BOUNDARY DISPUTE

My neighbour is building an extension next to my Garage and he has dug deep
next to my garage foundation exposing my brickwork. This may later on
damage my garage and cracks might develop.
I did consult a surveyor and he says:-
"Neighbour is exposing my garage foundations."
~This worries me somewhat - party wall matters should be put in place if the
dig is at any point below your garage foundation. If he digs to a level
below your garage foundations firstly there is a serious danger of
undermining your garage - especially if the trench/excavation is for any
length. Secondly your neighbour should serve 3m notices in compliance with
the Party Wall etc Act 1996 - an act of parliament.
Regards
What action should I take? I have legal Insurance with DAS and they seems
to be trying to evade any action against the neighbour.
What else could I do?
