I don't reason with double standards, Jigsaw. I only defend myself when I'm
attacked. For the remaining, I consider that, as a man sows, so shall he
reap. This is why, after having received loads of insults from PV without
replying on that level, I finally did so. That's degrading, but that's the
only way I found. The most funny is that he finds it surprising.

I understand you never received any insult from PV, which is why you never
took position on this. Don't ask me to do it on Dezi: he never insulted me
either.

Desi receives many insults in general, and I'm unable to say, at least for
some posters (William Robert for instance), who provoked them. I can't
possibly advise you on what to do. That matter can only be solved on an
individual basis. I only can say that, in principle, I disapprove this means
of tarnishing others, whoever uses it.

"legal murder" was a "stupid oxymoron". I said it was an oxymoron, full
point. Oxymora are commonly used in English and I can't see under which
biased standard one could label them as "stupid". Other frequent oxymora in
English are expressions like "deafening silence" or "mournful optimist".

What is _surprising_, is that you can FINALLY spell the word _surprising_,
since it's given you considerable difficulty in the past. To make it _simple_ for
you.
Two examples --
1) I used a simple method to solve this problem.
2) I used a simplistic method to solve this problem.

Both MEAN that a _simple_ method was used, simply that 2) can
imply that the method used, ALTHOUGH STILL SIMPLE, should
NOT have been used. In fact, 1) could also imply that the
_simple_ method used, was not the one that should have been
used. euro's pitiful excuse for an argument was that I overly
simplified what HE sees as complicated, by calling my _mind_
simplistic (of course he also claims to never insult). I argued that
he wouldn't know _simple_ from _complicated_ if it bit him in the
ass (an admitted, but deserved insult). And implied that problems
can ALSO be _overly complicated_ when they ARE simple.
An argument he was unable to grasp by presuming that simplistic
has nothing to do with simple (but of course it DOES, by definition),
and that it doesn't REFER to simplicity (which is DOES, by
definition).

Now, I understand how you also always unnecessary complicate things
that are simple (see my first comment above)... perhaps because you find
anyone who calls changing rolls of toilet paper _simple_ is mistaken, and
you consider it a complicated procedure which cannot be performed in
a _simplistic_ manner. Tell me, do you always insure the roll exits over
the top... or from the bottom?

Further, you will find that the word simplistic most certainly does REFER
to "simplicity" in contradiction to euro's words. Since you need only
look to the definition to find that it does. Looking at the definition itself,
which says "Of the nature of, or characterized by, (extreme) simplicity."
You do know what the word _refer_ means? Or are you going to try
and _complicate_ that, as well.

"simplicity", but what I wrote ("Simplistic" doesn't mean "simple" and

I agree with your statement except that PV does not unconditionally support
the dp. He's a bit over the top, IMO, but is much baited by resident
masters. Perhaps Euro should meditate upon the absurdity of his
unconditional opposition to the dp. Euro is unable to differentiate between
near complete rejection of the dp and unconditional support for the dp.
Pragmatic opposition to the dp means understanding that the unconditional
vocal opposition to the dp is as foolish as the unconditional vocal
advocates are meanspirited and incapable of recognizing that death is not

Erm... dan... not that I wish to make a big thing about this... but how
can you both AGREE with his statement, and then state "except" that
I do "not unconditionally support the DP"? Since the entire content of his
statement was asserting that I DO give "unconditional support to death
penalty."

To be clear... you are correct in your assessment of my views... I do
NOT "unconditionally support the DP." I am probably closer to
being an abolitionist than any other retentionist member of this group,
excepting your good self, who I sometimes believe to be an abolitionist
already. Although euro is rather hypocritical, since I believe he gives
_unconditional OPPOSITION to the DP_. Thus presuming that his
view is somehow superior to anyone holding another view. I can
certainly see a social condition that would cause me to change my
support for the DP. I am relatively certain that he is unable to see a
social condition in which he would support the DP.

And of course... "blood doesn't wash away blood" is a Persian saying,
in respect to revenge. Which euro feels every insult demands another
in return, even if he provides the most Kindergarten kind of stuff...the
"you are," "no... you are," "NO... you are," increasing only in volume,
simply repeating the same insult and throwing it back, without the
slightest bit of originality or an ability to respond rationally.

