More breaking news, bad news that is, for Obama
Phillip Berg filed a motion for extensive and expedited discovery in
the Philadelphia federal courts as part of his suit contesting
Illinois Senator Barack Obama's constitutional eligibility for the
presidency.
This motion filed by Berg on September 9, 2008 would require Obama to
turn over the following records within ten days.
* A "Genuine Certified Copy" of his "vault version" of his Birth
Certificate.
* Any and all certificates or other registrations of birth from
Canada, Kenya, the British Isles and the United States in the name of
Barack Hussein Obama, Barry Soetoro, and others.
* A "Certified Copy" of the U.S. Oath of Allegiance required to be
taken in order to regain any U.S. Citizenship status.
* Any and all passport records including applications and travel
logs connected with passports issued to Obama--or any previously used
names--in Indonesia, Kenya, the United States and more.
* Any and all adoption records, including records detailing the
adoption of Obama by his presumed Indonesian stepfather, Lolo Soetoro,
as well as his grandparents, the Dunhams.
* A copy of his FBI background check used in the vetting process.
* A copy of the "vault" version of his Birth Certificate from
Kenya.
* Any and all applications for a social security number and
replacement social security cards.
* Any and all applications and court documents detailing a name
change.
Within 20 days of the court order, should the motion be granted, Berg
is also seeking other records which would provide a window into Barack
Obama's past, including but not limited to college applications and
records from Occidental College, Harvard and Harvard Law School,
Columbia University, the University of Chicago and any other schools
to which Obama applied, as well as any applications for college grants
and loans, copies of any college thesis papers or other essays written
which could shed light on his life, background, heritage and
childhood.

I think that it's great that McCain was born in Panama before Americans born
on military bases were deemed American citizens by birth. It means he can be
deported back to his home country once convicted of the scandals he has so
far avoided.

When considering John McCain's history of unethical behavior, the list
usually starts (and ends) with the Keating Five scandal in the 1980s,
for which McCain was rebuked by the Senate Ethics Committee for having
shown, at a minimum, poor judgment. In the aftermath, McCain helped
improve his public image, and bury the scandal, by becoming an
advocate of campaign-finance reform.
But the notion that McCain cleaned up his act may not be entirely
true. Take, for example, Donald Diamond, a wealthy Arizona real estate
developer and generous McCain contributor, who wanted some coastal
land in California freed up by an Army base closing.
When Mr. Diamond wanted to buy land at the base, Fort Ord, Mr. McCain
assigned an aide who set up a meeting at the Pentagon and later
stepped in again to help speed up the sale, according to people
involved and a deposition Mr. Diamond gave for a related lawsuit. When
he appealed to a nearby city for the right to develop other property
at the former base, Mr. Diamond submitted Mr. McCain?s endorsement as
?a close personal friend.?
Writing to officials in the city, Seaside, Calif., the senator said,
?You will find him as honorable and committed as I have.?
Courting local officials and potential partners, Mr. Diamond?s team
promised that he could ?help get through some of the red tape in
dealing with the Department of the Army? because Mr. Diamond ?has been
very active with Senator McCain,? a partner said in a deposition.
For Mr. McCain, the Arizona Republican who has staked two presidential
campaigns on pledges to avoid even the appearance of dispensing an
official favor for a donor, Mr. Diamond is the kind of friend who can
pose a test.
Ya think? The closer one looks at this, the worse it appears.
In California, the McCain aide?s assistance with the Army helped Mr.
Diamond complete a purchase in 1999 that he soon turned over for a $20
million profit. And Mr. McCain?s letter of recommendation reinforced
Mr. Diamond?s selling point about his McCain connections as he pursued
? and won in 2005 ? a potentially much more lucrative deal to develop
a resort hotel and luxury housing.
In Arizona, Mr. McCain has helped Mr. Diamond with matters as small as
forwarding a complaint in a regulatory skirmish over the endangered
pygmy owl, and as large as introducing legislation remapping public
lands. In 1991 and 1994, Mr. McCain sponsored two laws sought by Mr.
Diamond that resulted in providing him millions of dollars and
thousands of acres in exchange for adding some of his properties to
national parks. The Arizona senator co-sponsored a third similar bill
now before the Senate. [?]
For the California projects, the campaign said the McCain aide
arranged the introduction to an Army official for Mr. Diamond?s team
as ?a constituent matter.?
Oh, is that what the kids are calling it these days?
McCain helped a wealthy and generous donor buy land from the Army ?
complete with special water rights ? for a quarter of a million
dollars, which McCain?s buddy then sold two years later for $20
million. There?s a term for this ? it?s called ?influence peddling,?
and it?s exactly the kind of thing McCain swears he never gets
involved with.
If the Rezko story was considered a big deal by campaign reporters,
the Donald Diamond issue should be huge. Why the New York Times ran
this the day of the Pennsylvania primary, when it?s likely to get lost
in the shuffle, is a mystery to me. If this same story ran on Thursday
morning, it would have become the talk of the political world in a
hurry.

