Dear all,
In an unequal society like India, land is one of the aspects that help level the playing field. Recognising this, governments over the years including the Mysore Maharaja and post independence state governments have granted land to SC/ST communities. However thousands of them have been dispossessed of this land due to fraud, coercion, extreme poverty etc.Recognizing this, the government brought the Karnataka Scheduled Castes and Scheduled Tribes (Prohibition of Transfer of Certain Lands) Act, 1978 (PTCL Act). However, due to several legal, administrative and social challenges the act has not been implemented in a thorough manner.
Thus, overall the past 7 months, All India Lawyers Association for Justice (AILAJ), Manthan Law (ML), Alternative Law Forum (ALF), PTCL Kaayde Bhoomi Vanchitara Horata Samiti (PTCL-KBVHS), Independent Progressive Researchers have come together to conduct a study on the challenges to the implementation of this Act across seven districts of Karnataka — Bangalore Urban and Rural, Kolar, Tumkur, Chitradurga, Ramnagar and Davangere.
We have now organised a public hearing on this issue on *Saturday, 6th June, 2026 at 10.30 a.m. at Gandhi Bhavan.* People who have been dispossessed of their land will depose before an eminent jury. The jury will then provide a verdict on the status of the implementation of this law.

ಆತ್ಮೀಯರೇ,
ಭಾರತದಂತಹ ಅಸಮಾನತೆಯ ಸಮಾಜದಲ್ಲಿ ಭೂಮಿ ಎಂಬುದು ಸಮಾನ ಅವಕಾಶಗಳನ್ನು ಒದಗಿಸುವ ಪ್ರಮುಖ ಸಂಪನ್ಮೂಲಗಳಲ್ಲಿ ಒಂದಾಗಿದೆ. ಇದನ್ನು ಮನಗಂಡು, ಮೈಸೂರು ಮಹಾರಾಜರು ಹಾಗೂ ಸ್ವಾತಂತ್ರ್ಯಾನಂತರದ ರಾಜ್ಯ ಸರ್ಕಾರಗಳು ಪರಿಶಿಷ್ಟ ಜಾತಿ (SC) ಮತ್ತು ಪರಿಶಿಷ್ಟ ಪಂಗಡ (ST) ಸಮುದಾಯಗಳಿಗೆ ಭೂಮಿಯನ್ನು ಮಂಜೂರು ಮಾಡಿದ್ದವು. ಆದರೆ ವಂಚನೆ, ಬಲವಂತ, ತೀವ್ರ ಬಡತನ ಹಾಗೂ ಇತರೆ ಕಾರಣಗಳಿಂದ ಸಾವಿರಾರು ಜನರು ಈ ಭೂಮಿಯಿಂದ ವಂಚಿತರಾಗಿದ್ದಾರೆ.
ಈ ವಾಸ್ತವಿಕತೆಯನ್ನು ಗಮನಿಸಿ, ಸರ್ಕಾರವು 1978ರಲ್ಲಿ ಕರ್ನಾಟಕ ಪರಿಶಿಷ್ಟ ಜಾತಿ ಮತ್ತು ಪರಿಶಿಷ್ಟ ಪಂಗಡಗಳ (ಕೆಲವು ಭೂಮಿಗಳ ವರ್ಗಾವಣೆಯ ನಿಷೇಧ ಕಾಯ್ದೆ (PTCL ಕಾಯ್ದೆ) ಯನ್ನು ಜಾರಿಗೆ ತಂದಿತು. ಆದರೆ ಕಾನೂನು, ಆಡಳಿತಾತ್ಮಕ ಮತ್ತು ಸಾಮಾಜಿಕ ಸವಾಲುಗಳ ಕಾರಣದಿಂದ ಈ ಕಾಯ್ದೆಯ ಸಮರ್ಪಕ ಅನುಷ್ಠಾನ ಇನ್ನೂ ಸಾಧ್ಯವಾಗಿಲ್ಲ.
ಈ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಕಳೆದ ಏಳು ತಿಂಗಳ ಅವಧಿಯಲ್ಲಿ ಆಲ್ ಇಂಡಿಯಾ ಲಾಯರ್ಸ್ ಅಸೋಸಿಯೇಶನ್ ಫಾರ್ ಜಸ್ಟಿಸ್ (AILAJ), ಮಂಥನ್ ಲಾ (ML), ಆಲ್ಟರ್ನೇಟಿವ್ ಲಾ ಫೋರಂ (ALF), ಪಿಟಿಸಿಎಲ್ ಕಾಯ್ದೆ ಭೂಮಿ ವಂಚಿತರ ಹೋರಾಟ ಸಮಿತಿ (PTCL-KBVHS) ಹಾಗೂ ಪ್ರಗತಿಪರ ಸಂಶೋಧಕರು ಒಟ್ಟಾಗಿ ಕರ್ನಾಟಕದ ಏಳು ಜಿಲ್ಲೆಗಳಾದ ಬೆಂಗಳೂರು ನಗರ ಮತ್ತು ಗ್ರಾಮಾಂತರ, ಕೋಲಾರ, ತುಮಕೂರು, ಚಿತ್ರದುರ್ಗ, ರಾಮನಗರ ಮತ್ತು ದಾವಣಗೆರೆಯಲ್ಲಿ ಈ ಕಾಯ್ದೆಯ ಅನುಷ್ಠಾನಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ಸವಾಲುಗಳ ಕುರಿತು ಅಧ್ಯಯನ ನಡೆಸಿದ್ದಾರೆ.
ಈ ಅಧ್ಯಯನದ ಭಾಗವಾಗಿ, ನಾವು ಶನಿವಾರ, ಜೂನ್ 6 , 2026 ರಂದು ಬೆಳಿಗ್ಗೆ 10.30 ಗಂಟೆಗೆ ಬೆಂಗಳೂರಿನ ಗಾಂಧಿ ಭವನದಲ್ಲಿ ಸಾರ್ವಜನಿಕ ವಿಚಾರಣೆಯನ್ನು ಆಯೋಜಿಸಿದ್ದೇವೆ. ತಮ್ಮ ಭೂಮಿಯಿಂದ ವಂಚಿತರಾದ ಜನರು ಗಣ್ಯರನ್ನೊಳಗೊಂಡ ನ್ಯಾಯಪೀಠದ ಮುಂದೆ ತಮ್ಮ ಅನುಭವಗಳನ್ನು ಮಂಡಿಸಲಿದ್ದಾರೆ. ಸಾರ್ವಜನಿಕ ವಿಚಾರಣೆಯ ನಂತರ, ನ್ಯಾಯಪೀಠವು ಈ ಕಾಯ್ದೆಯ ಅನುಷ್ಠಾನದ ಪ್ರಸ್ತುತ ಸ್ಥಿತಿಗತಿಗಳ ಕುರಿತು ತನ್ನ ಅಭಿಪ್ರಾಯ ಮತ್ತು ತೀರ್ಪನ್ನು ಪ್ರಕಟಿಸಲಿದೆ.
