Hey folks,
Is there anything I need to know before investing in teranews? Any
hidden costs? Are they trustworthy with credit card information?
Thanks.

I don't think they are 'trustworthy' -- but you might consider them
'usable' depending on your needs.

The reason they aren't trustworthy is because they misrepresent
themselves. They allege a so-called free service which costs a few
bucks, but which doesn't 'announce' that they are going to put
advertising trailers on all of your posts.

The reason they are usable and appeal to some people is because it is
not a bad deal if you use it according to that result. That is, you
have unlimited uploads and you have unlimited days of 50meg/day
download, both of which are definitely worth something.

The reason they aren't all that usable is because the service is
sometimes erratic or suboptimal.

If I were going to invest a few bucks in something and I were just a
text up and down user, I would 'contribute' it toward a more reliable
service which has a non-expiring block, such as octanews or others with
nonexpiring blocks. If I were going to be uploading text, I definitely
wouldn't use free.teranews because of the ugly abusive trailer.

If I wanted to just upload binaries, I might consider it. If I were
going to be downloading much binaries, I would be needing more gigs and
better gigs.

They've changed the message, though I'm sure you still won't like it.

Same here, and I've never heard any reports of credit card problems.

Yes, they did. After denying that they append the spam signature, they
now have shortened it to a one-liner yet they still can't manage to add
the sigdash delimiter (if not already present) to actually put it in a
signature. Bet they still deny adding it, though.

It's a free account for life and you complain about little credit line at
the END of the message? Do you complain about the google/yahoo/hotmail
tags at the end of all their email messages too? If you don't like it BUY
an account and it's not there. Free account for you == free advertising
for us.

It's our beta test server. It's how we keep the production servers so
reliable. We test stuff out on the free servers first.

BUT THAT FACT IS NOT ANNOUNCED ON YOUR WEB SITE. It's called lying.
You even lie when directly asked if you append the spam signature. You
claimed no knowledge of the spam signature.

>> The reason they aren't all that usable is because the service is
>> sometimes erratic or suboptimal.
>
> It's our beta test server. It's how we keep the production servers so

Yep, another unannounced lie. That fact is also never mentioned on your
web site. So you lie (by not announcing) that you will turn your users
posts into spam. You lie to them (by not announcing) that they are
using a beta server rather than what you profess to be offering them. A
"free" server does NOT equate to a "beta" server unless that fact is
actually mentioned.

You want to get free testers of your free beta server and you still want
them to spam for you? Uh huh. You aren't just asking for your
customers to be your spam affiliates. You also want them to test and
load your beta server. So your customers who pay you a signup fee (no
refunds but they'll gladly and without notification cancel your account)
for the "privilege" of testing and spamming for Teranews are doing
double dootie. Spammers always find excuses for their actions.

Make a decision. Have your customers be testers of your beta server.
Beta testers do not also become your involuntary spammers. No other
beta software or service that I've used required me to spam for that
software or service - because my testing was the exchange for reduced or
no cost. Or have them be INFORMED voluntary spam affiliates. You want
them to be beta testers AND spammers.

Teranews is notorious for cancelling memberships if you complain.

By the way, charging $3.95 is FRAUD in many countries, since it is NOT
FREE!!

tera charge $3.95 as a one-off registration fee and use of the service
is free of charge afterwards. Is that too complicated for you?

Don't make allegations you cannot substantiate, such as accusing
Teranews of fraud when the only fraud round here is you pretending to be

Yep, that's my personal experience. However, to be accurate, I asked
them to terminate my account but they also promised to refund my signup
fee. Yes, it's a piddly amount but how many customers would also
complain at the grocery store if the clerk handed them the wrong amount
of change? They lied about the quality of their service. They lied
about what service they provide (as in never mentioning the spam
signature). They lied to me directly by claiming no knowledge of the
spam signature when they replied (only once and never thereafter). They
steal by not refunding any charges made for their misrepresented
service. They are highly untrustworthy.

> By the way, charging $3.95 is FRAUD in many countries, since it is NOT

I understood the professed need to charge a signup fee. Hopefully it
was to eliminate abuse (by malcontents or spammers) of their free
server. I don't bother to track all Teranews-sourced posts along with
recording their history before and after when they started requiring the
signup fee so I don't know if the signup fee was effective to eliminate
malcontents, trolls, and spammers. Yet they have become the spammer
that their signup fee was supposedly meant to eliminate.

Oops, there is one good use of Teranews: download only. If you only
download from their spamming free server, you get a decent service (not
that reliable but far better than the other freebies). I don't recall
how many binaries their free server carries since that wasn't my area of
interest. There isn't much point to downloading from the text-only
discussion groups because participating in the discussion means
uploading and that means you spam Usenet. So you could use the 50MB/day
quota to download from their free server and not end up spamming for
them. However, I have no interest in downloading files from Usenet so
downloads (to get posts) and uploads (to submit posts) are of equal
value to me. I suppose pimps and pushers have some good points, too, if
you can manage to isolate those behaviors are that good, but then I'm
really not interested in supporting their good behavior to only support
their bad behavior, too.

Downloading would be okay from the free Teranews server since that would
not result in spamming the newsgroups with their promotional signature.
However, it is unlikely that someone using the free, oops, beta Teranews
server would not also use it to upload their posts to it (and then end
up being Teranews' spam affiliates).

If someone signs up, even on the 50MB free account, and they can't use it
(normally because of their own error), we'll refund the fee and cancel it.
We try to help the user, but sometimes we can't and in that case we give
them their money back. He's taking something good and twisting it into
same evil master plan to cancel and refund all our users. Ya, like we
really like to pay the 13% to process a credit card and then pay another
13% to refund it.

ya, ya, what he said... :)

Yes, we're very clear about the $3.95 setup fee. When you type your
credit card number into our website and it says $3.95 setup fee and
the user clicks OK it's hard to yell fraud.

Fraud would be if you said there would be no fee and we charged you
anyway. Which actually happened by a copycat news server startup a couple
years back. I can't remember the name anymore. Anyone remember it?

Fraud by definition requires deception. There is no deception in
Teranews offering an account free after payment of a setup fee. The
terms are clearly stated. Fraud at law is one of the hardest of all
crimes to prove. Taking a word such as "free" out of context would
not constitute fraud. As the courts have long held ad puffery is not
deceptive if a reasonable person would not be confused regarding the
meaning. The terms are transparent and clear.

It is a little hard to claim fraud in the inducment when they collect
the money up front.

The facts would not sustain a civil judgment for fraud. The standard
for criminal fraud is much higher. As the charge of $3.95 is stated
up front there can be no fraud in the inducement. There are no
charges after the setup fee. The terms are exactly as stated. "Free"
is not some magic word to be interpreted without reference to the
context of the remainder of the terms of contract. Remember that
anybody can sue anybody anytime. But it is not likely that such a
cause of action will be sustained. Tera is not deceptive in stating
the terms.

QUOTE

* Due to the overwhelming response to our free account offer and the
costs associated with verifying credit card information we have begun
charging a one time setup fee of $3.95. Their are no recurring
monthly fees with our 50MB/day package.

END QUOTE

I would recommend to Tera that they move this paragraph to the top
of the page. But it is clear and straightforward.