I have been ignoring your continuous insults for more than one year before I
began replying this way. That may not be the best reply, as I already told
to Jigsaw, but I don't see why I should just keep ignoring these insults and
producing rational arguments in front of someone who is so hysterical that
at times he can't even understand why human rights can't apply to animals.

Or, should I say, someone who believes there is a "right to life" when it
comes to justifying a ban on abortion but calls me names when I use the same
argument to justify a ban on death penalty.

It starts out that way, Euro: with people trying to respect FW. As he
calls everyone who agrees with him a 'moron', or a 'looney', or
'mental', or 'evil', or a 'goblin', and brandishes his crucifix aloft,
whilst claiming, 'natural rights cannot exist without a creator, you
spastic !', it is impossible to reason with him. As his lack of
formal education torments him, and drives him to use words that he
received in his Oxford Word of the Day e-mail, in an attempt to appear
erudite, the only reactions he elicits now are disgust, and amusement
at his latest gimmicks.

Mea culpa - I was referring to the "blood" comment, which I agree with.
Blood for blood does not equate with justice. Sometimes balancing of the
the judicial scales can only be achieved via execution, but rarely. I've
noted those cases that are candidates for such treatment.

It's interesting how merely changing who I respond to has changed the
perception of my position. In the past, I've largely debated with those who
hold the view that the dp is a regular, normal, acceptable course of
action - which has won me the enmity of many. I don't however have much
patience with those who proclaim absolutes from the opposition side, as Euro
has found.

Euro's position is that he would never support a decision to execute (though
oddly, he doesn't mind if others pay the consequences for his blindness).
Alway never is a fool's paradise. I'm a pragmatist. We don't have the
tools to implement safe imprisonment for some offenders without also
violating their basic civil rights and until we do, I'm unwilling to accept
that we should risk the lives of others (inmates, guards, Euro) for the sake
of inhumanely treating inmates who are a perennial danger and a false
"moral" stand.

I've found it near impossible to have a dialog with Euro since he fails to
acknowledge that every choice has consequences and limitations. Standing on
a pedestal proclaiming one's own superiority is the mark of a fool.

Of course establishing that _anything_ is indisputable is not possible. It
is however, possible to carefully and narrow define what circumstances would
qualify one for a death sentence, just as is done for prison sentences or
probation. The existence of a single voice of dissent ought not dictate
societal policy in a balanced democracy. Note the use of the word
"balanced". Democracy itself is not necessarily the sole criterion for
establishing policy - in order to have democracy in which the rights of
individuals are protected, we use some fairly undemocratic strictures - i.e.
the Bill of Rights.

That's not bigotry. Not more than those who argue that torture or slavery
are never appropriate measures. Saying that is actually just as hypocritical
as trying to convince others that you are an abolitionist in "certain"
conditions but actually staunchly oppose any move towards abolition.
Pragmaticism, when it results in bargainings on human rights, isn't a more
"progressive" or "acceptable" stance.

how to make sure that the limit you set can be implemented to every
particular case with no inequity. This is impossible with any justice
punishment. Hence the necessity to only keep reversible punishments, as only
these can ensure that any damage or inequity be repaired.

they are not "by themselves...." and then you say "they are..." Whether
they "make a point" is not the question. They ARE contradictory or absurd.
By definition. That is their PURPOSE. You simply throw around the words

can say under what social conditions you would support the DP,

cannot STAND FANATICS. They have been the bane of our species,

Only in your narrow minded world. When have you met with state legislators
to hone the range of penalties down? When have you succeeded in improving
the conditions for death row inmates, making available more funding for
appeals, more access to legal materials or gaining visibility for death row
inmates' cases?

