It's happened. The reason for my lack of excitement is that the time
needed to resolve this suit is longer than the time Obama can possibly
remain in office. And when he leaves office, it will become moot.

What part of Watergate did you miss? I suggest you read the 8-0
Supreme Court decision United States v. Nixon, 418 U.S. 683 (1974).

In summary, Warren Burger and the Supremes informed Tricky Dick
that the "Divine Right of Kings" is a Fairy Tale.

This isn't true, as US v Nixon shows. The courts don't like to get
involved in disputes that are technically about legal issues but that
are really political dog fights.

U.S. v. Nixon is not a good illustrative example of the
federal courts' willingness or nor to become involved in a dispute
between a POTUS and congress.
While it is true that that litigation occurred against a
background of such a dispute, of congress investigating whether to
impeach the president and apparently of being on the verge of doing
exactly that, the case itself arose in a criminal law context:
It was not congress and instead a special prosecutor following
widespread public anger at Nixon having summarily fired a prior duly
appointed independent prosecutor who obtained a criminal grand jury
subpoena for the tapes as part of an independent grand jury
investigation and it was the president's refusal to comply with that
subpoena that resulted in the Supremes' unanimous ruling.

An excellent point, but see the DC Circuit's ruling in Senate Select
Committee v Nixon. In deciding for the executive, the court was not shy
about instructing the Select Committee on its duties and indeed its role
in Congressional business.

Issa's committee has been timing its legal moves politically, to force
television news to report in earnest along with, I believe, the speech
of Obama's handpicked key-note speaker, San Antonio's Mexican Mayor.

Nonetheless the charges are not only valid but also imperative.

US news jumped on the break-in resulting in Watergate. It is a sign of
how the US meida has long been co-opted to not only not jump on the
murders resulting from Fast & Furious, but also a condemnation of the
media to not even assign investigative reporters to instead propagate
the DOJ's excuse: that Fast & Furious must be a mere "botch-job." And
why? Because Holder says so.

Imagine the news having simply accepted Agnew's excuses?

Despite the best efforts of, essentially, those most engaged in
co-opting the media in their shameless down-play of the issue*,
the issue is no mere "political dog-fight."

And the judiciary knows it.

Obama and Holder have challenged Congress's Constitutionally empowerment
for oversight including subpoena power.

If it turns out the judiciary is disinterested, it will be far more
indicative of its long having been co-opted also and not for any
traditional reluctance.

*They do so to protect Holder and Obama per se, but to protect the MxGov
and Calderon.


Meanwhile, there are reports and commentaries though from the
hinterland; and they are mounting and damning.

Republican congressional investigators continue to document the whole
sorry Fast and Furious affair. And while there�s plenty of blame to go

The first of three reports, obtained by the Los Angeles Times before its
release, concludes that five senior Bureau of Alcohol, Tobacco, Firearms
and Explosives officials � including its special agent in charge in
Phoenix and top man in Washington � share responsibility, citing their
�missteps, poor judgments and inherently reckless strategy.�

ATF allowed about 2,500 illegal gun sales in Arizona but failed to track
those guns to Mexican drug cartels as intended. Two were found at the
scene of U.S. Border Patrol Agent Brian Terry�s killing.

Two others were recovered after a Mexican state attorney general�s
brother was killed � and that first report says those five ATF officials
tried to hide that fact from Mexico�s government.

The other reports will deal with Justice�s �devastating failure of
supervision and leadership� and �unprecedented obstruction� of the
congressional probe at the department�s �highest levels� � which lately
earned Mr. Holder a contempt-of-Congress citation for withholding
subpoenaed documents.

However culpable others within Justice may be, the buck stops with
Holder, confirming that he�s manifestly unfit to remain the nation�s top
law enforcement officer.

Issa has backed himself into a corner. He's referred a criminal
contempt citation to the USA for DC, who laughed in his face. He's got
a civil suit ginned up to try to force Holder's hand, but the run time
on that exceeds the maximum time Obama could spend in office. He just
looks weak and foolish. All he's got left is inherent contempt. Let's
see if he's stupid enough to try to arrest the AG.

