I far as I know, it's always been a rule that you can't have good characters
and evil characters together in the same party.

In the first Chapter of BG, however, you have an opportunity to meet two evil
characters on the road and they can join your party.

Is there a penalty for this? Any thoughts on this appreciated.

You can have a party made up of any alignments you wish. The problems come
when your reputation enters play. If you manage to obtain a reputation of 20
evil npc's will leave your party, neutral characters will complain a lot, but
good characters will love your character. If your reputation is 1, evil
characters will adore you, and good characters will leave. Neutral npc's only
have a problem if your reputation is "1" then they will leave. They will
whine, moan and complain if it is 2-5 or 19-20. Page 145 in the game manual
explains most of this.
The three neutrals (2 True Neutral and 1 Chaotic Neutral) only really started
complaining hard once my reputation reached 19. I thought it was kind of fun
to hear them bicker a little bit here and there so I don't mind .
Now, having an evil character in your party might make some encouters
difficult. Some folks won't like the look of you and others will not want to
trust you, but again, a lot of this depends on the leaders Charisma and
Reputation. A Lawful Evil party could very well be heros for the commoner,
they just don't believe in showing mercy to thier opponents.

in my (limited) experience, you can mix the alignments up, but you will hear
the characters bitching at each other if they are together to long...

Well I have to speak up about one of my earlier attempts, where Jahiera
and Khalid duked it out with Xzar and Montaron on the way to Nashkell.
I don't know what triggered it, they had been complaining and making
snapping remarks at each other and then all of a sudden it happened. My
main character and Imoen was standing there staying out of the fight (I
am thinking wtf) and I could not do anything like in the scene when you
first leave Candlekeep.

Needless to say, I just went and restarted again but this time left Xzar
and Montaron on the road. So right now my party is mostly good with a
couple of neutrals in it. Maybe it was just me since I was exploring
all the maps in between and trying to complete a few of the side quests
first before tackling the mines. Kind of interesting though now but not
amusing at the time.

I took the two evil characters you meet near the start and teamed them up
with Jaheira and Khalid, as well as myself (obviously!) [C/G Mage] and
Imoen.

All went well with a bit of bickering until we were well in to the Mines at
Nashkel. Suddenly, Xzar and Montaron laid into Jaheira and Khalid! Result: 2
dead evil characters and lots of trouble for me!!