You might want to refer to the case of Kenneth McDuff who was sentenced to
death under the pre-Furman laws, had his death sentence commuted and
promptly upon his parole 15 or so years later, went on a 3 year killing
spree. This is to say nothing about his behavior while in prison. Refer

"[F]rom 1965 to 1992, McDuff had been arrested for burglary, sent to prison,
paroled, arrested for three brutal murders while on parole, convicted of
first-degree murder, sent back to prison and placed on death row, taken off

making terroristic threats while on parole, sent back to prison, paroled
again, arrested for driving while intoxicated while on parole, put in jail,
released from jail, placed on probation, arrested for public intoxication
while on parole and probation, arrested for murder while on parole and
probation again, and finally, put back on death row."

I'd agree that there may have been some redeeming value, but am hard pressed
to find even a smidgen of worth in him. He apparently also felt this way -
his final words were "release me".

McDuff's was the case that precipitated many of TX's draconian measures and
the reason why there is such a dearth of compassion for less dangerous
murderers. Sadly, due either to the size of the US population or something
about the culture, notable and dangerous killers are found in greater
numbers than elsewhere. Not dealing with them effectively is not something
the US population has shown itself willing to do. As with any policy, there
are others who are damaged, which is why I advocate a careful restriction on
the use of the dp. While I'd like to see no need for the dp, convincing a

Again... you seem determined to be deceptive in your words. I am certainly
NOT in favor of a ban of abortion. And you will not find any comment from me
that suggests that. I am opposed to on-demand abortion. The fact that
you cannot see the difference speaks volumes to your inability to see the forest
from the trees. And it demonstrates how often you attempt to distort what I and
others say here, in your determined pursuit of a concept in respect to a 'right
to life,' that even you cannot articulate properly, without depending on
plagiarizing the words of others.

1) I am against murder... which is the conscious and deliberate decision of ONE
HUMAN to terminate the physical existence of another HUMAN in what is
defined to be murder in the law.

2) Similarly, I am against on-demand abortion.... which is the conscious and
deliberate decision of ONE HUMAN to terminate the physical existence of
the unborn fetus they are carrying.

3) I am NOT opposed to the FUNDAMENTAL concept of the DP in respect to
executing _a murderer_.

4) Similarly, I am NOT opposed to the FUNDAMENTAL concept of abortion in
respect to aborting _a fetus_.

5) I have no FUNDAMENTAL problem with my society justifying KILLING,
believing that various forms of killings CAN be justified. I have no problem with
my society determining whether the individual killing of one member of my society
by another was justifiable in certain senses, or an unavoidable accident. With my
society determining the ultimate reasoning behind each individual killing, in the
sense of recognizing whether it is lawful or unlawful.

6) Similarly, I have no FUNDAMENTAL problem with my society justifying
ABORTION, believing that certain abortions CAN be justified. I have no problem
with my society determining who among those carrying a fetus can justifiably have
an abortion. With my society determining the ultimate reasoning behind each
individual abortion, in the sense of recognizing whether it is necessary or
unnecessary.

7) I believe it would be immoral and senseless to presume or implement laws
regarding the DP which would expect that all murderers should be executed,
without regard to the circumstances or behavior of those murderers. I would
oppose any such draconian implementation of the DP in the U.S. Many
circumstances exist surrounding the crime of murder in which my society should
readily punish with other than the DP.

address the issue of directly answering if the fetus IS life, because they
consciously KNOW it is. So they must always avoid that question, and
instead counter with some silly claim of the 'sovereign right to their own
body,' of the carrier. As if anyone could go into a doctor's office and

to their body, because of such a 'sovereign right to their own body,' as they
now can go into a doctor's office and ON-DEMAND the removal by abortion

believe he is still alive... to give the impression of truth to a lie. IMHO.

I have said it before -- I would, in an instant, trade my support for the DP
in the U.S., for laws which would require as least a minimal intervention
by my society in determining the necessity for abortion, consistent with the
needs of BOTH the carrier and the unborn fetus. With the life of the
carrier ALWAYS superior to the life of the unborn fetus if the carrier's
life is threatened by the continued gestation of the fetus, or certain
emotional issues provide justification for an abortion. Further, I am
not opposed to ANY form of non-invasive birth-control, including those
that induce the menstrual cycle, if the existence of a viable fetus has not
been recognized. If you think for one instant that I would compare the
execution of 849 of the most disgusting members of our species in 25
years, to the waste in innocent life in on-demand abortion in the U.S.,
a land of plenty that could easily absorb twice its present population
and benefit by such growth, you are gravely mistaken. I cannot speak
to the morality of other countries or societies. I must first look inward
toward mine, in both the argument of the DP and on-demand abortion.

