Baton Rouge, La. - A Louisiana justice of the peace who refused to marry a
couple because the bride was white and groom was black resigned Tuesday,
after weeks of refusing to step down despite calls for his ouster from
officials including the governor.

Keith Bardwell quit with a one-sentence statement to Louisiana Secretary of
State Jay Dardenne and no explanation of his decision: "I do hereby resign
the office of Justice of the Peace for the Eighth Ward of Tangipahoa Parish,
Louisiana, effective November 3, 2009."

Gov. Bobby Jindal called Bardwell's resignation "long overdue."

Bardwell, who is white, refused to marry Beth Humphrey and Terence McKay.

When questioned, Bardwell acknowledged he routinely avoids marrying
interracial couples because he believes children born to them end up
suffering. In interviews, he said he refers the couples to other justices of
the peace, who then perform the ceremony, which happened in this case.

"There is a problem with both groups accepting a child from such a
marriage," Bardwell said in an October interview with The Associated Press.
"I think those children suffer, and I won't help put them through it."

Just like any other job in the US, if you can't perform it, then you
can be replaced. In this particular case, not only was he not
performing his job, but he was violating state and federal law in
refusing to perform it.

This discussion appears suspiciously void of any mention or
consideration for the JP’s reason and the OP’s post. I’ll have to
remember that considering a child’s welfare is racist and risks
carrying with it the stigma of being labeled a nazi. In responding
counter to those accusers, I will now no doubt be subjected to those
same epithets. The lesson being, people need to ignore their own
opinions and mimic the majority or else risk being lynched by them. It
is indeed an interesting if not scary time in which to live.

refusing to do his job. Next, in this day and age of tight budgets, why should the public
have *anyone* on the payroll who is A) Not doing their duty, and B) Opening up the
possibility of one heck of a lawsuit? Hmm...?

He was no different than a Postal worker who refused to deliver the mail. No different
than a cop who refused to ticket someone for doing 75 in a school zone. No different than
a 911 operator refusing to connect someone reporting a heart attack to the local hospital.

And since you expect to be called something... How about "pathetic"?

Why would someone believe that unless they themselves would willingly
heap abuse on children of interracial couples?

But on the other hand, children of interracial couples can grow up to
be President of the United States.

If you're going to have "convictions" that are locked in cement, first make
sure you understand what those convictions are, the full effects of those
convictions, taken all the way to the end, are on others as well as
yourself. Make darn sure you're informed (how many of us even watch the
evening local and national news) fully from more than one source. Make sure
you're willing to take both responsibility and action on the results of your
convictions.

do you think you are complaining about? The former judge has every right
to not witness such marriages, but he cannot continue to be a judge. Is

There is really nothing on this issue to discuss. A JOP is either
hired or elected to do a job, the job includes a number of state and
federal laws that must be followed in pursuit of that job. He refused
a legally eligible couple a marriage license, in violaton of those
laws, and failed to perform his job. He resigned, probably ahead of
being fired. Case closed.

were black, and 0.0 percent of the offenders were white.

In the United States in 2005, 37,494 white females were sexually
assaulted or raped by a black man, while between zero and ten black
females were sexually assaulted or raped by a white man.

So, if you were a woman walking late at night and saw a white male
walking toward you on one side of the street and a black male on the
other, which side would you choose?

legally refuse to sell the house to a black person assuming that a
fair offer was made and the contingencies were reasonable.

Keep in mind that it is not unusual for the buyer and the seller to
not meet until the closing as well, which means that would be the
first time that the race of the buyer is known.

These come under the equal opportunity laws and the civil rights laws.

refuse to sell that house to a black person, based on the fact that
they are black, assuming that the house was for sale, and a fair offer

True, but there's a further clarification that needs to be addressed,
back before these laws existed, the problem wasn't so much the
individual seller, although they were part of the problem, but the
institutionalized discrimination. Realators would not show houses to
blacks in white neighborhoods to begin with, loan officers would often
stall and block loan applications from blacks applying for homes in
white neighborhoods, and a lot of similar actions that are now
illegal.

All states have an equivalent of the federal housing act, and they
vary somewhat from state to state, but they all have to meet the
minimum requirements of the Federal Fair Housing Act.

I heard that Bardwell is planning to become a pharmacist, so he can refuse

The existence of such laws are not a matter of belief. There are no
such laws in the U.S. There are various covenants regarding real
estate that state that the property may not be sold to a Black, but
those have not been enforceable since the mid-1960s.

The Civil Rights Act of 1968 prohibited the following forms of
discrimination:

1. Refusal to sell or rent a dwelling to any person because of his
race, color, religion or national origin. People with disabilities and
families with children were added to the list of protected classes by
the Fair Housing Amendments Act of 1988.

2. Discrimination against a person in the terms, conditions or
privilege of the sale or rental of a dwelling.

3. Advertising the sale or rental of a dwelling indicating preference
of discrimination based on race, color, religion or national origin
(and, as of 1988, people with disabilities and families with

Actually, it goes farther than that. The law was strengthened in 1988

Sure it did. Doesn't matter. Privileged characters don't rank in
my book. You can take your thousands of laws and stick 'em
where the sun don't shine. Federalism is irrelevant. Defunct.

The black market is the common market. The greater populace is looking
for alternatives. As the economy sinks they will find these alternatives
in freedom and the opportunity to rebuild.
