The biggest shock and surprise in the list of 86 frozen accounts released today by Kenya IGP, Joseph Boinett, was the inclusion of the highly venerated Sheikh Mohammed Abdi Umal, one of the leading Islamic theologians in Africa.

According to his online profile, Sheikh Umal memorised the entire Quran of 6,666 verses at the age of 9-10.

When the Islamic Courts Union was set up in Mogadishu, Somalia the Kenya-born Sheikh Umal became a supporter of it, but when it was hijacked by extremists, Sheikh Umal quit it and totally distanced himself from all forms of Islamic radicalism. He has since then been serving as an Imam of a Mosque in Eastleigh where he preaches wholly on societal problems affecting Muslims such as on marriages etc.

Only once did he depart from this by talking about the Westgate terrorist siege in a sermon on Friday, September 27, 2013, six days after Westgate (see video above).

I translated his sermon in a summary form at that time in 2013 and circulated it in social media. Tonight, I have made a new summarised translation to show that this clergyman could have been used as a powerful tool by the Kenya Government in the war to counter radical Islamic teachings, but the blunder-prone Jubilee Government decided to freeze his bank account as a terrorist sympathiser.

TITLE OF SERMON: WESTGATE ATTACK HAS NO BASIS IN RELIGION AND NEITHER IS IT JIHAD BY SHEIKH MOHAMED ABDI UMAL:

It is not permissible to shed blood without justifiable cause. If a Muslim government and a non-Muslim government enter into an agreement that agreement is binding and must be respected.

Therefore, if a non-Muslim comes to you with peaceful intentions, you cannot kill him, particularly if there is a covenant between you.

Similarly, if you are a Muslim citizen living in a non-Muslim country, then you have a weighty obligation to obey its laws, especially if you have obtained its passport and become its national.

That passport is a binding instrument and you are duty bound to obey the laws of that land, once you have become a citizen of that country.

It is not Islamically permissible for you to betray the non-Muslims of the land whose citizenship you have acquired. You simply cannot attack them, that is not Islamic.

If you kill a non-Muslim with whom you have an existing convention, then you will not enter paradise. You are obliged by Islamic Sharia to live in peace and harmony with him.

It is wrong for you to attack him, for that is not the Islamic Sharia from (Prophet) Muhammad.

If you are not content to live peacefully with him, then leave his land and give up his passport and then what you wish to do after that is up to you.

But you are not allowed to attack him as long as you live in his land.

There are those who go round saying their Muslim land is being occupied by non-Muslim. You cannot kick out such a non-Muslim by force, for it will only aggravate the situation.

On the other hand, if a Muslim comes to you from a non-Muslim land, with which your Muslim land has a convention, and asks you to assist him in attacking his non-Muslim land, Islamic sharia forbids you from breaking your convention, hence you are not permitted to attack his non-Muslim land.

Now for my comment. This is the sheikh they have labelled a terrorist sympathiser.

Forty NEP politicians met at Boma Hotel in Nairobi and drew up a list of alleged terrorist allies and included this sheikh in that list.

Are these 40 NEP MPs God-fearing Muslims ? Did they have any concrete proof that Sheikh Umal is a terrorist financier ? Or are they judging him guilty now on the basis of a past ?

Even Allah forgives one his sins if he  repents. Have these politicians taken the place of Allah and decided that Sheikh Umal must be judged by them ? What he did at the Islamic Courts Union belongs to history. In any case, Islamic Courts Union was removed by Alshabaab and Sheikh Umal has rejected Alshabaab as the above sermon shows.

Why did they now include the good sheikh in their list of infamy ? Didnt Jomo Kenyatta forgive the Khalif brothers - Abdirashid and his brother Abdisirad who put a bounty on Jomo Kenyatta's head when they were in Mogadishu leading the NFD Liberation Front ?

When did these NEP politicians take over the role of NIS which is supposed to know if Sheikh Umal is a terrorist financier or not ?

How accurate is their List of 86 accounts frozen ?

For if that list is to trigger bloodshed between the sub-clans of NEP, as it will likely do if sub-clan X thinks its wealthy sons were affected most and blames it on sub-clan Y,Z, then the shedding of Muslim blood in ethnic wars will be squarely upon these 40 leaders on Judgement Day as per Islamic Sharia.

I suspect that list was drawn hurriedly because Uhuru & Ruto were breathing down their necks but they should have courageously refused to implicate innocent persons for fear of Allah's Wrath. They should have told Uhuru and Ruto not to use Muslims as the scapegoats for police failures each time they fail to stop attacks or ignore warnings.

Anyway, I do not hold a brief for any of those named by them for I dont know any of them, except Sheikh Umal and I believe they unfairly indicted him.And one day Allah will question them.