In respect to on-demand abortion -- many countries do not enjoy the
opportunities for growth which exist in the U.S. because of over-population,
limited size, and insufficient resources/arable land. They certainly can
morally justify on-demand abortion as a means of limiting starvation,
poverty and over-population. I would never presume that they should
not provide a right for on-demand abortion given such extreme
circumstances which would result from simply more unfed mouths
if on-demand abortion were not permitted. In fact, I support efforts
from various U.S. and U.N. organizations which provide related works
toward controlling population growth in those areas.

In respect to the DP -- many countries do not experience the elevated
levels of violence and murder which exists in the U.S. I cannot speak
to presuming they would find the DP as suitable in their society as I
find it to be in mine. Truth be told -- I don't care if other societies spank
them, or send them to bed without supper as their punishment for having
murdered. What they do with murderers is their business. Should the
level of violence and murder be reduced in my society I would be more
amenable to abolishing the DP in the U.S. But excusing them ALL, at
the murder rate now experienced in the U.S. is unacceptable to me. The
reasons for this heightened violence and murder in my country would
consume an entire new post, and have been noted by me in many, many
posts here in the past, and I will not dwell on them again in this post.

Of course.. all IMHO.

Finally... end game -- I don't really GIVE A SHIT about those 849
murderers, when looking at even a week of on-demand abortion in the
U.S. After all they TOOK life... while the fetus IS LIFE!! To me those
849 are WORTHLESS. Others may believe that murderers provide
a "benefit" for our species, but I believe they are unable to articulate
what such a "benefit" is. Thus, for example, one hysterical poster found it
necessary to compare the "unemployed or ill" to murderers, claiming
they also have no "benefit," and another imbecile AGREED with him.
Another presumed that EVERYONE provided "benefit," but was
non-specific in respect to what "benefit" murderers provide. While
you found it necessary to presume that NONE of our species need
provide "benefit,' in your rather pathetic _defense_ of murderers, in
spite of the obvious flaws in any such argument, which presumes to
insult all those who have provided such "benefit," when we see how
far we have traveled since we first left the caves. I have no doubt
you would not enjoy being back in those caves.

Of course, I believe we have many flaws in our Justice System,
and many of those 849 murderers NEED NOT HAVE BEEN
EXECUTED. Suitable alternate penalties would probably have been
sufficient. We waste time, money and are perceived as less moral,
and often less concerned about human life by those opposed to the DP,
in not being more selective in who we SENTENCE to execution. In
my opinion, we should limit our executions to those murderers that one
would look almost silly to everyone, if they presumed we should not
have executed that particular murderer. Execute only those murderers
that we can easily justify executing, in the eyes of just about everyone.
I believe the standard for sentencing to execution should be raised, and
raised considerably. But ask me if I REALLY CARE... deep down...
and I would have to say, most especially in the context of on-demand
abortion... that I don't really GIVE A SHIT about those 849 murderers.
I have much larger fish to fry in respect to concerns about a presumed
'right to life.' Much of my opinions here, are not so much defending
the execution of those 849 murderers, but rather trying to put it into the
context that the DP should be seen as rather trivial in respect to those
larger issues. In any case, I find no reason to oppose the DP as a
concept which addresses the issue of murder. And no one here yet,
has mounted any form of argument which would convince me to
oppose it as a concept. Further, in respect to some European
contributors here, my belief is that much of the opposition to the
execution of those 849 proven murderers, is masking what is REALLY
behind such opposition... a rather vile, and detestable bigoted
anti-Americanism in general. I find much of that in your posts. Some
also may actually argue and even believe that murderers are SO
VALUABLE... but if they do so and ALSO argue that the fetus is
NOT VALUABLE, they are hypocrites, IMHO.