The judiciary is gonna kick this can down the road. My bet? The first
court to hear the civil suit dismisses it because Issa hasn't pursued a
compromise on disclosure.

They have, but they've asserted their own power to hold things
confidential under executive privilege. Obama hasn't made Nixon's
mistake: his claim is specific to certain documents prepared for
consultations between him and his top officers.

Yet, the Obama administration, in its manic quest for secrecy, has
pushed very hard in court to prevent the release of obsolete but
historical materials:

"On June 24 and 25, 1975, Nixon gave secret testimony to a grand jury.
According to news reports at the time, Nixon answered questions about
the 18-1/2 minute tape gap, altering White House tape transcripts turned
over to the House Judiciary Committee, using the Internal Revenue
Service to harass political enemies, and a $100,000 contribution from
billionaire Howard Hughes. Aided by the Public Citizen Litigation Group,
the historian Stanley Kutler, who has written several books about Nixon
and Watergate, sued for release of the transcripts of the testimony.[64]
President Obama's justice department opposed the transcripts release on
privacy grounds. On July 29, 2011, the U.S. District Judge Royce
Lamberth granted Kutler's request, saying that historical interests
trumped privacy interests. He noted that Nixon and other key figures
likely to be mentioned were deceased and most of the surviving figures
had testified under oath, written about or were interviewed about
Watergate. The transcripts were not immediately released pending the
government's decision on whether to appeal.[64] They were released in
their entirety on November 10, 2011, although the names of people still

Congress never has standing in these cases anyway so it will be
summarily tossed unless a Repug judge thinks it has some political
effect which it probably doesn't.

Why don't Repugs talk to their buddies at a GOP shill tank and get

Of course Congress has standing in these cases. It's their subpoena
that they're tried to get enforced. There's no "particularized harm"
standard as in suits for damages.

It happens often. The suer addresses the lawsuit as 'The Person's Actual
Name' as (or in the capacity of) the 'Title of Office' of 'Whatever
Office of Government'.

Do you have any cites for this? You don't suppose that Monica Lewinsky
could have sued Clinton for harassment had she not been a willing
participant?

Private citizens sue public officials all the time. In this case,
though, private individuals have no standing to enforce Congressional
subpoenas.

Oh, good. Don Gazpacho weighs in with his extensive knowledge of the law.

Generally, you can't sue a state or the feds directly, and unless they
agree, you can't sue them for damages at all. What you can do is sue
them for injunctive relief if your rights have been violated or if he's
failed to perform a ministerial duty on your behalf. But it's your
rights that have to be violated. You can't sue Holder because he's
ignoring a Congressional subpoena. Congress has to do that.

Clinton v Jones (1997)

Petitioner promptly advised the Federal District Court that he would
file a motion to dismiss on Presidential immunity grounds, and requested
that all other pleadings and motions be deferred until the immunity
issue was resolved. After the court granted that request, petitioner
filed a motion to dismiss without prejudice and to toll any applicable
statutes of limitation during his Presidency.

This says the suit on prior damages could proceed. It doesn't say it
would have failed had the damages been contemporaneous with holding office.

and Washington Post journalists were afraid they'd witnessed a gaffe at
the AIPAC speech. They couldn't let it stand. They chased down the

I think Don Gazpacho is responding to your question above about a
private citizen suing a currently serving official. And he's found an
interesting case, although it has no bearing on the F&F civil against
Holder.

Baby Zivotofsky as born in Jerusalem to US citizen parents, and he met
the requirements for citizenship at birth. Congress had passed a law
directing the state department to issue passports for such people
stating the place of birth as "Jerusalem, Israel." The State Department
refused to comply, and Baby Z sued Clinton, the Secretary of State,
asking that the court direct her to issue the passport as requested.

So here's a case where a private citizen has sued a public official for
a current grievance. Two things to note: 1) Baby Z isn't suing for
damages. That's not allowed, and 2) Baby Z is suing to have the
Secretary perform a ministerial duty, i.e., one in which she has no
discretion. That's required.

