, SSA has to notify them of
the award and reto amounts. Someone there has to figure how much was
paid out during those months and tell SSA. How long it can take
depends very much on how quickly Social Services responds and how
quickly SSA then pays them.
