It's funny that Tinubu is now being held responsible for the ungentlemanly behaviour and dick measuring between the former and incumbent number one citizens of Rivers state.

Tinubu had to intervene, and rightly so, when all political gladiators in the state were lining either with the former or the incumbent governor. Law and order had broken down.

I daresay all the political bigwigs in Rivers state failed their people because of stomach infrastructures.

Wise men build bridges during turmoil while the foolish build walls. All political players were building walls!
If you have to blame anyone, blame the political players for what happened to Rivers state, and not the person that put a moderator in to build bridges.

You're very wrong.

No law was broken by Tinubu. He followed the law. Yes, it is not stated explicitly in the constitution that elected governor or House of Assembly should be suspended. The cause or declaring the state of emergency will dictate the action required.

In any case, precedents indicate that governors have been suspended in the past.

The Rivers state issue, even pertinently requires suspension as the cause of the emergency is the political and threatened violence between the governor and house of assembly.

Let's be real, if Fubara felt he was illegally removed, he could have clarified his situation with the Supreme Court. But, he never did.

So, I don't understand why some of you Sideliners keep shouting illegality, while the principal actor, meekly accepted his faith.

STATE OF EMERGENCY IN NIGERIA: CONSTITUTIONAL PROVISIONS AND IMPLICATIONS

A State of Emergency is a situation in which the government is empowered to take extraordinary measures to restore public safety, maintain law and order, or address significant crises. In Nigeria, the 1999 Constitution (as amended) provides the legal framework for declaring a state of emergency.

Constitutional Basis for a State of Emergency:

The power to declare a state of emergency is derived from Section 305 of the 1999 Constitution of Nigeria. This section vests the President with the authority to issue a proclamation of a state of emergency under specific circumstances.

Circumstances for Declaring a State of Emergency:

According to Section 305(3) of the Constitution, the President may declare a state of emergency by an instrument published in the official Gazette only under the following conditions:

1. War situation involving the Federation.
2. Imminent War or Invasion
3. Breakdown of Public Order and Safety which requires extraordinary measures to restore peace
4. Threat of Breakdown of Public Order
5. Disaster or Natural Calamity which affects a community or the entire nation.
6. Any Public Danger or emergencythreatening the existence of Nigeria
7. A Governor’s Request with the approval of a two-thirds majority of the State House of Assembly.

Procedure for Declaring a State of Emergency:

*Official Proclamation-

The President issues a proclamation published in the official Gazette.

*Transmission to the National Assembly-

The President must send copies of the proclamation to the President of the Senate and the Speaker of the House of Representatives, who must in turn convene their respective Houses to consider the situation.

*Approval by the National Assembly-

The National Assembly must approve the proclamation within two days (if in session) or ten days (if not in session) If the proclamation is not approved within the stipulated time, it ceases to have effect.

*Duration and Extension:

The state of emergency lasts for six months unless a two-thirds majority resolution of the National Assembly extends it out of necessity.

*Revocation

The President can revoke the proclamation by publishing an instrument in the official Gazette.

The National Assembly may also revoke the proclamation at any time by a simple majority vote.

Effects of a State of Emergency:

Once a state of emergency is declared, the government may take the following measures if necessary:

- Restriction of Movement into or from affected areas.
- Temporary Suspension of Certain Constitutional Rights and civil liberties for the sake of security.
- Deployment of Security Forces to restore order.
- Economic and Political Measures may require government action towards stability.

Impact on State Governors:

The Constitution does not explicitly remove Governors from office during a state of emergency, however past precedents suggest that:

- The President may appoint an administrator to take over executive functions in the affected State.

- The Governor and State House of Assembly may become subordinate to federal authority for the period of the emergency.

