they have been "damaged" in some way. Normally this requires actual
financial damage, which blatherings on a newsgroup on the internet do not
normally cause. No matter how angry Ray or anyone else gets about what is
said here, even if it's libelous, if there is no proveable damage, there is
no lawsuit.
The Federal Rules of Civil Proceedure are readliy available, and Rule 11
provides sanctions for frivolous lawsuits. Even is Ray were to file such a
lawsuit, the other party has to be served withing 365 days or the suit is
dismissed for failure to prosecute. Federal Court is normally a very
expensive affair, however when someone files a frivolous suit such as a RICO
action, a motion for Summary Judgment or Dismissal is normally all that is
required to quash it. RICO is a very very difficult thing to prove, and
even though it's bandied about in a lot of different civil contexts, it's
innapropriate for most civil litigation, and certainly for anything that
goes on in this newsgroup.
I suggest that the lawsuit talk be given the exact amount of notice that I
give the one who blathers it constantly, hit the button and block the
ravings of the lunatic fringe.
