by the original owner kmkpaints, about Susan and Jim the haulers who were
accused of stealing him from the new owner they were transporting him to.
Hope it all makes sense now :O)
.....in all fairness..here is Susan's reply to the accusations:
WEll, it certainly seems we are the talk of the town today. Please let
me entertain your concerns. For those of you who have no idea of what is
going on, that there are always two sides to every story. First and
foremost, we have been hauling for years......always with the same
contract. This woman knew the stipulations of the contract. She hired us
through a third party......sending us only the contract, and an email
about the deposit check......which consequently never arrived, and we
had to make several demands for it in order for her to pay it upfront
(half only). Here is the story. The horse was loaded at midnight in
Friend, NE. The horse was loaded into a 15X8 foot box stall.....which is
LARGE by all means, with 3 other 3-4 month old weanlings. The owners
representative at the farm of pickup couldnt tell me if the colt could
tie or not. As I do not practice tying the heads of colts that dont tie,
for fear of them hurting themselves, I loaded him into the box stall. He
was the biggest foal in the stall. WE delivered the colt in 14 hours,
650 miles. He was watered, hayed, and taken care of very well on the
trip. I called the new owner personally when the truck was 4 hours from
her place. No mention of a problem was made. We arrived, she came out to
the street to meet us. We had already unloaded the colt. She looked him
over, was satisfied, clipped her lead rope on and released
mine.....without my permission. I had already asked that payment and
paperwork be settled first. She took off anyway and put the colt into a
paddock. The colt was fine.........not ONE mention of a problem. MR.
Cooper was not home and cannot say anything about the condition of the
horse. He was not there. He is going on the word of his spouse alone and
slandering our company. WE had the colt vet checked THREE hours after
leaving her home.........and he got a 100% bill of health, no injuries,
no dehydration, etc...........cuts dont heal in three hours!! Anyway,
she then told us she had "beefs" with us. I asked her what.......she
said that she had paid for a full stall and didnt get one....that her
colt had to share with others. She had never even looked into the
trailer, but was informed by the previous owner. I am sure had she
looked into the trailer, she wouldve seen ample room and wouldve
appreciated that her colt could lie down, instead of being tied into a
slant stall with his head up for 14 hours. I explained that the stall
she was discussing was a combination of not one, two, but THREE and a
half FULL stalls..........half of a 30 foot long horse trailer. The
horse only shared it b/c we were unsure of whether he could tie or not.
The previous owner was aware of it, and we didnt hear a word about it
when the foal was loaded, or anytime in transit. Only did we hear about
this, when the horse was delivered. She REFUSED to pay. Anyone who has
ever stood a stallion, or trained, boarded, etc with horses knows that
contracts very specifically call for certified funds BEFORE the horse is
released. She did not offer even a personal check...........she says we
wadded it up in her face. Then explain to me why 3 hours later at
another delivery, I took a personal check for FOUR times the amount she
owed......regardless of contract. She DIDNT offer payment and she knows
it. James and I have both submitted to polygraph tests now based on this
womans ridiculous accusations......perhaps she should do the same!!!!
This woman was NOT hit, beaten, attacked, etc over this money. We
defended ourselves over an attempt to enforce our contract. We retained
custody of the colt PER contract. She attempted to stop us, clawing,
scratching, pushing, biting, etc. I have a black eye, bruised arms,
etc............the only time EITHER of us did anything was after she
kicked my husband in the groin and he groaned to get her off of
him.........I pulled her hair ONCE to force her off of him......this is
what she is now telling people is a BLOW to the back of her head, by MY
HUSBAND......my husband never touched this lady......EVER!!! HE only
held the colt......period. She didnt have the money......as she has
admitted......she didnt have it............period. She wasnt going to
pay b/c she couldnt. If she wouldve told us that, I have clients that
can attest to the fact that we wouldve released teh colt. She simply
REFUSED to pay and therefore we enforced the contract......if you
personally had a mare owner that owed a stud fee, mare care,
etc.....woudl you release the mare without payment.........this is the
same principal.........we rendered services to her and she didnt pay her
bill. We took the colt back and she pressed charges and called the
police AFTER we left.........hence she can distort things however she
wants, but she is lying and polygraphs can prove our story......how
about hers? Services arent free in this world, and companies which
demand to be paid arent in the wrong. The colt has been vet checked, is
in a full boarding facility now, safe and sound..........and this crazy
woman turned him loose into a road during the scuffle..........is this
who you would want to own your animal??? I certainly wouldnt. I guess
she thought if he ran away, we wouldnt get him.......so why not turn him
loose into a busy road.............hmmm............ They are being sued
for slander, defamation of character, and assault charges are being
sought against Ms. Cooper as well........I have a black eye, bruises,
contusions, etc. and we wont mention what was injured on James when this
psycho kicked him in the groin. She is not going to win this, and will
pay her bill. I have told her over and over that I will release the colt
when her bill is paid. She has gone back to paypal now and said that
services werent rendered, now trying to reverse the original deposit
check. She has even said now that I didnt stall the horse
overnight.........wow..........I only had him from midnight to
2pm.......14 hours, when was I supposed to stall him. She states I tried
to charge her for board and feed..........that is also a lie.......I
only asked for the balance of the contract. This lady is short a few
screws and this thing will become quite involved. For those of you who
dont know us, please refrain from passing judgement on companies who
only seek to be paid. We didnt assault her, we didnt hurt or injure her
colt, we just wanted to be paid. She REFUSED to pay, period.......never
once offered payment, regardless of what she says. Why in the world
would I refuse payment......to keep a colt that I dont have papers on??
I have 16 horses of my own, the last thing I need is another mouth to
feed. Please remember there are 2 sides to every story.......and usually
the one screaming the loudest is the one who is the guilty

Nope. Once the colt was put in the paddock, you no longer had
custody and to take him from the paddock (over a payment dispute)
and reload him and drive away was illegal.

The law does not permit you to enforce the contract in this
manner.

Only after you stole him out of the paddock, right?

OTOH, you may end up being charged with horse theft. Two wrongs
don't make a right, you know.

You broke the law and stole her horse. 'Nough said.