I refuse to accept that ONLY the INDIVIDUAL whim of the carrier
can totally determine the fate... either living or being sucked out as
garbage... of that unborn fetus. Just as I refuse to accept that ONLY
the whim of an INDIVIDUAL murderer can totally determine the

that microbes have some "right to life." Nor is it arguable that murderers do not
abrogate such a "right to life" of other humans at their pleasure using THEIR
OWN individual "authority" they consider supreme as they commit that act
of murder. They consider themselves ABOVE any edict from any source.
Abolishing by their own authority any presumed _right to life_ of their
victim. They are no longer beholden to any "authority" from any source
other than themselves. Further, you fail to realize that if there is a "universal"
right to life that could not be "abrogated," the food chain guarantees the end
of every living organism that preys on other living organisms... including homo
sapiens. Your words are so imprecise and ambilevous (heh... my Oxford
word of the day -look it up, 'bob'), that they should shame you, rather then
have you believe you have said something profound. Look at your words
again. Admit they are clumsy... _Abrogate_ them by your own authority, and
rewrite them in clear, precise English. I'm waiting....

None of the above implies I believe a creator did provide such an
unbelievable thing as a "universal right to life." It simply is irrelevant to the
idea. With or without a creator, it is obvious that nature did not provide a
"Universal right to life." If such a creator exists, He cares NOTHING
about your life, my life, human life, or ANY form of biological life in a
particular sense. If a creator exists He concerns himself with larger issues
than the protection of murderers under the guise of a synthetic invention
called a "universal right to life." Nor obviously does nature care... things
live, things die, with no particular rhyme or reason. Thus, the idea can only
come from the mind of Man. And so, it can only be the arrogance of
Man himself that takes such liberties with our existence. The entire chain
of history bears that out. If there is such a right... why does ANY biological
life form ever die? What terminates that presumed _right_? Nature
provides only an urge to survive, consistent with evolution, which might find
its roots in a creator. I say "might," since it is unknowable as to the first cause
of that biological urge. Other than without it, we would not be here to argue
the point. But having an _urge to survive_ does not imply a _right to survive_,
anymore than a murderer having an _urge to murder_, could imply he has
a _right to murder_. Nowhere is there any right to life for any INDIVIDUAL
biological entity, or a specific species. In fact, only Man can even articulate
that belief. Other animals certainly don't concern themselves with that concept.
But being able to articulate that belief... does not make it so. It simply means
Man's fertile mind has used that self-created principle to ENHANCE his urge

I agree with the thrust of your argument here (regarding the notion of
_magnitude_, in any case) but I must question whether all 849 murderers
cited by you are necessarily the "worst of the worst". I will readily
agree that the group in question contained many of the "worst of the
worst" and, indeed, that the majority of the group might be described as
such.

However, given some cases (including a few of those that Richard has
posted here), I would hesitate to say that all 849 executed murderers
represented the "[some of] most vile members of our species".

I've fallen terribly behind in posting. I haven't even had a chance
to read, much less respond to so many posts that I see in number
from my favorite _crash test dummies_. Most of them probably
hysterically pointed at me, Many of them I will probably ignore,
because I again have a full day tomorrow, and for once I seem
to be under time constraints. So I will not be able to apply some
needed gestalt to 'brain tumor bob,' except for those comments I
believe show his deep deterioration where I believe it is essential
I at least apply some soothing therapy. I will probably ignore Ol'
Racist Nev... which I sometimes feel makes me less than
responsible to my species.

It's good that the question of abolition/retention has been settled
with retention the clear winner, since that is no longer necessary to
debate here. :-) Many of my posts have lately generated a firestorm,
which I find good but also hardly able to keep up with.

Do not take any of the following as presuming it represents
some sort of disagreement with you. I simply wish to put
in place some particular opinions I hold regarding the present
subject. Others might read it (I doubt that), and comment.
I feel that your particular post deserves that I put a bit of effort
into describing my feelings regarding the comparison
of slavery to the U.S. DP, because some abolitionist believe
they can piously cloak themselves in the idea that because
they oppose the U.S. DP, that makes them the SAME as
those who oppose slavery (you KNOW who your are). With
the obvious intention of implying that those who support
the U.S. DP MUST also support slavery. In other words,
doing a reverse flip on logic. It is an obscene attempt
to distort viewpoints. And to me, nothing could be more
hypocritical. To me it only presumes that THEY have
stated innocent slaves can somehow equate to murderers.