In cases like Plateau (2004) and Ekiti (2006), Governors were temporarily replaced by appointed administrators.
Past Declarations of State of Emergency in Nigeria

1. Western Region (1962)
Prime Minister Tafawa Balewa declared a state of emergency in the Western Region due to a severe political crisis within the Action Group (AG). The internal feud between Chief Obafemi Awolowo and Chief Samuel Ladoke Akintola led to violent clashes and legislative chaos. The region was placed under emergency rule, and Dr. Moses Majekodunmi was appointed administrator.

2. Plateau State (2004)
In May 2004, President Olusegun Obasanjo declared a state of emergency in Plateau State following a surge in ethno-religious violence that resulted in widespread killings and destruction. Governor Joshua Dariye and the State House of Assembly were suspended, and Major General Chris Alli (retd.) was appointed administrator to restore order.

3. Ekiti State (2006)
A leadership crisis in Ekiti State led President Obasanjo to impose emergency rule in October 2006. The controversy arose after the impeachment of Governor Ayo Fayose, which triggered political instability. Brigadier General Adetunji Olurin (retd.) was appointed administrator until normalcy was restored.

4. Borno, Yobe, and Adamawa States (2013–2014)
President Goodluck Jonathan declared a state of emergency in Borno, Yobe, and Adamawa States on May 14, 2013 amid the escalating Boko Haram insurgency.

Unlike previous cases, governors and state assemblies were not suspended. Instead, the federal government deployed more troops and imposed curfews to curb insurgent activities. The crisis persisted despite intensified military operations.

5. Some Local Governments in Borno and Plateau (2011)
President Jonathan imposed emergency rule in select local government areas in Borno and Plateau States due to rising Boko Haram attacks and communal conflicts. This was Before the full-scale emergency in 2013.

6. Rivers State (2024–2025)
President Bola Tinubu declared a state of emergency, citing a breakdown of governance in the state.

This followed a political power struggle between Governor Siminalayi Fubara and the Rivers State House of Assembly with tensions escalated

The irony, again, is that Tinubu knows this to be the truth because his VP Shettima, in a speech not too long ago, admitted that the president has no constitutional authority to remove any elected person, even a councilor, from office. What is a coup, if not the sacking of elected officials and their offices? Is that not what Tinubu did by suspending the governor and the legislature of Rivers state? Do you want to ignore it because it wasn't carried out by the military? 

Come on, let's be serious sometimes, Femi Olajide. Nyesom Wike built a fire place, the Wike leaning legislature brought a gallon of gasoline next to it, governor Fubara snatched the gasoline from them, but president Tinubu snatched the gallon from both of them, poured it on the fire place, and lit the fire.

"This idiot called Natasha Akpoti-Ijoko is a big fool. Her six month suspension is just over and the National Assembly leadership has to meet first to determine her recall. She supposed to wait at home for a recall letter from the National Assembly, but she wants to force herself on the National Assembly by going there uninvited. Her suspension letter says, until she is recalled by the National Assembly before she will be allowed back. NLC threatens to mobilise against NASS if Akpoti-Uduaghan is blocked from resuming

The Nigerian Labour Congress (NLC) has warned that it would mobilise its members against the National Assembly if the Kogi Central Senator, Natasha Akpoti-Uduaghan, is not allowed to resume her legislative duties, having served her suspension period.

NLC President, Joe Ajaero, issued the warning in a statement on Thursday, condemning the decision to continue restraining Mrs Akpoti-Uduaghan.

“We warn the leadership of the National Assembly and their enablers: the Nigerian people, united across ethnic and religious lines, will not stand idly by while you cannibalise our democracy. The labour movement, as the historic defender of justice and the common good, will mobilise its immense membership and moral authority to resist this slide into autocracy. An attack on one senator today is an attack on the sovereignty of every Nigerian voter tomorrow,” he said.

The NLC, an umbrella body for trade unions in Nigeria, often channels public grievances through protests.

It is unclear whether the union plans to immediately mobilise demonstrations should the Senate persist in blocking Mrs Akpoti-Uduaghan’s resumption until the judicial process regarding her suspension is concluded.

