Lawyer demanding high payments
Question: I hired a lawyer (or should I say, he hired himself, since
he was a friend of the family) for a court battle involving two
protective orders, a domestic A&B charge, and a divorce. In just a few
months time, he managed to rack the bill up to over $15,000. I am 22
years old, and I certainly do not have this kind of money. Via email,
his paralegal talked me into $200 every two weeks payments. However, I
was unable to afford these, and they dropped me shortly after, without
really resolving anything. Turns out he was a civil lawyer and he
didn't tell me. Anyway, I have been making smaller payments, but now
they are threatening to take me to court because I am not paying the
amount we informally agreed to in an email during time of service. To
my knowledge I never signed any sort of document agreeing to it. Can
they force me to make $400+ payments based on that? Thanks.
Answer: With friends like that who needs enemies? (LOL)
Can they force you to pay them based on an oral agreement? While it is
much more difficult to get a judgment on an oral agreement it can be
done and since the plaintiff would be a lawyer it is going to be much
easier for him in most courts to get a judgment. Since he will be
attempting to collect a debt he will be subject to fair debt
collections and so every time he or his associates contact you they
must tell you they are a debt collector. If they don't do that every
call is a new violation.
Catching them in their violations (if any) and keeping a careful
record of them then when he does file suit and you respond would
probably be the best time for you to file a federal lawsuit against
him and that should put an end to it.