Racism in the U.S. has its roots in slavery. So let me say
a few words on how I feel about racism --- I have often been
accused of being overly emotional regarding the subject of
racism -- and I plead guilt. Accused of being too unreasonable
in seeing things that others contend are not there, when seeing
racist slurs thrown about with abandon here -- But I see what
I see, so others cannot presume to argue that I cannot. Called
too angry in those arguments --- But I would question why I
should not be angry at racism. Too accusatory toward the
comments of others in respect to racism --- But I would feel
as having failed in some measure if I did not speak my mind.

In general, I have also recently been accused by 'euro' of trying to
make complicated concepts "simple,"... and frequently accused
by others of trying to make "simple" concepts complicated
(which might happen in answer to this post). Thus, I'm not sure
anyone actually knows where I am coming from, or what they are
talking about in respect to my posts. So, that <rant> being said,
let me try to set up, with what I hope is some reflective and
reasoned clarity, a scenario that might better explain how I feel
about slavery and the U.S. DP.

First, I am on record as having said that Karla Faye Tucker did
not "deserve" the DP, and it was a waste of resources in every
respect to execute her. She should have been shown mercy,
IMHO, and in that respect the U.S. DP quite often does not
meet the standards I would expect from it, in respect to the
murderers we do execute. So I would ask to consider three
cases --

Case 1 -- A Black male native is snatched from his family in
Africa, never to see them again. Thrown into the hold of a ship
with 500 other Blacks, existing with them in his and their own
excrement and urine on that trip. At that moment probably
NEVER to taste again what it is to not feel the chain around
his neck or waist or leg. Fed hardly anything. Occasionally
a bucket of water passed down. Pulled from the hold on arrival.
Placed on a block for sale. Bought by a farmer wishing to
use him to pull his plow, because the farmer cannot afford
a mule or a horse, and the price for that slave is less
than that mule or horse. Spending the rest of his life pulling
that plow, and doing ANYTHING else the farmer wishes,
WITHOUT QUESTION. Treated the same as a farm animal.
Or worse... not only sub-human... but sub-animal. Beaten
when not working fast enough. Tasting the whip if the farmer
has a bad day. Subsisting on the barest of what is necessary
for survival. Sleeping on straw. Never to have contact with
any human outside of the life of that farmer again. When
reaching an age where the cost of keeping him alive exceeds
what he can generate, having his throat slit by the farmer in
an _economic decision_. With no more concern than
wringing the neck of a chicken. Buried in an unmarked
grave. Forgotten. The farmer having broken no law. End
of life. End of case 1.

Case 2 -- A Black female native is snatched from the bosom of
her family in Africa, never to see them again. Endures the same
travel conditions. Sold on a block to a sullen-eyed farmer having
some other ideas of how to use her than the other farmer. Forced
to serve the farmer's family. Cook for them. Wash their clothes.
Scrub their floors. Clean their feet. Empty their toilets. Wipe
their ass. Perform every servile chore the family wishes. Then,
in the dark of night, visited by that farmer. Forced to endure the
most degrading insults one human can visit on another short of
murder itself. The laws of such a land making it a crime to fuck
an animal... but raping a slave quite permissible. And when
she becomes too old... too unattractive for this miserable swine...
and he finds he has enough money to purchase a younger
one... again the slit throat... again with no concern. again an
unmarked grave. The farmer having broken no law. End of life.
End of case 2.

Case 3 -- Karla Faye Tucker, a multiple-murderer who admitted
that she had an orgasm when she had murdered. Sentenced
to the DP, but fully repentant. Fully rehabilitated. No further
danger to any human. Absolutely no reason to execute her.
Still she is executed. End of life. End of case 3.

