BERDO 2.0 - Phase 2 Regulations Notice of Rulemaking

Good afternoon,
On October 20, 2022, the City of Boston issued a notice
of rulemaking for the Phase 2 BERDO 2.0 regulations.
These regulations, after public comment and adoption by the Air Pollution Control Commission, will ultimately set rules to implement BERDO, including the creation of the Review Board, emissions factors, renewable electricity purchases, blended emissions standards,
designating a tenant as “Owner”, and other topics under the BERDO
2.0 Ordinance. The draft regulations can
be found here. Additional regulations will be drafted in 2023 and will set rules regarding hardship compliance plans, individual compliance schedules, portfolio compliance, the Equitable Emissions Investment Fund, and any other clarifying regulations as
needed.

Commission, Boston City Hall, Environment Department, Room 709, 1 City Hall Square, Boston, MA 02201. Written comments will be accepted until 5:00 p.m. on Thursday, November 10, 2022.
Testimony will also be accepted at a public hearing of the Air Pollution Control Commission on November 16, 2022, at 1 p.m. The hearing will be held virtually at https://us02web.zoom.us/j/86329377111.
At this hearing, the Commission will hear and review feedback from the public, discuss the regulations, and may vote to approve the Phase 2 Regulations. This hearing will be publicly noticed on boston.gov/public-notices 10
days before the hearing date.
