Why didn’t you post the link to the story that you spoke of?

The link you posted went to a story with no teenagers and no one shot
or shooting from under a car.
Also doesn’t say how many times he was shot.
Just that 3 bangs were reported, not how many missed the target.

In fact, the only thing you got right was that it was in Austen.

It looks like some druggy crashed his car then left the scene of the
accident and walked a block down.
Then was apparently messing around on the shooters property where he
was subsequently shot.

Lesson learned?
Don’t leave the scene of an accident and try to hide by breaking into
someone’s property.
When entering someone’s property, stay on the sidewalk and go straight
to the door and knock.
If no answer, turn around and leave the property immediately.

Any other actives are the actions of a thief and needs shot.

Also apparently gunner commented without even reading the article.

A broken down car is not criminally worthy of being shot in the
back by a nutter, and certainly the nutter had no idea of that
prior event. "Last Resort" is not finding a teenager outside
at night and fleeing. A cop certainly couldn't get away with that
behaviour and neither will this murderer .

Yes, the laws are the exact same in every state, as well as the federal
government. The only reason there are different law books for each state

therefore, are virtually identical from state to state, with some minor

When discussing the law, wording is very important. Most legal terms are
certainly universal in the US, but descriptions of specific crimes vary
quite a bit. "Aggravated" and "Armed" mean different things in different
states, as well as the USC, because they aren't legal terms, but
descriptions of how a crime was committed.

Also, there are 13 Circuit Courts in the federal court system, each covering
a different section of the country, and they aren't bound by each other's
decisions. They can, and often do, cite and abide by other Circuit Courts'
decisions, but are under no obligation to do so.

Now, as to your question. I'll not be going through each state's laws, both
because I haven't the time, and there's no need.

Anybody can be charged with anything, just as anybody can be sued for
anything. Charges are generally piled on, knocked off, and modified from
the moment the crime took place to conviction, and sometimes even years
after conviction.

In the case of California, PC 211 handles Robbery, while other penal codes
and sentencing enhancements deal with whether the accused was armed with a
bladed weapon, firearm, loaded firearm, fake firearm, and so on.

Having missed the original discussion, I have no idea what point you were
trying to make, but there's your answer.

This is indeed true. But Ill have to stipulate that they are a good
thing after they have reached a certain point in their criminal career.

Chicago Illinois, LA California, New York New York, and Hominy
Oklahoma?

Last time I checked in Hominy Oklahoma it was yes to all of them.
Especially the last one.
The first one was a possible defense and you may get lucky in court.
The middle one is a good opportunity for a plea bargain.

All of them will get you legally shot to death anywhere you try it in
Hominy Oklahoma.

And technically, you can be charged with anything even if you did
nothing.
The real question is would you be convicted and serve time for doing
it.
And that completely depends on your lawyer, the judge, the DA, and the
jury.

Aggravated (armed) robbery does not exist in California.

CPC 211. Robbery is the felonious taking of personal property in the
possession of another, from his person or immediate presence, and
against his will, accomplished by means of force or fear.
213. (a) Robbery is punishable as follows:
(1) Robbery of the first degree...
(2) Robbery of the second degree... Additional sentencing(12022.53) comes
into play if a gun is involved and that has several variations.
Further there is one state that does not even practice statutory law.

There is a significant difference between faith and confidence. Confidence

Yes, their states did. With modifications. Look up "Model Penal Code."

Further, it is not against Los Angeles, Chicago, or New York City's local
ordinances to shoot someone. Oh, they might get you for "discharging a
firearm within the city limits," but those cities have no local ordinances
against murder. State law governs.
