I am in complete agreement with you and Ekwueme here. Further, Sanusi has not completely come out clean about the leak of the alleged missing $20billion to the opposition. When Obasanjo attacked the President in that now famous letter, Presidential investigation revealed OBJ could have gotten that information from nowhere and no one but Sanusi. Sanusi is one public official that I see who is in constant opposition to the same goverment he serve. Quite honestly, the President should have kicked him out long time ago. Let him go to court.
 
Also, let the opposition pick him as their Presidential candidate and let's see how far he go. If he become the opposition presidential flag bearer, that will be Jonathan's easiest way to reelction.

I'm glad to find common ground here with you here. I completely agree with you. SANUSI NEEDED TO GO!
 
Sanusi's actions in constant opposition and vociferous condemnation of the government he serves amounted to insubordination, and his corruption-like "gifts" to his favored "charities" as donations were flagrant misuse of CBN funds and intended to boost his persona.
 
GEJ needed to do this one, although he may have handed Sanusi a hero-presidential ticket in the eyes of the opposition.

I don't agree with you.  Sanusi needed to go.  Where in the world does a CBN Governor give donations in millions/billions?  Who approved such expenditure?
 
Please, don't lecture us on that.  Goodluck's action shows that he has a gut.  Sanusi thought that he was a demi-god.  Enough of that.
 
I strongly support President Goodluck Jonathan on this move.  It is over due. Yes, let the impeachment begin.  You think it is easy.

Indeed what GEJ has done is further evidence that the man is an ogoro drinker! Given the $20b oil money scandal that Sanusi has pushed and the fact that the man has few months to go as CBN governor, Mr Prez should have bidded his time, just like he did during the UMYA lack of transmission of power saga, and allowed Sanusi to hoist on his own petal if his accusations were baseless and politically motivated. But now with this knee jerk but malicious action against SLS, GEJ has willy-nilly exposed his soft under belly and with the political dynamics as it is in the National Assembly with defections and all that I see the possibility of another presidential impeachment saga looming leading up to 2015. 
With all the corruption around GEJ and now this constitutional crises,  GEJ is sure precariously perching on the precipice and mindlessly exposing the country to political and economic upheaval. 
It is unfortunate GEJ does not have good advisers who are patriotic and strategically savvy. So he is getting foolhardy in office and believing in his own invincibility, because of the shenanigans of his militant confederates..but again we’re reminded of what James hardly Chase wrote " it  is when a guy gets full of confidence that he is wide open for the sucker punch…”. I just feel sorry for the country that it may yet live out the dire predictions of 2015…after over half a century of independence and a civil war to boot. 
How unfortunate that Africans can't get their acts together and save the multitude of their people from self inflicted pestilence and suffering, due to inept leadership and corruption of the political class…somali, sudan and soon Nigeria…waooo!

I think the question is: Is $20b really missing?
Sanusi may have said so to divert attention from his own financial irregularities. This was a man who rebuffed the national assembly. And now he is locking horns with the presidency. Are we saying the CBN is a law unto itself?
Left to me this man ought to have been sacked long ago. Apart from destroying the banks, what has he really done? The press embellished his person. Now he has to pick up the crumbs

Cool Breeze:

It is precisely for crass political actions like this that GEJ will never win a free and fair election as president.

If he was determined to rid himself of Sanusi he should availed himself of the due process rather than some provision which was rendered extant by the CBN Act.

We should encourage this President to abide by the rule of law no matter how unpalatable it may seem. Now whatever the faults of Sanusi he has made a hero out of him.

And if the President is so concerned about corruption why has he not suspended the NNPC boss or minister why the investigate the alleged theft or loss of $20 dollars?

Mark my words this decision will come back to haunt Jonathan.

Sanusi never criticised the government. He blew the whistle concerning the monumental corruption going on in the NNPC. NNPC failed to remit revenue to the Federation accounts from sale of crude oil for nearly two years. The President was put on alert but he rather slumbered until the matter was brought to the Court of Public Opinion. NNPC still cannot account for twenty billion dollars in a poverty stricken country. NNPC now claims it used part of the money to defray it running cost! This is hogwash. This is the crux of the matter which some of fail to see because of sentiments.

Hero Sanusi will evolve to a god in the near future thanks to the irrational and licentious action of Mr President. What's the fucking point in sidestepping the due process in removing Sanusi who is already on his way out of the CBN? Yes Mr President's ego may be served and I know many people will be wanking over this but I bet the entire sane world will conclude that the guy was sacked for blowing the whistle.

