Ray Gordon's Google Lawsuit dead in water

For those unaware of it, Gordon Roy Parker of Philadelphia,
Pennsylvania, alias Ray Gordon, is suing Google claiming that their
caching and indexing of his website constitutes copyright infringement.
He wanted to change the status of an e-book he was giving away before
into one he had the belief he could charge for, but people were able to
obtain the originally free copy from Google's cache of his website, so
he decided to sue Google for something like a billion dollars.

Slashdot reported that the Electronic Frontier Foundation reported that
a Federal District Court in Nevada has ruled that Google's caching of
websites is fair use. Summary judgement granted to google on four grounds:

* Requesting an automatically cached webage is not infringement because
the initial copy was not infringing;
* Plaintiff gave an implicit license to copy by not using a no-archive
metatag;
* Google's caching of web sites is fair use;
* The action of caching as Google performs it fits the Section 512(b)
"safe harbor" provisions given to service providers under the DMCA.

As usual, the Ray Gordon Litigation train derails again in a spectacular
crash, or it will once Google gets the same decision in psychopath
Gordon Roy Parker's attempt to extort money from them. Maybe they can
demand attorneys fees and bankrupt him and confiscate his computer. One
can wish.

But wait... Gordo is still suing Google and claiming that by archiving his
own public statements about being Jesus or saying he wants to marry a 13
year old girl or that he can crash the stock market at will or that he had a
bondage session with Madonna... it constitutes defamation.

Once again, Paul Robinson jumps in, a day late and a dollar
short...

Contributing nothing new, nothing that wasn't already common
knowledge, and presuming that he is the end-all and be all of
how to handle this ongoing situation.

We have yet to see him *do* anything, other than tell people
what he thinks is wrong with them.

Still don't have any real advice, Paul? The only thing you've
offered so far, led most of us on a wild goose chase. The Philly
PD people we spoke to chuckled and said that it wasn't their
jurisdiction, because the "injury" took place were each of us
were, and that we should call our local PD, who openly laughed,
asked if it was real, and then told us to call Philly. So, that
circularity got us nowhere.

Got anything better?

Given the law firm that the idiot is taking on, I say legal fees are
going to be demanded. This law firm is one of those that never goes
anywhere alone. They always show up in a team and they aren't cheap.
WSGR bill will be 10s of thousand because they can ask for it and get
it. Ray will have to SELL a lot of stuff to pay for that.

Wow, that sounds like an anonymous threat/annoyance of the type the new
federal law was designed to stop.

(never mind that even in bankruptcy, one's computer would be protected, but
that's what happens when laypeople speak on things like that).

Also note the desire to suppress my free speech. Very telling.

From what... something like $435 a share at closing today?

That stock is up from a starting price of about 20 bucks a share back in
september of 04.

Yeah, I'm sure the execs over at google are crying themselves to sleep.
