Portland property maintenance company faces lawsuit over phallus cake allegedly sent to ex-employee by HR

PORTLAND, Ore. — A Portland property maintenance company is in legal hot
water after their HR manager allegedly sent a phallus-shaped cake and a
message encouraging the recipient, a former employee, to eat it.

According to a press release, Dasher Lights LLC and Aspen Ridge Property
Services are facing charges of racial discrimination, harassment, and
retaliation.

The suit alleges that the Portland-based property maintenance company
allowed the Human Resources manager to "harass a Hispanic employee without
consequence, ultimately forcing him to resign due to an increasingly
hostile work environment."

According to the release, in May 2022 a janitorial Operations Manager at
the company "received a large [...] chocolate penis and scrotum at his
home with the message 'Eat A D--k' on the inside box cover,' sent by a
supervisory employee.

The supervisory employee, who was in charge of human resources for the
company, "mistakenly left her own name on the offensive package and later
admitted sending it, after the shipping information confirmed her
identity." She also allegedly called the victim a "huge d--k" in front of
management shortly before the incident.

The victim's spouse and daughter were reportedly at home when the package
arrived and were "deeply disturbed by the contents and message," including
the "obvious racial implications."

According to the lawsuit, the HR employee was not instantly fired.
Instead, Aspen Ridge’s owners eventually offered the cake-recipient victim
a $50 gift certificate and a promised apology - which never materialized.

The lawsuit claims that the victim experienced isolation and retaliation
for trying to "seek solutions" to the incident, including the repeated
dumping out and scattering of garbage the employee had cleaned up. The
lawsuit alleges that HR's husband, who also worked at Aspen Ridge, was
complicit in the victim employee's harassment.

“To allow a supervisory employee in a position of power—especially one
with responsibility for human resources functions—to act in such a
blatantly racist and harassing manner toward an employee is inexcusable
enough, but the retaliation my client received while advocating for some
basic human dignity and a safe working environment went the step beyond,”
said the victim's lead attorney Daniel Le Roux in the release. “We hope
this case sends a clear message that if an Oregon company allows this
level of outrageous behavior, they will be held accountable.”
