Dear Sir:
You will please be advised that as a crime victim I hereby request all
my rights under Section 37 of the North Carolina Constitution,
including the right to confer with prosecutors in the above-entitled
prosecution against Zachary Alan Keene. As I watched in my sister's
open field without cover, and after he had already twice tried to run
me down with his 4-wheeler, Keene, yelling and cursing, "I will blow
your GD head off!" pointed a high-powered rifle with telescopic sights
at me and fired in the afternoon of 5 October 2011. The bullet struck
in front of me. I saw the grass fly. For the first time in my life
someone pointed a gun at me and fired. I thought I was going to
die.
One of the 4 officers with Buncombe County Sheriff's Department who
arrived at the scene shortly after this man pointed his rifle and
fired at me refused to acknowledge the extent of Mr. Keene's criminal
liability and caused me to have to go to the magistrate's office and
obtain a warrant for misdemeanors when you know and I know Keene
committed a felony and has no business possessing ANY firearm.
Also be advised that TWO 911 emergency call recordings which I have
acquired clearly demonstrate that a big-bore rifle was fired and that
Mrs. Ruby Denton, wife of Rev. Leroy Denton, heard the blast from
Keene's rifle, which occurred less than 50 feet from her home. Before
officers arrived one of the two other boys with Keene ran with the
rifle into the woods as I watched, and hid it. It should have been
confiscated as evidence, but your officers appear to have some cozy
relationship with Keene, and made no effort to speak with an
independent witness, Mrs. Ruby Denton. You will also note that while
I was armed with a pistol I could not return fire because Keene used
the other two boys as shields; and two homes, the Denton home and the
home of Becky Netherton Cheek, were nearby. The Cheek home was
directly behind your Keene shooter.
Mrs. Denton is elderly, diabetic, and in a wheelchair. I don't want
to have to pull her into this, or subpoena her, but if I have to, I
will. She corroborates the facts, while you and your minions try to
alter them. The Denton phone number is published in the directory as
6xxxxxxx.
Also please be advised that the last time I drove down Gill Branch Rd.
to the home which I inherited from my father, Rev. James H. Smith, I
passed by Zachary Alan Keene as he emerged from Keene Tax Service on
Gill Branch Rd. and he was carrying a long rifle or shotgun and waving
it in the air above his head at me. So it appears to me that the
intervention of your officers has emboldened and enabled this young
man. What does he need with a gun? Why did he menace me with a gun?
I was unarmed. Perhaps you have even made him feel as though he is a
victim. Knowing you as I do, and plenty about your dirty political
shenanigans and political chicanery, I would not be surprised. Am I
supposed to be afraid to drive a public road to my own property
because of the likes of you, Zack Keene, and your officers? I grew up
here and have lived here 67 years. People like you, many of them
outsiders like you, have come here with their low ethics and turned
Buncombe County into the Wild West, something like Dakota Territory.
And I do not forget that so many times you walked up to me in the
courthouse, unprovoked, and made harassing remarks to me in the
presence of others which were obnoxious and deprecating, and
calculated to do harm.
I went to the courthouse yesterday to get true copies of the
cyberstalking warrant and the clerks could not find it. I want to
show it to the NC Court of Appeals. Do you know where it is?
And finally, any efforts on your part to lessen the seriousness of the
crimes committed against me on my land and on my sister's land, or to
alter the facts to accommodate Mr. Keene or sabotage my safety, will
be considered as both civil and criminal violations of my rights
guaranteed by the NC and United States Constitutions and applicable
acts of Congress of the United States. In this regard it is duly
noted that out of obviously corrupt motives you calendared the Keene
case for the 27th of January before Judge Julie Kepple with another
case in which I am prosecuted under a warrant which you suborned. At
the calendar call I requested the prosecutor and Judge Steven Cogburn
to set the case of the alleged cyberstalking, which is a frivolous and
malicious warrant, at the earliest possible date. This sly and
delayed setting did not happen inadvertently. You are forum-shopping
and playing malicious games. Your moral compass is broken. I know
what is going on here, and you are hereby warned not to violate my
civil rights under of color of law, because I will indeed respond to
this obvious and despicable conflict of interests and your malicious
unlawful gaming of the magistrates, judges, and the calendars of the
criminal courts.
There is much more to be gleaned from 5 October 2012, many more sordid
facts of wrongdoing by people sworn to protect and serve, but this
will be enough for now.

I busted two of those warrants on my own, this one and a subsequent one, both before they ever got to a jury. Bwaaaaaaaaaaaahahahahahaaaaaa!
