Replace files despite being in use

Hi,

I have to write an AppleScript app, which replaces a number of font
files. For this, I wrote the following syntax:

move every file of folder (myTempFontFolderPath as alias) to
myFontFolder with replacing without invisibles

I know that this syntax is correct, because it works correctly if the
files don't exist yet. Unfortunately, I get the following error if the
files do exist already:

error "Finder got an error: The operation can靖 be completed because 陴
is in use." number -47

Consequently, the files are not replaced. Does anyone have an idea as to
how to replace the files despite being in use? I'd rather not move them
to the trash one by one.

The app need to be a GUI app eventually, which makes it seem that using
a terminal command with sudo is no option, but otherwise all suggestions
are highly appreciated.
