Custody Battle for Premature Twin Boys Turns Vicious As Diandra Douglas Has
Babies' Biological Father Arrested

LOS ANGELES, May 24 /PRNewswire/ -- The birth of twin boys who survived
being born 12 weeks premature should be cause for celebration, but in the
case of Diandra Douglas, former wife of actor Michael Douglas, and the
babies' genetic and biological father, Zack Hampton Bacon, III, successful
NYC-based hedge fund executive, the battle for custody turns vicious and
ugly. On Saturday, May 22nd, Ms. Douglas had her partner of four years
removed from her Montecito home in handcuffs by local police and served him
with a temporary restraining order, based on fabricated information of
alleged violent behavior, in order to keep Mr. Bacon away from her and his
newborn sons. She is the legal mother, but not the biological mother, of
the twin boys, who were born on March 4, 2004, through a surrogacy.
"I have lived with Diandra for four years in New York. We entered into a
legal agreement to have children via a surrogate mother and to raise them
in New York City," says Mr. Bacon. "The plan began unraveling in December
2003, when Diandra learned that that the embryos carried by the surrogate
were both males. Disappointed with the sex of the babies, Diandra, without
consulting with or informing me, began arranging for the adoption of a
third infant, a baby girl from an orphanage in Kazakhstan. When I
strenuously objected, especially after learning that the boys were born
three months premature, she continued to proceed unilaterally with this
irresponsible adoption. She then filed suit, while my sons were still
hospitalized, to take primary custody of my children and to keep them in
California."
The twin babies were released from the hospital on Saturday, May 15th. The
couple agreed to and signed a "Statement of Understanding and Agreement"
that upon their release from the hospital the twins would temporarily stay
at Ms. Douglas's Montecito home, until they were medically cleared to
travel by plane to New York. Furthermore, the agreement stated that Mr.
Bacon would be provided a suitable bedroom in the Douglas home with
complete unrestricted access to and from the residence and the boys.
"During the week, I heard from Diandra's staff that she was working with
counsel to somehow have me physically removed from the house. I was served
with a restraining order alleging violent behavior on Saturday, May 22nd. I
agreed to leave the premises, but when not out of the house fast enough,
Diandra called the police, who subsequently arrested me, and led me to the
county jail in handcuffs," adds Mr. Bacon. "First Diandra ambushed me with
a custody suit. She then agreed to drop the custody suit in exchange for
excessive financial and custodial demands. Now she is resorting to vicious
maneuvers, based on fabricated information, to have me physically separated
from my two newborn children."
According to Zack Bacon's ex-wife, Eve Bacon, "During the entire time I
have known Zack (for about 30 years), he was never physically, verbally or
emotionally abusive toward me or towards others. In fact, he has always
been respectful -- even in times of disagreement. We have two wonderful
children together. Zack is, and has always been, a committed and devoted
father." Mr. Bacon and his wife Eve were married for 14 years and divorced
in December 1996.
The custody case will begin hearings on Monday, May 24th in the Los Angeles
County Superior Court of California.

I hate to call someone that, but I'd have to agree. I remember seeing a picture
of her and Michael with their son, they were hand and hand and the kid was
lagging behind, alone. He just looked like a lonely, unhappy kid who was
ignored by his parents. I remember reading that Diandra and this man were
having problems before these twins were even conceived. She thought this would
help the relationship. SHe sounds like a very selfish woman.

Silly, the reason she didn't do a good job raising her other child is
because he was a *boy*. Sheesh.
I can't imagine how it must feel to know that your mom was
disappointed because you were the "wrong kind" (enough to order one
that was the kind she had her heart set on). Whatta bitch. I'm sure
she'll be fighting so vigilantly for custody if they, due to their
prematurity, have developmental disabilities ("Damn it, not only are
they boys, they're gimpy ones, too! Why me, God?!").

Parts of this story(excepting the disappointment with the sex of the
children and the Kazakhstan adoption)are reminiscent of the Cheryl
Tiegs/Rod Stryker child custody battle several years ago. As I
remember a surrogate carried twins which were Stryker's biological
children. Tiegs publicly claimed that they were her eggs, a claim
which was discounted by several top fertility doctors who said it was
virtually impossible to harvest 50 year old eggs to produce healthy
viable fetuses. After the children were born, Stryker sued for divorce
and full custody of the twins, calling Tiegs a less than dedicated
"mother" and I THINK he confirmed the rumor that she was NOT the
biological mom. It was a rancorous legal fight and I seem to remember
that Stryker ended up with the full custody he sought. My guess is
that this will be the case with Douglas/Bacon.
Does anyone know if the courts tend to go with the biological father
over the non-bio mother when the couple are NOT married?

That wasn't the way I remembered the Tiegs/Stryker story at all, so I
did a bit of research just for the heck of it:

There WAS an ugly fight for custody of the Tieg/Stryker twins! Which
is really weird considering that Stryker said that Tiegs really didn't
want them in the first place and was a less than "hands on" mom. My
original point was to show that when the bio dad and the non-bio mom
are fighting for custody, the court MAY lean towards the dad(unless
there are negative facts about the dad of which we are unaware.) So,
Bacon LOOKS like he may have the upper hand in this case.