Earlier this week, Mrs Akpoti-Uduaghan threatened to sue the Clerk to the National Assembly (CNA), Kamorudeen Ogunlana, if she is not allowed to resume by Monday. Her lawyer, Michael Numa (SAN), conveyed the threat in a letter dated 10 September.

Although the Senate has not issued an official resolution, there are indications that the upper chamber may block her resumption when lawmakers reconvene on 23 September because the matter is still before the court and deciding otherwise would be subjudice.

Assault to democracy

Mr Ajaero described the continued denial of Mrs Akpoti-Uduaghan’s resumption as a threat to Nigeria’s democracy.

“The Nigeria Labour Congress




 (NLC) rises in vehement condemnation of the Godswill Akpabio-led Senate’s decision to continue barring Senator Natasha Akpoti-Uduaghan from performing her sacred constitutional duties. This act is not merely an error in judgement; it is a brazen, premeditated assault on democracy itself, a direct threat to the social contract, and a dangerous slide towards fascism masquerading as governance,” he said.

He criticised the Senate for ignoring a court ruling that voided her suspension and for refusing her return even after the suspension had lapsed.

“That you suspended a fellow Senator from her constitutional roles depriving her people proper representation is not sinful enough but you went ahead to ignore the rulings of the Court that voided her suspension and at the expiration of your illegal suspension, you are still denying her a return is the height of impunity and morally reprehensible. This is no longer a democracy,” he stated.

Alleged manipulation of the judiciary

Mr Ajero also accused the Senate leadership of attempting to silence the opposition and manipulate the judiciary.

“The Senate’s pathetic recourse to a frivolous legal technicality, claiming the matter is sub judice, after the expiration of a patently illegal six-month suspension, is the height of legislative bad faith.

It is a cynical ploy that reveals a sinister agenda to silence dissent, crush opposition, and manipulate the judiciary as a tool of political persecution.

This action, led by Senator Akpabio, constitutes a gross abuse of power that shames the hallowed chambers of the National Assembly and spits on the collective will of the people of Kogi Central who elected Senator Akpoti-Uduaghan.

“From our standpoint, this action is a direct attack on the Nigerian people. It is a declaration by a privileged political elite that they are not accountable to the citizens they purport to serve.

By willfully disenfranchising an entire senatorial district, the Senate is effectively stealing the political representation for which the people pay taxes.

This denies Kogi Central its right to participate in lawmaking, oversight, and the appropriation of national resources, directly impoverishing the constituents and perpetuating a system of exclusion and economic injustice. It signals to all Nigerians that their votes are meaningless and can be invalidated by the whims of any tyrannical leadership.

“The NLC stands on the side of democracy and wishes to state that this action is: a calculated test-run for the emasculation of opposition and the subjugation of sovereign will as 2027 approaches. It is an attempt to punish integrity and honour and hound men and women of conscience out of the political space.

A Senate that operates as a court in its matter, suspends members, and then ignores the expiry of its own sanctions, is a Senate that has declared war on the very principles of representative democracy and on our nation,” the NLC chairman said.

Natasha threatens legal action against NASS clerk over resumption blockade

Suspended Kogi Central Senator, Natasha Akpoti-Uduagha, has threatened legal action against the Clerk of the National Assembly, Kamorudeen Ogunlana, if she is prevented from resuming plenary on Monday.

Natasha’s threat was contained in a letter dated September 10 and signed by her counsel, Chief Michael Numa, SAN.

She vowed to seek legal redress against any attempt by the National Assembly to disregard a court order regarding her resumption.

“Take notice that failure to comply by Monday, 15th September 2025, will leave us with no alternative but to initiate proceedings against you personally and in your official capacity,” the letter read.

In the letter, Natasha’s counsel stated that the National Assembly’s refusal to obey a court order was a violation of the Constitution and the Code of Conduct for Public Officers.

She vowed to initiate contempt charges and disciplinary measures, adding that the clerk would be held responsible for instigating a breach of peace.

