TURMEL: Doris New medPot charges to be withdrawn after Howard Popham's death

to trial, I recounted:
JCT: 69-year-old Howard Popham and his companion Doris
New had a farm on the north shore of the Ottawa River
and were busted for a crop of over 3,000 outdoor plants
in 2016. DNA testing was done in 2017 and charges were
just laid a few weeks ago in 2018. So they face a
Mandatory Minimum of 2 years for both these oldsters
when it's over after many years. June 6 for the 1st
appearance of these threats to society. Cops and
Gardeners on parade.
This was Quebec and Howard was never to find a doctor.
Howard has been ailing. He had to miss the last hearing
where Doris explained he was in the hospital undergoing
surgery.
After several more surgeries, I sad to report he passed
away yesterday. Guess he really qualified for medical
need.
Doris will now have to face the production charge on her
own. The only problem is that Howard filed the Quash and
Constitutional Motions, not her. Can they amend his
documentation to substitute her name or does she have to
file it all over again? June 19, she's back in court to
find out.

JCT: I forgot to mention that Max Gauthier helped both
Howard and Doris get their exemptions which had to
complicate the Crown's case given they could probably
"establish medical need to simply be exempt!" (Hitzig
Paragraph 170)

Ray says the Crown called to tell Doris that they would be
withdrawing her charges on June 19.

But they want to keep any pot equipment found in the home.
They need to get a seizure order for the equipment unlike
Doris needing a S.24 for Return of the substance. So seizing
her equipment will which will be resisted now that she has
her own permit to use the machinery that can't be linked to
the plants outside. Prove those scales were used to weigh
those plants outside. We'll see.
