Topic: "How H.R. 3408 Could Affect Your Future as an Independent Contractor"
Rep. McDermott (D-WA) introduced a bill, H.R. 3408 which includes a
repeal of Section 530 of the Revenue Act of 1978. In this bill,
McDermott wants to close a perceived loophole of payments to a
corporation not currently requiring 1099-MISC filings. This means your
small business would need to send a 1099 to all service suppliers and
vendors where you have done more then the mandated 1099 minimum in a
calendar year.
While that might not seem overly perverse, H.R.3408 goes on to discuss
the reclassification of independent contractors to employee status.
Written in the usual obtuse and unclear language, it leaves room for a
broad-brush interpretation of reclassifying current contractors as
employees if the client does not satisfy new criteria for justifying
their treatment of them as independent contractors. In addition to
severe tax consequences, the interpretation could eliminate our ability
to operate as independents.
