DCI disqualifies Aussie Twice !!!

The Short Version

I won a place in the Dallas Pro tour.
I am disqualified.
I am told I can qualify again.
I qualify again.
I am banned because of first disqualification.
I am angry.


The Long Version

Oct 6th(?) I came second in the Melbourne Pro tour. Gaining a Pro Tour
berth.

Oct 17th Contacted by Jason Carl (DCI head) and told I have been
disqualified and
my placing in the Pro Tour Qualifier has been anulled. At this stage I have
not been banned.

Oct 28th Told by Luke Devlin (Melbourne DCI) that he has contacted
Heather
Henricks (DCI) and she has specifically stated that I may qualify in New
Zealand.

Oct 29th Buy EXPENSIVE international flight to New Zealand.

Oct 30th Contacted by Luke Devlin and told he has some bad news. I
tell him I dont
want to hear from him and hang up on him.

Nov 2nd I came second in New Zealand Pro tour. Gaining a Pro Tour
berth.

Nov 3rd Find out from Housemates I have been banned. Send
inquisitive and
pleading email to DCI.

Nov 7th Return to Melbourne and find Fed-Ex letter dated 30th Oct
banning me for 2
months from the 19th Oct. Signed Jason Carl. It arrived on the 5th or 6th of
November.


I am currently banned.

I would be very surprised if any of the people involved dispute any of what
I have stated
occured with the following exceptions :-
1) Luke Devlin claims he told me I "should not go to New
Zealand" before I
hung up on him.
2) I am told that Heather Henricks claims she told me
directly to do nothing
without written approval. I have never spoken to this woman and would be
fascinated to find
out when this was meant to have occured. If she does not remember this
conversation either
I am sure I was misinformed.


Details, Commentary and Questions.

I disagree with but do not dispute my initial disqualification. I
did not fight it or lie to
them. They should and do have the power to take my first pro tour slot. I
have had to explain
to friends, family and peers why I was not going to Dallas. Think about
that.

I was told by DCI I could try again. I did so at 5 days notice in a
completely unfamiliar
tournament class (Ice Age / Alliances) as the Melbourne tournament had been
type 2 .With a
27 hours old deck against unknown competition I managed to come second.

The reason I went to New Zealand was to regain my honor thereby
proving I desevre
to go to Dallas. If I lost out I would have looked quite the fool, dont you
think?

Since I came 9th at the 1995 world Championships I qualified for the
first Pro Tour in
New York. I was told by DCI two weeks returning to Melbourne, from New York.

If I can not believe what Heather Henricks says why is she allowed
to speak?
How can I be banned from the 19th of October if they only decided on
the 30th?
If they wished to stop me from qualifying why did they not contact
the New Zealand
tournament organiser? Were they just hoping my arrogant gesture would fail
so the problem
would just disappear?

I have no right of appeal and no legal rights as I am not an
American citizen. This is
my appeal. I feel ripped off and angry and wish to spread my story. I feel
it at least makes
good reading, feel free to tell your friends.

This whole Glenn Shanley banning thing would be easier to evaluate if
I knew why he was banned or DQed in the first place. So, why was he?

The issue of why you were banned aside (and it seems like you admit
some level of responsibility) this is where you made an error.
Your failure to listen here cost you. If you bought an expensive
ticket on short notice, it was most likely refundable. You had a
chance and didn't take it.

As for having no rights because you are outside the US - this is a
NON-ISSUE!!! Read the other posts about the DCI ranking system and
the accuracy/efficiency of their updates. The system is a disaster,
and a lot of people are suffering because fo it. It is not because
you are overseas, it is because the DCI is run by a bunch of gamers
who think its "cool" and not by someone with any real experience.
How long it will take for them to develop the skill needed to run
this effieciently is anyones guess.

unless i missed it, id like to see the explanation as well. i wonder why
he left it out, he had to know that would be the first question in our
minds. maybe its becuase whatever he did will automatically make us
think he got what he deserved? any info would be appreciated.

This is very interesting. When I received an important call, I at least
listen to the man. Maybe you were just too upset to listen to what he
had to say?

Exactly what did you do? Did you pull a Chip Hogan and bribe another
player? That episode got tremendous play over the newsgroups so I feel
you'd be familier with the dos and don'ts of that sort of thing. WHAT
DID YOU DO???

I know several Americans that didn't get a chance to 'appeal' their
suspensions because there was nothing to appeal. You've stated above
that you didn't fight this 1st anullment, so you obviously agree you did
something wrong. If you'd have listened to the organizer that called,
instead of hang up, maybe you'd have a better understanding of what's
going on. We certainly don't.

PS-I'm not trying to take sides in this, but as Chris Pikula and Dan OMS
have stated, you haven't said a damn thing about why they banned you.
There was a prominent American player that got caught drawing extra
cards at a qualifier in Nevada last April, right before Long Beach.
There was no question that he did this. He knew that he wasn't going to
get a spot, AND he didn't try for another one because he knew some
punishment was coming down (one year suspension). Until you tell us
what the hell you did, I'd have to agree with Wotc's banning.

As far as I understand it Glenn was banned for collusion, based on the
other player at the Melbourne Pro Tour receiving an offer of the
prize-packs for forfeiting the last game so he could have a 2-1 win.

You certainly have legal rights.

My advice is sue them for punative damages. It's a tradition as old as
America. The only problem is that it may be expensive, and I doubt any
lawyer would take your case pro bono.

I don't know how solid your case is, but I wouldn't mind it in the
least if someone lit a fire up the DCI's butt.

he was banned.

One of my Australian friends has confirmed that the player in question
colluded with his Semis or quarters opponent by offering said opponent
all the prizes he would win at the qualifier. After the awards
ceremony, the opponent reported the collusion to the head official (who
did not know about the collusion when it occured). The player was
suspended for two months from DCI play (which means he couldn't play in
any sanctioned tourneys during this time, including one in New Zeland).
He hung up the phone on the officials who tried to inform him of this
decision before they had the chance to do so. He goes off to NZ for the
qualifier. He finds out that he loses his spot after he comes back. Oh
well. Maybe next time he'll take the full phone call.

Yes... he cheated. He didnt need to, he screwed up, and he should have known
better. He has been banned for 2 months.

Looking back, 17 years later, this ban really was BS.

What we did is now standard practice at every current protour qualifier.

There was no airfare involved back then.
If Andre won that final, he was not spending the 2000 bucks to fly there.
But I was.

So, he got all the cardboard, and I got the right to sit down in the big leagues.

...And then Wizards got it wrong.


My morality has not changed.
What we did was just fine.
What we did is now perfectly legal, and expected play.
