Yeah, this makes sense: A 10-year-old suggests a bully
should be shot with a water pistol, so the police
confiscate his fatherīŋŊs firearms and the State revokes
his concealed-carry permit.

It happened in New York, a State that is notorious for
the difficulty it causes its residents who want to
legally carry a gun and that recently suspended the U.S.
Constitution and passed draconian gun restrictions. The
father posted news of his plight April 1 on the
Longislandfirearms.com forum.

As much as heīŋŊd like it to have been a bad April FoolīŋŊs
joke, itīŋŊs not. In addition to having his guns
confiscated and his license revoked, John MayerīŋŊs son was
suspended for two days by the Hauppauge School District
following the March 1 incident. When Mayer inquired the
next day about when his license would be restored, police
told him it would be restored when his son turned 18 and
moved out of the house.

Well it looks like the author Bob Livingston, didn't make much effort
to get full information on this story. Livingston wrote:

So far, everything is pretty vague and not much is being said.

The father's pistol license was "suspended indefinitely" (an
absurdity)

The authorities stated, “The Suffolk County Police Department to my
knowledge did not have the OPPORTUNITY to confiscate any of
firearms,” [caps added by me]

AND

“John Mayer was able to think quickly and transfer the ownership of
his weapons before any action could be taken.”


The authorities stated, "The Suffolk County Police Department also has
an obligation to ensure the safety of people in the community,
especially children, while this investigation continues."

The fact that an investigation is taking place is absurd.

Just The Mention Of A Gun In School

March 1st was just another day when I put my 10 year old,
fourth grade son John on the bus and sent him off to
school. Or so I thought. On the contrary, today was the
day that my life as a gun owner was about to change,
dramatically and rapidly.

Sometime during the day, my son allegedly spoke with a
few of his classmates. The boys (excluding my son) were
involved in a school yard pushing incident the day
before. Two or three of these boys (including my son)
were talking about going to the house of the boys that
did the pushing. These boys were to take with them a
water, paint and bb gun. Word of this got to the
principal. She immediately interrogated the children. I
received a call from the principal advising me of this
just as my son got off the bus. She also advised me that
my son was to be suspended for two days because of his
words. She decided that this talk amongst students
warranted filing a police report. If this wasn't bad
enough, the police were sent to my residence and I was
advised that my guns may be taken from me. This can't be
happening, I thought. But it was.

The following Monday I received a call from Pistol
Licensing that they would be at my residence in the
morning to take my guns and suspend my license. I
attempted to explain that this must be a mistake, no
wrong doing occurred on my part. My son has no access to
any of my guns. The officer that came to my residence saw
that all my guns were secured.Pistol Licensing was not
interested in my side of the story. They were only
interested in what happened with my ten year old son in
school.

This is what gun mania does to people. The gun nut side want to go
overboard in what they say they should own and the gun sane side
respond according to the law of opposite and equal reaction, as in
their inane handling of this particular situation. The more insane
the good side gets in reacting to gun issues is a reflection of how
insane the bad side has gotten. To defuse the insanity on both sides,
you need to first diffuse the insanity behind gun ownership.

Ocean County prosecutor's office spokesman Al Della Fave confirmed
Brandon Holt had died but said he couldn't provide further details.
Toms River police Chief Michael Mastronardy said Holt was pronounced
dead at 5 p.m. Tuesday, nearly 24 hours after the shooting occurred in
a neighborhood that residents described as "very quiet."

The 4-year-old, whose name was withheld, was not injured.

Prosecutor Joseph Coronato, speaking earlier Tuesday at a news
conference, said the boy got the .22-caliber rifle from his home and
it discharged accidentally Monday evening. The children, whose
families live in the neighborhood, were about 15 yards apart.

Center for Disease Control and prevention data obtained by The
Christian Science Monitor shows 35 accidental firearm deaths per
100,000 children ages 5 to 9 between 2008 and 2010. For children 4-
years-old and younger, 62 died.

The younger boy's mother called the emergency dispatcher to report the
shooting, Coronato said.

Coronato said it was too early in the investigation to know whether
anyone would be charged. He would not say who owned the gun or
speculate on how the 4-year-old got it.

Mastronardy called the shooting tragic and said it affected the whole
community, a sentiment shared by those who live there.

One resident said the two families had not lived in the neighborhood
for long and she did not know them well.

"I'm sad for the children involved and their families, but I'm angry
with whoever owns that gun and allowed a little child to get hold of
it. A 4-year-old can't load a gun," said Debi Coto, who lives a few
doors down. "I had just been telling my sister how nice it is to see
kids playing together and enjoying themselves, and then this happens."

Coto said the 4-year-old's mother seemed very upset in the minutes
after the shooting and appeared to be trying to comprehend what had
happened.

The shooting came just days after a 4-year-old boy in Tennessee
grabbed a loaded gun at a family cookout and accidentally shot to
death the wife of a sheriff's deputy and amid debate over gun control
laws in the wake of December's Newtown, Connecticut, elementary school
massacre.

I am unable to vet this story. I see where the first person posted to
a public forum and we all know how reliable these are. A child
certainly would and should face disciplanary action for a threat
involving a gun of any type and, apparently, this one went well beyond
a device that squirted water. We have to take threats of gun violence
seriously particularly when the child has access to guns in his or her
home.

I did a little research and found this quote from the SCPD:

"Contrary to some inaccurate reports currently circulating, the
Suffolk County Police Department did not confiscate any of Mayer�s
firearms."

The police told Mayer that they were going to confiscate his guns and
suspend his pistol permit.

Mayer transferred ownership of his pistols to a friend and the
ownership of his long guns to a gun store before the police came and
the police did not have the "opportunity" to confiscate them.

You will hear this kind of tripe all over Usenet; however, *I* need
more than "he said she said". If they weren't legally his, then he
couldn't transfer them. Anyway, the story has now *morphed* from
"confiscation" to they wanted to confiscate them... and that's a sure
sign of an urban myth.

Furthermore, the SCPD denied that anyone's permit had been
suspended... but I think I'd vote to suspend it because he's a jerk
and has a wimp for a son. What'd he do? Bury his permit in the back
yard so they couldn't find it?

Naaa... this one is another replay of that story about Jane Fonda, the
POWs, and the secret notes they passed. Not that it couldn't happen,
mind you... it just didn't.

As I said: it has all of the indications of an urban myth.

If law enforcement in New York could have confiscated his guns, which
I seriously doubt, then hiding them wouldn't change a thing in the
long run. If an agency has confiscatory power and issues such an
order, then the owner against whom the order is issued cannot transfer
ownership.

All you have is one person whining about his kid being disciplined in
school. I'm not saying that it couldn't happen. If you're diagnosed
with schizophrenia, for example, it will most definitely happen. I'm
just saying that I find no hard evidence of a confiscation order being
issued over a water pistol and doubt the veracity of the story at this
point in time... but I *have* seen stranger things.

For example: I once saw a cat with six toes... I wouldn't have
believed that a six-toed cat existed until I actually saw one.