The State Department has claimed that the law is unconstitutional as it
interferes with the executive's conduct of foreign policy. I don't
understand the reluctance. The only relevant foreign policy issue
concerning Jerusalem is about recognizing that city as Israel's
capital. Which the passport doesn't and couldn't do. After all, part
of Jerusalem has been Israeli since 1949.

as children, learning about civics and history, that we might be
required to fund and fight for the jews in israel. US intervention in

prop up a religious state, using our soldiers to fight their war with

They should fund their own charities and support their own religious

Reducing regulations is primary since regulation is what stifles
commerce, the more regulations, the more it costs our economy. Most
regulations are used by existing businesses to reduce competition, and
competition would help us get out of this depression.

End the "war on drugs" make them legal (increase competition) and sold
at any drug store and push for prostitution to be legal too, that will
take the BIG money out of trafficking in drugs, and that will reduce the
gangs/dealers income and that should reduce the value of sex slaves and
hurt the human trafficking business income also. Why have illegal
prostitutes when there are so many legal tax paying prostitutes out there?


Create Bi-color money, Red money for inside the USA and Original Green
money outside the USA..... NOTHING BUT A COLOR/INK difference, and
suddenly sending red money home to Mexico would be useless as the RED
money would be useless in Mexico since the Banks and etc wouldn't accept
it abroad. All electronic money leaving the USA would be debited the
Sales tax when the money is sent/spent.

The Drug dealers would have Red money that they need to exchange for
green money, makes it hard to do in large amounts and hard to spend and
more expensive to deal with….. that *makes Drug smuggling less*
*profitable* as would dropping the income tax and installing a

This will reduce the number of tax crimes that people are in jails for
and it will give the people back their privacy. It will also promote
*GREEN* living where people will save more and waste less and buy second
hand and wear things out rather than discard and buy new. Then add to
the amendment that *if congress raises any tax by* 1% *they are forced*
*to cut* every single expenditure of the *government by* 3%.

Begin to draw down troops as needed from around the world. Put half of
our military bases along the southern Border to minimize the amount of
border that the Border patrol needs to watch, the military and Federal
trespassing laws will push the illegals to spaces between the military
bases.

This tax/border policy will financially assault the drug dealers and
hookers and other underground economy's by forcing them to have to pay
tax when they *spend their money* , which will further reduce the
benefit of dealing in other illegal stuff. There needs to be one type
of dollar for use inside America and one type(color) of dollars for use
outside the USA. That will make it harder for smugglers to get money out
of the country and if they do spend it here then they will pay the sales
tax and that money is used to enforce the laws to catch smugglers and
terrorists. We are "right now" taking money from peoples pay checks
before they get them and at the same time we don't tax drug dealers
terrorists or hookers or illegals or others at all, we are penalizing
the working Americans and giving a TAX loop hole bonus to illegal
activity. Sales tax will also encourage saving money rather than
encouraging the leveraging of every dime you can borrow like income tax
does.

This will drive people in the underground economy to become part of the
real economy. It will stop most of the turf killings and end our
immigration problems with illegals stealing identities since they will
be paying tax(as sales tax). Offer illegals less welfare and charge them
tax and they won't be so eager to come here and we won't need to chase
them......

End Social Security/Medicare, grandfather it out of existence.

Pass an amendment to the constitution that makes all
*laws_and_treaties* have a seven year sunset clause, and it requires
that each law/treaty be voted by a separate roll call vote every seven
years to continue to be maintained in our laws.

There should also be some constitutional amendments to stifle congress'
borrowing and spending making it more difficult for that process. And a
constitutional amendment to limit the Interstate Commerce Clause. The
politicians use that clause to justify all sorts of socialist crap. The
founding fathers never meant for it to be so broadly applied. Limit it
with an amendment, so government can't justify every crazy idea by
saying its legal under the interstate commerce clause.

Pass another amendment creating term limits on congress so the House
has 6 terms and the Senate has 2 terms, for a total of 12 years in
either side of congress. WE NEED TO STOP CONGRESS FROM PASSING FRIVOLOUS
LAWS TAXES AND BORROWING AND ENDLESSLY PRINTING MONEY.

