Question on H1 Transfer

Hi,
I have a question on H1B visa transfer.
My H1 was Approved and I got the visa stamped few months back, but the
company that sponsored my H1 is not showing interest in sending me to
the US - I am still in my home country (India).
They are saying things like the project for which they selected me has
been closed and I will have to wait till they find a new project ...

In this situation (I have not started working for the company that
sponsored my visa), I am want to know if A new company can file a
transfer for me (based on the fact that my visa has been stamped
several months back) or does the new company have to file a new
application (I would like to avoid this as I will have to wait for the
application to be approved)

Any help in this regard would be appriciated.

Hi,

There is nothing called H1 transfer. The new company will have to file
a entirely new H1B for you. The process may become simpler if you
already have a copy of the approved H1B.

In plain English, you are shit out of luck. You can kiss that one
goodbye. You should stay in India. There are layoffs left and right
with huge numbers of unemployed IT workers. Have some respect and
leave the job for an American. You think we have tons of IT jobs
here??? We don't! It is a tight labor market. Now begone!

With all due respect sir, why do American companies say "we are an
equal opportunity employer" ?
But I think If I leave the job, another Indian will get it - the visa
quota numbers are there you know ...

Thanks for your response,
I do have an approved H1B, already stamped.
but, as I said,
I have not started working for the company that sponsored my visa, I
want to know if a new company can file a transfer for me or does the
new company have to file a new application - The new application will
take 2-3 months to be processed and would use up another persons chance
to work in US as it would be counted against the quota.
I heard that according to the new law, I can start working for the new
company as soon as they file for a transfer (there is something called
a transfer as far as I know ...) but what I am not sure of is

This is interest. I wonder what our h1-b lovers would do to explain this clear
breach in the theory that they are comming to fill vacant jobs. I guess they
really are making the job vacant on demand or approval of the h1-1 visa.

Don't listen to Dan. There are not huge numbers of unemployed IT workers. He
simply is a bigot who doesn't want anyone coming here to work so he'll lie
or do whatever it takes to keep them out. The only grain of truth in his
entire post is that you are probably out of luck in regard to the job for
which your H-1B was filed.

Companies are required by our government to say they are "equal
opportunity employers". It nothing but boiler plate and is essentially
meaningless.

I dont know if you are eligible to apply for a visa transfer, as you
have not started working for the old company. You could post this
question to alt.visa.us & address it to ingo. In addition to this you
can search the archives here, there might have been somebody in your
position.

ps: I doubt if the time differnce for a new visa & a transfer is
considerable. Why not ask the new co to get you a new visa ?
