NOTRE DAME SUES OBAMA ADMINISTRATION

By Liz Goodwin
ABC News
May 21, 2012

On Monday, the University of Notre Dame joined six other Protestant
and Catholic colleges in suing the Obama administration over its rule
that all employers must offer contraception without a copay in their
insurance plans.

Obama gave the commencement address at the prominent Catholic
university in 2009.

In its suit, the school says that health care reform's contraception
mandate violates its religious freedom and would require it to go
against Catholic principles by offering contraception and
sterilization to students and faculty in its insurance plan. The
university serves 11,500 students of different religious faiths, and
has always been led by a Catholic priest as president.

The Obama administration announced in February that religious
organizations such as schools and hospitals would not have to offer
birth control to its employees. Instead, the insurance company would
contact women covered by its plan and offer the contraception. The
U.S. Conference of Catholic Bishops and other religious organizations
objected to this, saying that the organizations' premiums would still
be helping to pay for the contraception in that scenario. In its suit,
the University of Notre Dame says it is self-insured, which means this
accommodation would not work for them.

A Department of Health and Human Services spokeswoman told Yahoo News
that she couldn't comment on pending litigation, but that the
department is still forming its contraception rule for self-insured
religious schools.

Employers' insurance plans will have to offer birth control starting
this August, but religious organizations will have another year before
they must, too. Churches are exempt from the rule.

I place economy among the 1st and most important virtues, and public
debt as the greatest of dangers to be feared. To preserve our
independence we must not let our rulers load us with perpetual debt.
If we run into such debt we must be taxed in our meat and drink, in
our necessities and in our comforts, in our labor and amusements. If
we can prevent the government from wasting the labor of the people
under the pretense of caring for them, they will be happy. Thomas
Jefferson, The Notes, page 109.

ask what you can do for your country. John F. Kennedy, January 20,

Stupid, just stupid. The RC's are trying to save a bundle of money by
opting out of paying anything extra for health care for all their
employees. That's what this is really all about!

Hi Nick,

I can only guess what you were replying to as my filter knocked out
the original and you did not quote any of it.

I am surmising that something was said about the Roman Catholics'
suing over birth control being forced on them in their insurance
plans. If this is the case, we must support them on this.
How would you like it if Orthodox insurance plans for the clergy,
etc., were forced to pay for abortion? If we do not protect
other's religious freedom, the loss of our will be next. And,
it is also the right thing to do.

If I surmised wrong, then never mind.

Todd,

There is no doubt that there is a separation between church & state
and one can't impose it's will on the other. However, this argument is
strictly financial. Not Obama destroying the Church or it's teachings,
but financial. What the healthcare initiatives state are that "ALL"
people are covered, not just some. The RC's will save a ton of money
with this tactic, but the healthcare initiatives are not about an
attack on any church, it's all about $$$$$$$$$$$$$$.

The government is imposing something that is counter to
a religion's teaching. It is all about Dear Leader trying
to get re-elected. This is all part of his phony, made up
Republican "War on Woman". It need to go down in shame
and flames.

First they came for the Jews and I did not speak out because
I was not a Jew.

Then they came for the Communists and I did not speak out
because I was not a Communist.

Then they came for the trade unionists and I did not speak
out because I was not a trade unionist.

Then they came for me and there was no one left to speak
out for me.

"This" is the requirement that in the USA employers who provide health
insurance for their employees are being required to provide insurance
that covers birth control products and abortions. Roman Catholic (and
many other) hospitals and other organizations are, not surprisingly,
objecting.

Of, course, in a country with a sensible health care system, health
insurance would not be provided by employers at all. In that case each
person would be able to choose an insurance policy that covered what
he/she wanted covered. If such a system existed in the USA, it would
also have the advantage that each person would know how outrageously
expensive health care is in the USA; many have no idea, because their
employers are footing the bill -- a system that came about decades ago
when wages were frozen and employers seeking to attract more qualified
workers were obliged to offer non-wage incentives.

Hi Perce,

A well written analysis.

Ever strike you as "odd" that the Administration is using the
Interstate Commerce Clause to defend in the Supreme Court laws
imposed on a product that "by law" can not be sold across state line?

Oh, right.

I thought it was something to do with fighting Irish, and I thought the
Orthodox didn't have a dog in that fight; it was strictly a Catholic-
Protestant one.

Hi Steve,

This is a freedom of religion issue. Dog or no dog, all
religious Americans need to stand together on this one.
I would hope others would stand with us if the government
decided to deny us health care because we ate weird food
during lent, or decided we had to provide free abortion
in our clergy health care packages.

And, of course, a major religion sues the president
and American Pravda refused to cover it.
