White House press secretary Jen Psaki on Friday confirmed that President
Biden intends to sign executive orders on gun control.

Psaki replied “Yes” to a journalist’s question about whether reporters
should “be expecting executive orders from the president on gun measures.”

But she said the timing was unclear due to a review process.

“When the president was the vice president in the Obama-Biden
administration, he helped put in place 23 executive actions to combat gun
violence. It’s one of the levers that we can use,” Psaki said at her daily
press briefing.

The new gun control push by Democrats follows the murders on Monday of 10
people at a Boulder, Colo., grocery store. Last week, a gunman killed
eight at Atlanta-area massage parlors.

The White House is considering orders to require background checks for
“ghost guns” that can be manufactured at home without serial numbers and a
requirement that local cops be notified if someone fails an FBI background
check to buy a gun from a registered dealer, according to recent reports.

The reported orders under consideration aren’t necessarily applicable to
the recent shootings.

Suspected Atlanta shooter Robert Long, 21, reportedly bought a semi-
automatic firearm from a dealer after passing a background check on the
day of the killings. Suspected Boulder gunman Ahmad Al Aliwi Alissa, also
21, bought a Ruger AR-556 pistol after passing a background check six days
before the attack.

Biden called for gun control legislation Tuesday in a speech at the White
House, but significant reforms are unlikely to pass the evenly divided
Senate, where 60 votes generally are needed to pass bills.

Thirty-five Senate Democrats introduced legislation this month to ban
“assault weapons” including popular semi-automatic guns such as AR-15-
style rifles. But it’s not likely to pass. Bipartisan legislation
previously failed to expand mandatory background checks to cover private
gun transfers among non-dealers.

As vice president, Biden led a federal gun control task force formed in
late 2012 after the mass murder of 27 at a Connecticut elementary school.
At the time, Biden dispensed gun advice that lawyers said could violate
existing laws, including encouraging people to shoot guns in the air and
through closed doors to combat possible threats.

WASHINGTON — President Biden on Thursday announced a slew of new gun
control measures after a recent pair of high-profile mass shootings, and
insisted the Second Amendment doesn’t grant an absolute right to own guns.

Biden presented the executive actions in the Rose Garden, joined by
Attorney General Merrick Garland and Vice President Kamala Harris.

“No amendment to the Constitution is absolute,” Biden maintained, pointing
to the famous Supreme Court ruling that you can’t yell fire in a crowded
theater as part of the First Amendment’s free speech clause.

“You can’t yell … ‘fire’ in a crowded movie theater and call it freedom of
speech. From the very beginning, you couldn’t own any weapon you wanted
to own. From the very beginning that the Second Amendment existed, certain
people weren’t allowed to have weapons. So the idea is just bizarre to
suggest that some of the things we’re recommending are contrary to the
Constitution,” he said.

“Gun violence in this country is an epidemic. Let me say it again: Gun
violence in this country is an epidemic, and it’s an international
embarrassment.”

The most widely anticipated measure instructs the Justice Department to
issue a proposed regulation within 30 days to undermine the at-home
manufacture of so-called “ghost guns,” which can be made with equipment
that drills and folds metal parts. Activists who oppose gun control have
promoted the technology.

“Anyone from a criminal to a terrorist can buy this kit [and in] as little
as 30 minutes put together a weapon,” Biden said. “I want to see these
kits treated as firearms.”

Another action orders the Justice Department to issue a regulation within
60 days that would “make clear when a device marketed as a stabilizing
brace effectively turns a pistol into a short-barreled rifle subject to
the requirements of the National Firearms Act.”

The White House said in a fact sheet, “The alleged shooter in the Boulder
tragedy last month appears to have used a pistol with an arm brace, which
can make a firearm more stable and accurate while still being
concealable.” However, the alleged gunman passed a federal background
check before purchasing his weapon and it’s unclear if the new policy
could have meaningfully altered the tragedy.

Another Biden rule orders the Justice Department to propose model
legislation on “red flag” laws that states would have the option of
adopting. The president said he also wants a national red flag law.

“Red flag laws allow family members or law enforcement to petition for a
court order temporarily barring people in crisis from accessing firearms
if they present a danger to themselves or others,” the White House fact
sheet said.

Biden also is ordering a report from the Bureau of Alcohol, Tobacco,
Firearms and Explosives on the illegal firearms trade. And on Wednesday,
Biden announced that he would nominate gun control advocate David Chipman
to lead the ATF.

Gun control gained political momentum after the massacre of 10 people at a
Boulder, Colo., grocery store last month and the murder of eight at
Atlanta-area massage parlors.

“You probably didn’t hear it, but between those two incidents, less than
one week apart, there are more than 850 additional shootings — 850 — that
took the lives of more than 250 people and left 500 injured. This is an
epidemic, for God’s sake, and it has to stop,” Biden said in the Rose
Garden.

“Every day in this country, 360 people are shot. Every single day, 106 of
them die.”

Biden said the federal government also will see about funding local anti-
gun efforts in cities that are experiencing a spike in murders. Garland
said his department would make available $1 billion in grants for
“evidence-based intervention strategies,” such as paying former criminals
to act as “violence interrupters.”

“Cities across the country experienced historic spikes and homicides. As
law enforcement can tell you, the violence is hitting black and brown
communities the hardest. Homicide is the leading cause of death of black
boys and men ages 15 to 34,” Biden said.

“There are programs have demonstrated that they can reduce homicides by up
to 60 percent in urban communities. And many of these have been badly
underfunded or not funded at all of late.”

But the new executive actions would not necessarily have prevented the
recent mass shootings.

He said that “if the Lord came out and said, ‘Joe, you get one of these,'”
he would eliminate legal immunity for gun manufacturers.

Biden said he supported legislation introduced last month by 35 Senate
Democrats to ban “assault weapons” including popular semi-automatic guns
such as AR-15-style rifles. And he endorsed an effort to expand mandatory
background checks to cover private gun transfers among non-dealers. But
neither measure is likely to pass the Senate. A bipartisan background
check compromise has failed since 2013.

Federal litigation in recent decades expanded gun rights, establishing
that an individual right to own guns is protected by the Second Amendment
and knocking away local bans on handguns and restrictions on concealed
carry permits.

Former President Donald Trump’s administration in 2018 banned via
regulation the use of “bump stocks,” which allow semi-automatic guns to
fire more rapidly, after the mass murder of 60 at a Las Vegas country
music concert. The Supreme Court turned down a challenge to that ban.

Let's give Biden the benefit of the doubt and assume his goal
is to deter gun violence. My challenge: show how these proposals
would achieve that goal. Sub-challenge: Pick any past act of
gun violence. Explain how that violence would have been prevented
if Biden's gun control proposals were already law.
