1. Copy the Diabdat.mpq from the CD to your Diablo directory (it's a few
hundred MB)
2. Download a crack from www.gamecracks.com (i think). Run it, and it
should work without the CD.

Is one still considered legit this way? I'd like to do this to avoid the
annoying CD spinning.

Yes, it's completely legit.

I think not. I am legit, and I have to deal with the distracting
spinny sound of my cd-rom every time I play Diablo. For someone not to
it would give them an unfair advantage not intended in the game's
design. The spinny sound is half the challenge to beating the game.
Well i used to play diablo in my old 486 dx4/150 (oc), with my crappy
toshiba 8x, so i consider you non legit cause my cd spinning time was longer
than yours...! :)

Actually no. Cd-rom drives when Diablo was made, didn't spin fast enough
to make that much noise. So, by playing it off the hard drive, you are
actually returning it to the way it was designed.

Especially if it means a big lag is upcoming as the game loads up a
nice big wave file or something. You can use that advance knowledge
of incoming lag to your advantage, or you can be paralysed by fear
(especially if your CD is getting pretty scratched up by now and the
game may crash due to a read error (the new replacement CD I bought
over Christmas isn't much better than my original Diablo CD.)
What sort of penance should we require from all these play off the
hard drive folks? I'm thinking airfare and lots of beach time and a
secluded paradise might be good for starters...

My CD-Rom (4x I think) was part of a system I bought right after
Diablo was released (Not being able to play Diablo on my 486 was final
impetus towards upgrading) and it can make a horrible racket when it
spins up to grab a big chunk of data. In fact you'd think it had the
electromagnetic equivalent of a carburetor the way it howls sometimes.
the first few batches of Diablo CD's seem to have been a "non-standard"
size... slightly larger than normal.
Thus while they worked fine, they created an extreme amount of noise in most
CD-ROM drives
more recent Diablo CD's seem to be "standard" size...
