Even though it is possible, it's kind of hard to imagine writting two songs
with such similar choruses and not realizing it. Especially since the same
four people wrote both songs and have continued played Dirty Magic since
Ignition was released 6 or 7 years ago.
To me it seems like they might have used the chorus intentionally. They reused
the same guitar riff from Genocide on Ixnay, and also did the remake of
Feelings so they don't seem to have a problem with recycling old material.
Though they have released a lot of original material and original lyrics on all
of their albums, I think they were probably writing Have You Ever and that
chorus came up and they thought it went well with the song.
To be honest, I did NOT think the songs were similar on the first few listens,
and still feel the same way. Dirty Magic is one of my favorite songs,too.

Janet I didn't either on the first few listens. But listen to the
choruses on both songs. When he goes "Some days my soul's confined and
out of mind sleep forever......some days i'm so outshined and out of time
have you ever" is very similiar to the line in Dirty magic that goes
"Pull the shades.....razor blades...you're so tragic...I hate you so....
but love you more....I'm so elastic....the things you say.....games you
play....dirty magic". Go back and listen to those parts and tell me if
you find a slight similarity. I'm not saying they are identical but
slightly identical.
You are right about both songs being good. When it all comes down to it,
each song has something going for it. So that's really all that counts.

He's right, it does sound the same...I noticed it the first time I heard Have
You Ever. But they're both awesome songs so I guess they knew what they were
doing!!

OK, I see the similarities now that I've listened a few times--virtually
identical but a little faster. Coincidence--maybe not. This would've been an
interesting thing to bring up in the chat a couple of weeks ago (or maybe on
Rockline/Modern Rock Live this weekend!).
Maybe some of you can find work as copyright attorneys!
