Tonight I watched a documentary on Metallica, and although I am not into
them the documentary did hold my interest and I do have an appreciation for
them.
Then .......
On the news:
Metallica is sueing Victoria's secret for the use of Metallic for a make up
product.
They contend that Metallic is intended to confuse consumers.
Yeah contend like an ear bite.
This is a monument of stupidity.
If Metallica can sue for the use of Metallic, a word in the English language
before any of the band members were born.
Then can I sue them for using the word "a" since it too is in the dictionary
and I use it.
I'd hate for someone to confuse the word "a" with MetallicA in everything I
write and say.
I used the word a long before the band was even formed.
Maybe I can sue them.
They've got your money, and that a lot more money than I have. This seems
enough motivation and grounds for suing these days.
In the spirit of their music, I though they would be against this type of
greed and capitalism.

Well, actually, it wasn't "Metallic", it was "Metallica". So while I
agree that this is yet another sign, like we needed any more anyway,
that Metallica is a sellout, your point that they sued over a word that
was in the English language is actually not applicable.
And if anybody watched the Daily Show the other night, Jon Stewart said
something along the lines of: "Metallica's lead singer James Hetfield
first saw the eyeliner pencil at a party, where somebody pointed out to
him that that was the name of the band he was in."

Has anyone even considered that Metallica might not actually be behind
this, and that it might be Elektra or Q Prime?

Case in point, the recent cases where Alice Cooper was suing over
KISS's song Dreamin' that sounded too much like I'm Eighteen. The
record companies fought over that one, not the bands themselves.

Hey, that's just my thoughts on this. I never saw this view posted so
I decided to let some of your hear it.

get the facts straight. Victorias Secret has something named Metallica, not
just metallica. If it was just metallic, then everyone could sue Metallica
because the word metallic has been used for make-ups, paints, and other
things for years.

Yeah, but when Kiss sued King Diamond for ripping off their face make-up
(would you believe me if I said that Kiss' make-up is a registered
trademark, like Coca-Cola??) their record company was not involved. It was
pure Gene Simons' bullshit!
