Divyendu case: Appeal to community leaders and in public office to
come together

Sunday, July 4, 2010

You are aware of the horrific attack that lead to death of Dr.
Divyendu Sinha in front of his family at Old Bridge, New Jersey. The
senseless and horrific attack attracted large mainstream and local
media attention and their is great outrage in the community. In
just last 3 days more than 4000 people visited the website

http://justicefordivyendufamily.wordpress.com/
http://justicefordivyendufamily.wordpress.com/%20

and expressed their outrage. There are several among those visiting
from mainstream America.

Our community has come long since the 1987 dot busters gangs attacked
Indian Americans in Jersey city where the hate crimes aginst Indian
Americans peaked during 1987 to 1993. We have learned to come
together to respond to issues that is threatening our larger
community. But we cannot be complacent. Five years after Geetha
Angara was murdered at work place at Totowa, New Jersey and till
today the justice was not done to the family. This we understand was
because key evidence was destroyed at early stages combined with lack
of attention of media and the community. The murder of Dr. Divyendu
Sinha committed in front of his wife and two sons by five 17 year old
hoodlums needs the community to come together quickly so that the
evidence is properly collected and those who committed this barbaric
act are tried in proper manner such as being tried as adults. We
also need to ensure the bereaved family which lost their sole bread
winner is adequately compensated.

We need to take into account that if we do not act properly (and in
time), there is possibility we are opening door for more such
attacks. One of the people commenting on the website mentioned that
there are some facebook pages glorifying the death. While that
needs to be investigated, it is critical we send the right message to
those who think there are easy targets. Proper investigation is
needed to find out if there is also racial motive, irrespective of
the trouble they created to a driver in a car just few minutes
before they committed this gruesome murder.

Many members of our community have chosen to sacrifice their time and
resources in building temples, running cultural organizations,
arranging various programs in support of organizations in India and
US, but it is extremely important to discriminate and act on what is
critical which is in front of us that needs immediate attention.
Just as wise says, no amount of water will help the person who died
of thirst, no amount of work done later will help if we miss this
critical window.

We are fortunate that as the number of Indian Americans rose, many
have chosen to dedicate to serve the public cause and take various
positions in state and local administrations. But if those elected
body or in administration do not speak up or worse speak such as a
way to hurt the cause of getting proper justice due to some imaginary
fear of losing their position or support from mainstream for speaking
the truth then it is the most unfortunate thing. We are already
hearing an Indian American Official in local administration has
announced that the crime against Divyendu is not a hate crime. That
is unfortunate since the jury is out there and let the investigation
officials determine what the real motive of the case is. Then there
are others who are not speaking up or speaking up adequately. When
we stand behind truth and put our position in fair and objective
manner, majority of mainstream Americans respect and support it. It
is evident from the fact that many mainstream Americans commenting on
the website expressing their outrage.

Various activities can be planned if there is adequate support.
Several people are urging a march or vigil but such steps will be
effective only if there is strong showing of support. While larger
participation of community leaders in various organizations is
requested and is necessary, your minimum help immediately can be as
simple as timely propagation of the messages (email) to all your
members community and urging them to participate in the activities
and provide assistance to the family.

Please let us know if you will be able to help by sending email to
justicefordivyendufam...@gmail.com (or respond to this email).
Updated information will be on the website

Dear Friends:

Namaste. It is with a very heavy heart and profound grief that I
share with you the news of terrible beating and resulting death of
Dr. Divyendu Sinha of Old Bridge, NJ. By now many of you may have
heard, read or seen the news on TV.

Dr. Divyendu Sinha was a Life Member of Vishwa Hindu Parishad of
America. He was a brilliant technocrat who earned his B. Tech. in
Computer Science and Engineering from the Indian Institute of
Technology and a Ph.D. in Computer Science from Stevens Institute
of Technology. He was working for Siemens corporation.