We strongly advise that you reconsider your untenable stance and comply with the Constitution and extant judicial orders,” the letter added.

Nebu, you call yourself a lawyer. Hence, you will know the difference between express terms and implied terms in legal documents. If it is not expressly stated, the courts can imply a meaning by referencing other relevant express terms to infer the intentions of the original drafters of the document.

Your reference to the ruling of the US court is your usual way of misappropriating unrelatable case to support your flawed stand. It is an express terms that the removal of a federal reserve judge can only be effected "for a cause".

Show me a term in the Nigerian constitution that says a governor cannot be suspended during emergency rule or reign of martial law and I'll hold up my hands in defeat.

Does it occur to you that the express statement in the constitution that:

"The Governor and State House of Assembly may become subordinate to federal authority for the period of the emergency", can be construed to mean suspension is implied therein?

Just by the above statement, even without using the word suspension, the federal government can appoint an administrator that will represent it in the state and sideline the Governor and HA. Such is the power prescribed expressly and can be implied into the constitution.

I am not going to argue this matter with you but I am glad that you appended the Constitution's prescription of what happens in a state of emergency. Rule of thumb, Femi Olajide, whenever and wherever the Constitution prescribes XYZ, that XYZ must be followed to the letter, it cannot be substituted with any thinking of anyone's -- that is why President Trump is unable today to fire Fed Governor Lisa Cook (not a state governor, it is one of the governors of US equivalent of the Central Bank). The Constitution mandates that a Fed Governor can only be removed "for a cause", but no cause has be established against her, only mere a allegation of mortgage fraud peddled by Trump's minions. Trump fired her (the first and only black woman to hold that position) but a federal court has reversed him because Trump's action is against the prescription of the Constitution -- an allegation is not "a cause". 

Based on what you appended below, nowhere did the Nigerian Constitution state that a governor could be removed in a state of emergency, therefore it can never be done in a lawful society, no matter whatever reason a president adduces. Additionally, the Constitution clearly stipulates the only instances when a governor can be removed -- impeachment/removal, resignation, or death. The governor enjoys immunity from prosecution or criminal investigation too. Were president Tinubu not lawless (on purpose, he knows he has no authority to suspend a governor and he would never accept such a suspension were he a governor), he would not have suspended governor Fubara from office. Were Fubara smarter, older, or better experienced as a politician, he would have rejected the suspension.  

The precedents you cited are misleading. President Obasanjo's replacement of two governors in 2004 and 2006 states of emergency were extraconstitutional acts that should have gotten him impeached, removed from office, and prosecuted had Nigeria a credible legislature (see South Korea whose president, upon declaring a phony state of emergency in December last year, was impeached, removed from office, arrested, and is under going trial for treason over his action -- the same punitive action is being taken against all aides of his who assisted him in carrying out that illegality, including his wife). Obasanjo's action is not a precedent because it was resisted by citizens, but the Supreme Court cowardly and corruptly shied away from taking up the matter. 

The 1962 case you referenced is also misleading because it occurred under a different Constitution and under a different form of government. Section 33(10) of the Constitution of Western Nigeria provided that "the governor shall not remove the premier from office unless it appears to him that the premier no longer commands the support of a majority of the members of the House of Assembly". Based on the forwarded signatures of 66 members of the House of Assembly (out of 112) who wanted the Premier removed from office, it appeared to the governor that the premier no longer commanded the support of majority of the members of the House of Assembly, thus the governor exercised his constitutional power and removed the Premier. The Chief Justice of Western Nigeria took this case to the Supreme Court, in seeking answer to the question: Could the governor remove a Premier based on a letter signed by some members of the House, and not as a result of a vote of no confidence on the floor of the House? The majority ruled in favor of Akintola -- removal had to be based on a motion passed on the Assembly floor. 