Those three cases now stand before me. God appears to
me and speaks -- "In my mercy, you can choose one slave,
and I will restore that one to Africa as if nothing had ever
happened to him or her. Your choice." "But I will not make
it that easy for you with the other slave and Karla Faye."
"You can choose to save the life of Karla Faye Tucker.
She will not be executed. But by doing so the life of the
other slave will remain unchanged and he/her will live that
life as a slave as fate has determined." "Or... you can
choose to also restore the other slave to Africa as if nothing
had ever happened to him/her as well. But in so choosing
you must accept the execution of Karla Faye Tu...."

That fucking needle would be whipped out, and I would personally
be shoving it into her fucking arm before God could finish His
sentence. Before His head stopped spinning. And Karla would
get no further than "Jes....." in her appeal to "Jesus, help me!"

Do you now get the picture of how I compare a murderer who
is fully rehabilitated and no longer a danger to anyone, to an
innocent slave? To compare even ONE innocent SLAVE, having
spent their life in such slavery, to the most benign, the most
repentant, the most undeserved of execution MURDERERS, is
a concept so alien to me, so repulsive, that I cannot find the
emotional words which can fully describe my feelings. Further,
euro tried to compare slavery as a CONCEPT, which involves
the MILLIONS of innocents placed into slavery, over hundreds
of years, to the U.S. DP, which has executed 849 proven
MURDERERS in 25 years. Given the argument that euro
hopes to make (to _feel good_ about himself here, preening
himself before others), and given other abolitionists who hope
to hitch THEIR agenda to comparing slavery as a concept,
with the U.S. DP, it is the greatest insult to SLAVES that I
can imagine. Punished once for having committed no crime.
They are essentially punished AGAIN as they lay in those
unmarked graves... as they are compared to MURDERERS.

A rather unfair dilemma for someone like _me_, however. I would
probably choose as you had but I would need more than a little time to
think it over.

My point didn't really cover the comparison of slavery with the DP
(which doesn't _offend_ me per se but certainly strikes me as completely
invalid to the point of silliness) but rather the idea that all those
executed since 1975 were indeed the "vilest [whatever you said,
precisely]".

I'm sounding entirely like a Dutch Uncle when I suggest that your
emotional response to the comparison of slavery with the DP prevents you
from convincingly refuting it. _I_ don't bother with it because it is
invariably brought up by an abolitionist (and often with the best of
intentions) and I find it entirely too embarrassing to comment upon, by
and large.

That doesn't mean that I don't regard the DP as both impractical or
unjust but that should be known to all regular posters here in any case.

I see you changed your position from 849 of the "most vile" murderers to
simply "proven" murderers. I'll bet that a careful retrospective analysis
of those cases would yield a far smaller number that you would agree merited
death and who never found any rehabilitation or other justification for
allowing them to use up perfectly good oxygen.

While I agree that the judicial process weeds out nearly all of those who
don't merit the dp, it remains true that 'nearly all' does not equal 'all'
of the all. Until we put in place laws, restrictions and practices that do
not reach for the dp as a solution until _all_ other options have been
examined and rejected, that do not permit prosecutors to benefit their
careers on the backs of those whose cases are marginally dp-eligible, that
provide at least as much financial and analysis support to competent defense
lawyers as to prosecutors, that prohibit minors or the retarded from
execution and that preclude the racial imbalances found on death row as well
as preventing the many other forms of abuse seen in dp cases.

We've come a long way since Furman and it does appear that dp prosecutions
are levelling off, but until virtually inarguable cases are the norm rather
than the exception, with objective criteria making it clear that a different
course of action would not suffice for both punishment of the criminal and
protection of society, we still have a far distance to go.

By way of example - last week I posted that David Brewer had been executed
in Ohio. I didn't mention that the murder took place in my community and
the murder was a particularly gruesome one, with much angst and anger that
it occurred here. (Except for the principals, I know very well everyone
else involved with the case, from the prosecutor to the police team to the
judge to the defense attorney.) Despite the graphic description of the
kidnapping/murder, this remains a case that should not have been
dp-eligible. Brewer was not a career criminal, but he had an obsession with
the victim, who was the wife of his former fraternity brother in college.
The case was prosecuted for death because of the publicity and justice would
have been every bit as much served had David Brewer spent the next 90 years
in prison. It's cases like this that need less emotionalism and less lip
service to justice and more sensible management.