To quit filling the jails with people over *social taboos* , we need to
take away congress' ability to "social engineer" businesses or private
people by removing the governments use of tax code to manipulate people.

Government needs to spend 10% less every year until they meet the
income of the government. The best way, is to
*use_both_cutting_and_taxing* , the Congress should implement a rule to
force an across the board spending freeze/cap (That only allows cutting
spending) and then across the board cuts on the government spending, to
do that we have to include a law in our TAX amendment to the
constitution that can't be easily circumvented, to force them to cut
spending 3% for every 1% Congress raise taxes. So any federal sales tax
increase would result in automatic spending cuts using a baseline of 10%
taxes.

And we need to give up our roll as the police man of the world, let
them fight their own fights. We also need fewer crimes for people to be
committing, we need fewer police and prisons to support.... the above
drug and tax plan, will reduce police and prison needs by at least that
10% that this plan suggested cutting each year.

NO welfare to corporations, and cut welfare to private people by 10%
each year until it is 10% of today's cost. Any way you look at it, we're
in DEEP for a long time.

The Soviet Union made it absolutely necessary to make "Israel's security...a US responsibility."

We funded and fought a war for the French in 1917. We funded and fought
a war for them (and against them) again in 1941. We funded and fought a
war for the Chinese and Filipinos that same year.

You can say about WWII: Well, we were attacked on our own soil by the
Japanese. But the fact of the matter is, Oahu wasn't the United States
in 1941. The US fleet had only recently moved there, in an inarguably
provocative ploy by the Roosevelt administration.

And being attacked at Oahu had nothing whatsoever to do with the
Germans, did it? The Germans would declare war on the US, not in
solidarity with the Tokyo, but because they were already under attack by
the US--FDR had been waging a secret (and illegal) war against them in
the Atlantic all year.

In 1942, why would we only send a single Marine division to Guadalcanal
to fight the Japanese, while sending what amounted to a double ARMY to
fight the French in North Africa? After all, the French never declared
war against the United States, did they?

Your answer depends upon your point of view, obviously.

Under nearly constant self-criticism, the US waged a war of containment
against the USSR and the PRC from 1946-1989.

The usual criticism took the form of your question: "When did [nation
X]'s security become a US responsibility?"

Nearly 100,000 Americans would die in the Cold War. About 4 times that
number were maimed and wounded, many became broken men, haunted by their
fate for the rest of their lives.

At our hand, millions, heartbreaking millions of foreign nationals,
combatants and non-combatants alike, would also die in the Cold War.

To what purpose?

Again, your answer depends upon your point of view.

You're an adult, remember. You're not allowed to answer "none."

Thanks for sharing. What's your point? That the Jasper Bank of Jasper,
Georgia failed and was taken over by the feds? Was there a run on
banks? Did people lose their savings? Has commerce been hobbled? That
the banks that failed did so because Obama was in office?

The banking system is producing more failures than in most previous
years. Printing and borrowing to bail them out isn't making them "healthy".

The success in bailing them out is the very problem making everything
else worse as in unemployment and low GDP and sinking or stagnant pay
and retirement and health care benefits.

It is pushing us into StagFlation and you are trying to pretend it's
better..... YOU have every right to be an idiot, just don't think you
have a right to force the rest of us to be idiots like you.

This is true, but the failure of the Bank of Jasper in Jasper, Georgia
isn't the measure. Can you make a case that the banking system is in
jeopardy? You know, along the lines of the fall (no pun intended) of
2008? 'Cause I could be convinced by evidence. Got any?

Printing and borrowing to bail them out isn't making them "healthy".

The large banks that make the wheels of commerce turn have repaid the
government loans and are showing profits.

We're still pretty much in the Bush depression that started after the
crash of 2008, and the statistics show that. But we're talking about
the banking system.

recovery and the recession was over according to technical indicators,
or are they lying today when you and they are saying it's still Bush's
recession....?

We support Israel because its the only democracy in the middle east, and
is/has been effective in controlling many of the other religious
dictatorships there who are antagonistic to us.