The case went to the Privy Council in London, the final court of appeal then and on May 27 1963, it resoundingly reversed the Nigerian Supreme Court because of the constitutional clause "unless it appears to him [governor] that the premier no longer commands the support of majority of the members of the House of Assembly". The Privy Council held that the governor didn't have to only rely on the sitting of the Assembly for it to appear to him that the premier had lost majority of the Assembly members' support. On the same May 27 1963, the Western House of Assembly amended its Constitution's section 33(10) with "in consequence of the passing of a resolution in the House of Assembly by a majority of the members of that". It backdated this amendment to October 1960, which immediately nullified the governor's removal of the premier in 1962.

You can see that the extraconstitutional act with which Akintola clung onto power, and with it brought mayhem to Western Region, is the same extraconstitutional act with which Tinubu suspended governor Fubara; the difference is that Fubara is too inexperienced a politicians to have fought back and the people of Rivers state inexplicably accepted Tinubu's unconstitutional act.  

Let it be noted that president Jonathan contemplated repeating former president Obasanjo's suspending of some governors during his proclamation of a states of emergency but his attorney general of the federation/other lawyers advised him that he held no such power constitutionally.

You always drop the tribalistic joker card, when you're losing an argument. No one is walking away with a star-studded jacket for losing an argument.

If the governor and the house of assembly are subservient to the federal government (you didn't contest that) and the federal government chooses or appoints an administrator to represent effect it's wishes, is that still legal or illegal? (You can't contest that as being legal).

If the administrator either by instruction from his employer or by his own volition, decides to sideline the governor and the house of assembly in running the government to mitigate the reasons for declaring the state of emergency, will that be legal or illegal? (You can't deem that to be illegal).

What is the difference of what I just described above and the announcement of suspension of the governor and the house of assembly? The only difference is the fact that one was announced as such and one wasn't.

You can demote, suspend, upgrade or ignore a subservient authority to you for the period specified by the law. That was implied into the constitution, but not expressly stated.

I'm out too on this issue. I have nothing to add. I'm not even a lawyer.

It is in where the Constitution states what should be done in a state of emergency -- removal or suspending a governor is not one of the things to be done. Reasonable, honest, and properly educated people don't try to prove a negative, which is exactly what your question attempted to do. Where a Constitution says do XYZ, it is mandatory to do XYZ; it is extraconstitutional to ignore XYZ to doing WQR because the Constitution didn't forbid doing WQR.

That you don't understand something doesn't mean it is flawed or unrelated to a topic under discussion. What the Constitution says is the core argument, not what it didn't say, could have said, or what you capriciously think it said. As with Tinubu, who ignored what the Constitution prescribes in a state of emergency to suspending a governor, which it didn't say, Trump ignored what the Constitution says, a Fed Governor may be removed for "a cause", to removing one by willfully misinterpreting "a cause" or assuming that the Constitution should have included an allegation as "a cause". That is the relatedness that you could not comprehend. 

The only term in the Nigerian Constitution that talks about removal of a governor deals with impeachment (section 188). A governor cannot be removed except following the procedures outlined in this section. Equally, a governor cannot be suspended because suspension is a punitive action which the Constitution not only does not make no provisions for but also forbids through the immunity clause.

Not at all, because under no proper usage of the English language does "subordinate" equate to "suspension/removal". The constitutional clause you excerpted simply points to the order of precedence while operating in a state of emergency; it actually clarifies further that the Constitution does not anticipate the suspension or removal of elected state officials. 

Femi Olajide, you are playing childish tribal politics, I am not, and i refuse to join you in that. If you visit the archives, you will see that Nebu held the same position when president Obasanjo removed governors Fayose and Dariye, and he sounded alarms against it when presidents Jonathan and Buhari were about to announce their states of emergency.

President Tinubu cannot leave Rivers State alone. Rivers State alone, can make or mar his 2027 ambitions. With what I see today, Rivers people will not vote for Tinubu in 2027 if the elections are free and fair. But then, very few expect it to be free and fair.
