First of all, let me preface this with the fact that I am
not an employee of VisioSonic.
I like the people who are VisioSonic and as such, have lent
my assistance to them as needed. I have done this because I
like them and their product.

Here it is,

Many of you who were at the Mid-America and the Mobile Beat
Cleveland show know exactly what is going on. The new DJ
Power display
is confusingly similar to the one VisioSonic has been in
development of for several years.

All the guys from VisioSonic have been very calm and
professional. They have allowed all the disc jockeys
decide, for themselves, which product met their needs.

At both conventions, each DJ, who won the other software,
approached VisioSonic personnel and exchanged it for the
VisioSonic
version.

At the Orlando show the ("Knock-Off Display") was, once
again, opened and displayed in public. A process server
served DJ Power.

This was witnessed by myself and some of Orlando's best
DJ's. I agree, DJPower has been available for a few years,
however, what is the reason for the "Knock-Off Display"? It
seems that the Florida court system will have the final
decision on this issue.

"These Are The Facts" taken from public records in the
Federal Middle District Court
in Florida.

VisioSonic has filed a verified complaint against DJ Power
for unfair competition in violation of the Federal Trademark
Act of 1946.

Until June of 1999, the look and feel of the DJ Powers
screen display was dissimilar to the look and feel of
VisioSonic's Digital 1200SL screen display. Beginning of
June of 1999, however, DJ Power began advertising and
marketing the DJ Power software in conjunction with a screen
display ("Knock-Off Display") that is confusingly similar to
the look and feel of VisioSonic's Digital 1200SL screen
display.

VisioSonic has filed a motion for Preliminary Injunction to
have the court to enjoin DJ Power from engaging in unfair
competition.