Technically, no one votes for a candidate for President of the US. All
votes are cast for each state's slate of electors, and the electors vote
for President. Even if Berg could show he had standing to sue, he would
have to do so in state courts to challenge the eligibility of electors.
Part of the hurdle there is that electors often aren't bound by state law
to vote for their candidate.
Nothing in the Constitution prohibits an ineligible candidate for
campaigning for office. Presumably, he or she wouldn't be allowed to
take office, but that couldn't be a problem until after the Electoral
College meets.
After the Electoral College delivers their votes, a joint session of
Congress takes the official tally, and at that point challenges may be
made to any elector. No federal court will intrude on such a
Congressional prerogative.

In this new filing of 9 Sep. Berg has apparently "got the goods" on
half-breed and is asking for <<< extensive & expedited discovery <<<
On any criminal case, AFAIK, an actual "discovery meeting" is held,
prior to court hearing, wherein the "plaintiff" and "respondent" and
their lawyers actually lay-out and discuss they plaintiff's information
that will be introduced into court! I was surprised to know that.
So, Berg, a lawyer is setting out to play hardball! Gives me another
follow-up chore in maintaining liaison with the Clerk of the Court in
Philly so I can post updates.
We can also appreciate the contributions of a reformed kcajyer in this
case as well. We're getting there!. Will go thru my Washington papers
today but I don;t expect to find anything on Barack.

whack job. Berg also sued George W. Bush for complicity in
the 9/11 attacks. This is a frivolous lawsuit like most of

We already know that Obama is a U.S. citizen. His birth
certificate is posted on his website, it has been examined
by an independent source, and has be verified by the Hawaii
Department of Health.

designating just who they would be, to decide who is President.
Your argument is a malicious attempt to not only divert attention from
the fact, "The President must be a natural born citizen of the United
States," but also an attack in favor of oligarch rule on the very
democracy that is the U.S.A..

Um, there seems to be some doubt as to whether or not Obama
was, in fact, born in Hawaii.
A lawyer in Montgomery County, Penna has filed at this same District
Court. 2 pleadings.
(a) around 15th or 20 July, 2008, a first case alleging that the Hawaii
Certificate of Live Birth, shown on the Obama website = is a Forged
document.
(b) on 9 Sept 2008 the 2nd pleading requesting the list of "discovery'
information that Berg will need to prove his case. Thanks to Don
Gabacho. that's 2 cases, by _Philip Berg,, claimant.
I telephoned the Courthouse at 4 pm today, Friday, to see if I could get
an 'update' on either case, and when the first hearing will be held.
Clerk's office was "busy" and all I got was a promise to call me back.

complaint against a Presidential candidate and no standing with a
President-elect.

The electors convene per instructions in the Constitution. If they are
committed to an ineligible candidate, then Berg would first have to look
for state laws that disqualify them.

The President must be. But that doesn't apply to people who campaign for
the office, although any such person elected would presumably be
disqualified from taking the office. Thus Berg has no grounds for suing