Divyenduji, his wife Alkabahen and children, Ashish (16 years) and
Ravi (12 years) had stepped out of their home to take a late night
stroll on Friday, June 25 in a perfectly safe neighborhood where they
have lived for sixteen years. This is a neighborhood where people do
not lock front doors and cars are left unlocked in driveways. As
they were returning back and were near their home around mid night, a
car full of five teenagers (two Caucasians, three African Americans)
pulled up; the driver stayed in the car and rest of them came from
behind and attacked Divyenduji and his two sons. He was hit on the
temple, he fell down and hit his head on the pavement. The
attacker(s) continued to kick him on the head and neck. After the
attack they escaped in the car. Divyenduji was able to get up so
they tried to walk him to their home. However, after walking a few
yards, he collapsed. At that point his son ran to nearby house and
the neighbor came out and called 911. He was transported to nearby
Raritan Bay Hospital. At that time (around 12:30 A. M.) he was able
to answer questions like his name, birth date, etc. though his speech
had begun to slur. He could not raise his left hand but was able to
raise right hand . Soon after he became unconscious and by 4:00 A.
M. he was transferred to Robert Wood Johnson Hospital in New
Brunswick. This hospital has excellent reputation. The children had
bruises, swollen jaw, neck pain, etc. but they were treated at the
hospital and released.

According to the neurosurgeon who briefed us, by the time Divyenduji
reached there, damage was done. There was severe cranial bleeding in
the brain and brain had swelled so much that it had compressed brain
stem which had affected all vital functions adversely. The brain had
also shifted because of tremendous pressure within the enclosed
chamber.

According to the doctor, the compression of the stem is an
irreversible process. One thing that was disturbing was that this
surgeon had not looked at the reports from the first hospital and was
not even sure if the reports and scans had accompanied the patient.
He was not even aware of the fact that Divyenduji had been beaten up.
He said that the bleeding had a pattern of a stroke but when we asked
pointed questions, he admitted that the stroke was likely the result
of the beating and trauma caused by it. VHPA volunteers from Staten
Island and New Jersey chapters as well Divyenduji's neighbors and
friends had reached the hospital and were there throughout the two
and a half day ordeal. Dr. Ila Sukhadia, President of Staten Island
Chapter insisted on receiving a copy of all CATscans and having
received them shared it with three outside specialists. Sadly, they
concurred with the diagnosis that nothing could be done to save
Divyendubhai's life. Divyendubhai's younger brother, Purnendu and
Alkabahen's younger brother, Alok were able to catch a flight out of
Bharat upon receiving the news and reached the hospital on Saturday
afternoon. While Divyendyji remained on life support, we all hoped
for a miracle and continued to do chanting and prayers in his ICU
room.

On Sunday, the doctors advised that they would be doing two tests,
six hours apart to check if the brain was sending any signals. If
results were negative than they would declare that the life had ended
and the life support could not longer be maintained. First test was
done at 9:00 P.M. and the results were disappointing. Second test was
carried out at 3:00 A. M. on Monday and at 4:00 A. M. Doctors
declared that Diveyenduji life had ended. Thus all our hopes against
hope were dashed. A life was snuffed out needlessly at prime age of
49.

The family decided to donate his kidneys so life support was
continued.

Finally at 4:30 P. M. on Monday, June 28, family and friends gathered
around Divyenduji, lighted a lamp, put Gangajal and Tulsipatra in his
mouth and amid chanting and recitation of sacred mantras, the body
was moved to Operation room.

The funeral is scheduled for tomorrow.

Details of the funeral are:

Prakashbhai Waghmare, a member of NJ chapter, former Governing
Council Member and our Resident Media Director, immediately alerted
ethnic as well as mainstream media and also wrote to the mayor of Old
Bridge. Response was tremendous; he was interviewed by the radio
station 1010WIN, had a call from the mayor and on his recommendation,
Channel 7, WABC interviewed Ilabahen; this interview was broadcast on
Monday, June 28 evening.

Satyanarayan Dosapati a community activist from Old Bridge has
created a web site:

http://justicefordivyendufamily.wordpress.com/

You may leave your message there. Divyenduji's biography also
appears on this web site.

It is good to know that all five teenagers are now in police custody.
Debate will go on about whether it was a random attack or one with
racial overtones but the fact is that we have lost a colleague, a
brilliant man and the family has lost everything. We urge all of you
to help us put continued pressure on the police, prosecutors and
politicians so that the case is not watered down, the guilty are
punished to the fullest extent of law and such senseless attacks on
innocent, law abiding citizens may be prevented.

We further seek your support as we help Akabahen and her children put
pieces of their life together; this will be a daunting task which
will require long time commitment of genuine support- emotional,
physical and financial. With the consent of the family, we would
like to raise funds to support their legal as well as other needs.

