Marlins fined over hiring of manager

Major League Baseball has levied a six-figure fine, thought to be up
to $250,000, against the Marlins for failing to consider minority
candidates when they hired Jack McKeon as their manager earlier this
month, sources said Thursday.
The Marlins could have faced as much as a $2 million fine for
violating Commissioner Bud Selig's minority-hiring initiative, which
requires teams to notify him of top job vacancies, including manager,
and to provide a list of minority candidates considered for the
position.
Still, the fine is thought to be the largest ever levied against a
South Florida pro franchise.
The Marlins, sources said, spoke only with McKeon about the position,
which came open when the team fired Jeff Torborg late on May 10.
Marlins major league coaches Ozzie Guillen and Bill Robinson and
front-office assistants Tony Perez and Andre Dawson were not
considered even though all four are minorities.
"The matter has been dealt with," Baseball's President and Chief
Operating Officer Robert A. DuPuy said Thursday.
DuPuy would not elaborate or comment further. The Marlins also
declined to discuss the fine.
"The issue has been resolved," Marlins President David Samson said
through a club spokesman.
In April 1999 Selig sent a letter to major league clubs laying out
guidelines for boosting minority hiring, including requiring teams to
notify him when certain upper-level positions were open, and providing
him with a list of minority candidates.
The commissioner's office is supposed to review those names before
teams make managerial hires, whether the changes come during the
season or not. A minimum of two minority candidates are typically
interviewed for such positions.
In 2000, Selig reportedly fined the Detroit Tigers $250,000 for hiring
Phil Garner as manager without interviewing anyone else. But the
Tigers sidestepped a larger fine by creating a community advisory
board committed "to Equal Employment Opportunities, their Diverse
Business Partners Program and their community relations activities,"
according to an MLB news release.
Selig did not return a message left at his office.
The Marlins cannot appeal the fine, which could have been avoided had
they notified Selig of their plans to change managers and explained
that while they could have considered minority candidates, they chose
McKeon on a temporary basis to fill out the rest of the season, and
particularly because of his experience righting wayward franchises.
The Marlins have never explained publicly whether they interviewed
anyone other than McKeon, other than to say that they followed MLB's
procedures. Samson has said team owner Jeffrey Loria spoke with Selig
on the morning the announcement was made, but Selig had already
learned of it from television reports and was "very upset," a source
confirmed Thursday.
When asked about the potential for a fine earlier this month, Samson
dismissed the notion and referred to the team's "impeccable track
record of minority hiring."
"The point of [the commissioner's edict] is to make sure, in my
interpretation, that organizations take into account all candidates
for all positions at any time without any regard to race, religion,
color, or creed," Samson said at the time. "Our organization does that
consistently, which is why I'm not concerned about this inquiry."
Of the 60 combined manager and general manager positions in the
majors, minorities occupy nine (15 percent). Ken Williams of the White
Sox and Omar Minaya of the MLB-owned Montreal Expos are the lone
minority GMs.