Few hours my wife and me visited Divyendu Sinha's funeral. We saw
many hundreds of people across the cross section of races whose lives
Divyendu and his family touched.

It was heart breaking to see his wife and two teenage sons who lost
their loved one in a senseless attack. What is tragic is they have
to bear the loss with the images of the the brutal attack done in
front of their eyes, for no reason, no provocation while they tried
to stop helplessly.

Those who came up and gave eulogies are from the cross sections, from
the PhD student who said how he used to enjoy Indian food at their
home, to his manager at Siemens who could not control his grief and
sorrow and pledged to do his best to see the family through, to the
faculty member at College of Staten Island who want to start a
scholarship (or funding) program in his name and many friends who
accounted their memories and his scholarship. The priest who
conducted the ceremony has done a great job of informing the ceremony
procedure to those who are not acquainted.

Though this loss is primarily to his family and to his close
relatives and friends, but it is also that of larger community. If
one family is insecure, it is insecurity for all of us. It could be
anyone of us. We do not know the motives of those who attacked, it
could be racial, it could be first easy target they found to
perpetrate their gruesome violence and perhaps Indian Americans in
their view are easy targets.

What next? While we are attentive to this now, it cannot be a
matter of first few days. The family has to continue and they would
need support, emotionally, financially and legally. The family has
to go on and there are two teenagers who needs to go to college.

We have to ensure that justice is done to the family and community
can play a big role in showing support. Many times these cases are
diluted with the affected getting little support in the end. This
case has to be pursued effectively in both criminal and civil courts.
The civil courts have to pursued to ensure that the family is
compensated adequately for the loss of sole incoming member of the
family.

In helping them we are helping ourselves. We have to come together
as a community and be their larger family.

About 800 attended a candlelight Vigil on Sunday, July 18th, 2010 at
Old Bridge High School to honor the memory of Dr.Divyendu Sinha

New Jersey, July 18, 2010: Over 800 people attended a Vigil and
Memorial service held in honor of Dr. Divyendu Sinha who was fatally
attacked near his home on June 25, 2010 in front of his wife and two
sons at Old Bridge, New Jersey. Old Bridge Township officials, Old
Bridge Board of Education members, State Legislators, Old Bridge
community as well as members of the Indian-American Community at
large, including leaders of other organizations such as Anti
Defamation League (ADL) and Japanese American Citizens League
participated in the vigil.

The community expressed grief for the loss of Dr. Sinha’s life. Dr.
Sinha was a brilliant technologist who had made many contributions to
the field of science. More importantly Dr. Sinha was a law abiding
American living in what he thought was a safe community of Old
Bridge. Representatives of the Sinha family and close friends
expressed their gratitude to the community for their support.
Lawrence Cooper of ADL said Jewish people will stand together with
Indian American community, shoulder to shoulder and denounce the
crime. Indian American elected leaders Sudhanshu Prasad and
representative on behalf of Upendra Chivukula called for firm action.

While the Township’s administration and the Board of Education
expressed their sorrow over the tragedy, many speakers wanted to know
as to why the Township Administration and the School Board had been
ignoring the telltale signs of the tragedy. It was pointed that the
tragedy did not suddenly occur on the day of the attack, but its
signs were very obvious much earlier.

A website that has been set up to petition the Middlesex county
prosecutor and other authorities to bring justice to Dr. Sinha’s
family for this heinous crime, has received over 30,000 hits (with
nearly 10,000 signing the petition) to date. Some comments stated
that their children were aware who the perpetrators of the crime who
were bullies at school but school chose to ignore because they are
valuable as good athletes to school team. A reporter, who covered the
story and happens to live in the same development as Dr. Sinha,
mentioned that her Chinese American neighbor is terrified about the
bullying practices by certain elements of the school. The community
wanted to know how and why the school administration had overlooked
such incidents. The superintendent responded by saying that the
school would not condone bullying regardless of an individual’s
athletic skills.

The town’s administration was queried about several incidents of
harassment and bullying reported by citizens of township during the
town hall meeting on June 29th arranged after the attack. One
community leader who had interviewed the residents of the area
highlighted examples of rowdy behavior by certain elements in the
neighborhood and subsequent inaction by the police when such
incidents were reported.

The message conveyed by several speakers was that the Township and
School Board would have to take responsibility for the tragedy and
take every step in their power to ensure that this incident was not
repeated.

The vigil ended on a positive note where the community leaders and
the community at large who had assembled, expressed appreciation that
following the incident the administration as well as the school board
have been very cooperative and forthcoming in extending help to the
family and the community.

The elected officials offered to work diligently to serve justice.
The community promised to keep up the vigil until justice is served,
and the community agreed to foster harmony among citizens of all
races and religions.

Indian American community, comprising of several Organizations in
tri-state arranged the program under the leadership of Pradip (Peter)
Kothari. For additional information, contact Satya or Sreedhar at
847-462-4692.

Divyendu case: Appeal to community leaders and in public office to

Sunday, July 4, 2010

You are aware of the horrific attack that lead to death of Dr.

senseless and horrific attack attracted large mainstream and local

have chosen to dedicate to serve the public cause and take various
positions in state and local administrations.

IITian killed in New Jersey attack

TNN
The Times of India
Wednesday, June 30, 2010

Washington - An IIT-ian who was assaulted by three juveniles while on
a walk with his family in a New Jersey suburb succumbed to his
injuries on Monday, police and family friends said. The assailants
have been arrested.

Divyendu Sinha, 49, an alumnus of IIT Kharagpur died after battling
injuries sustained in an attack by three 17-year-old delinquents in
New Brunswick when he was walking with his family near his home
around 11.40pm. His two sons, one a 10-year-old and the other a high
school student, suffered minor injuries and his wife was unhurt.

No reasons were given for the attack in which no weapons were used.
Police said initial reports did not indicate the attack was racially
motivated.

The three 17-year-olds, whose names were withheld because of their
age, were initially charged with aggravated assault which was later
changed to murder and conspiracy to commit murder after Sinha's death
at the Robert Wood Johnson hospital, nearly two days after the
attack.

Friends said Sinha was a computer scientist who was working as a
technology officer at Siemens. After graduating from IIT Kharagpur,
he earned a doctorate in computer science from the Stevens Institute
of Technology in Hoboken, New Jersey. He served on the faculties of
the Institute and Staten Island College.

Horrific Racial Attack on Indian Family in NJ

Saturday, June 26, 2010

There is a horrific attack on Indian family (Prof Sinha, his wife and
two teenage children) in Old Bridge, Central New Jersey area and help
is requested to contact media (Local/National TV, Radio Stations and
print media). Below are details of the case.

(Note that the next few days are crucial if this family will get any
justice. Few years ago an Indian woman was thrown into a huge water
tank at work place in Holmdel, Central NJ and till today there is no
justice done to the family and lack of media attention is believed to
have played a big part).

- - -

On Friday June 25, there was a mean spirited horrific attack on an
Indian family on Fela Drive in Oldbridge, N.J. As per routine Prof.
Dr Divyendu Sinha, his wife Alka and two teenage children were on
evening walk in their community when for no apparent reason, a car
full of teenagers (reportedly four) came and pounced on them beating,
kicking with such severe force that Dr Sinha, is in 'S.I.C.U.',
hanging by a thread for his life in "Robert Wood Johnson Hospital",
in New Brunswick, N.J. His children, Ashish & Ravi, who were also the
victims are going through MRI and other tests and are under
'observation'.

At this moment, the prognosis regarding Dr Sinha, a brilliant
technocrat who was recently working as a Consultant to "Siemens
Corp", is extremely bleak.

This incidence has galvanized and outraged the entire Indian
Community in NY/NJ area reviving their fears for their safety. New
Jersey has a very dubious history when it comes to 'Racial'
incidences. As the highly educated, entrepreneurial Indian
community started realizing 'American Dream' with economic success,
there had been series of racial attacks on them, starting with 'dot-
busters' incidences in early' 80s. In this incidence the community is
clamouring for expedited open investigation and demanding to bring
culprits to immediate Justice.

Nobody knows what progress the police have made in this incidence, so
far.

FOR YOUR INFO -- The following writeup was sent by me to all the
Indian PRINT Media, "NY Times" & "Star-Ledger". Can some of you pl

Dear Editor, -- I sincerely request you to give, not only wide
coverage (with your own digging/input) to following horrific racial
attack but also to follow it up with the "Authorities" for in-depth
investigation and give justice to the Indian Community. As
investigative journalist, pl help us bring culprits to the Justice.