CAPIO has filed a suit before a Federal High Court in Enugu seeking the enforcement of the Fundamental Rights of 796 prisoners held in Oji River, Enugu and Nsukka prisons for a period ranging from 6 months to 8yr without proper charges and trial. CAPIO is a not for profit change-development organization of the Discalced Carmelite Order with particular interest in

the justice sector, genuine prison reforms and general welfare of prisoners.

In partial fulfillment of our legal objectives which is to protect the interest of prisoners in Nigeria through advocacy for a reformed judicial system and rendering compassionate free legal services, applying international best practices, we have filed a Fundamental Rights Application on behalf of 796 awaiting trial inmates of Enugu, Nsukka and Oji River prisons of Enugu State in suit: FHC/EN/CS/17/2014, Court 1 and before Hon Justice Shauibu of the Federal High Court, Enugu Division seeking the relief stated in the process attached hereto.

The matter has been fixed for Monday the 17th Day of February 2014 for hearing of the application. 1.I am a Program Officer of Carmelite prisoner’s interest organisation [CAPIO].

2.I have the authority of our counsel and the Applicants to depose to the affidavit 

3.I was informed by Gregory Obasohan who is handling this matter that:

a.All the Applicants are inmates of Enugu,Nnsukka and Oji River Prisons, Enugu State respectively 

b.The Applicants are not in a position to depose to the affidavit because they are presently detained at the various prisons.

c.All the Applicants have been remanded in prison custody on the allegation of various offences ranging from murder, manslaughter robbery, rape and other related offences.

d.The Applicants have spent between 3months to 8years in prison custody without arraignment before a court of competent jurisdiction. Attached hereto are the recordsobtained from records department of the Prisonsstating their names, offence, court, date of remand, length of stay,same is marked Exhibit A1 A2& A3.

e.A letter dated 29th October, 2013 was written to the Honourable, Attorney General of Enugu State [1st respondent] to inform him of the continued incarceration of all the Applicants without arraignment or trial. The letter was copied to the Executive Governor of Enugu State, the Chief Judge of the Enugu State, the DPP, Ministry of Justice, Enugu State, the Solicitor General, Ministry of Justice, Enugu State, the Zonal Director, Radio Nigeria Enugu Network Station,  Enugu State, the Comptroller of Prison, Enugu State and the ZonalDirector, NTA channel 2, Enugu State. An acknowledged copy of the letter is hereby Attached and marked Exhibit B.

f.Another letter was written dated 29th November, 2014 as a reminder when there was no response to the previous one. A copy of the letter is hereby attached and marked Exhibit C.

g.Discreet investigation carried out at the court registry, revelled that no information has been filed at the high court which have jurisdiction to hear the matter, neither has the DDP given his opinion on the matter.

h.And unless this court intervenes, the liberty of the applicants willbe in jeopardy

4.I believe will be in the interest of justice for the application to be granted and the state will not be prejudiced.

4.ORDER XI OF THE FUNDAMENTAL RIGHTS (ENFORCEMENT PROCEDURE) RULES 2009 provides that

       ‘’ at the hearing of any application, under this rules, the court may make such orders, issue such writs and give such directions if it may consider just and appropriate for the purpose of enforcing or securing the enforcement of any of the fundamental right provided for in the constitution or Africa Charter on Human and Peoples Rights (ratification and enforcement) Act to which the applicant’s may be entitled’’

5.In the instant case, the all the applicant have been remanded in prison custody for series of alleged offences and have spent well over and above the legally prescribed sentence for the offences for which they are been held in custody. See exhibits A1, A2 and A3. The law does not envisage a situation where a citizen of this country will be detained without facing trial for such a long period of time in detention. This is a gross violation of all the laws in the land and as such the continued detection and incarcerations of the applicants cannot be justified under any law.

The report in question purported that the "infractions" of Gov SLS are dated back to 2011. This is an indictment on its own on GEJ administration because if the person occupying the seat of CBN governorship had been committing grievous crime under the watch of the presidency for over 3 years and no one heard about such crimes until the person blew alarm about serious corruption associated with the presidency, any decent person would consider the presidency act against gov SLS as nothing but unjustified reprisal and haunting for being a whistle blower against the presidency.    

The replacement is equally not going to be in the interest of the masses.

A Close analysis of FRC’s Dossier
 
I suggest a closer look is warranted of the many allegations of financial malpractices and corruption during Mallam Sanusi’s Tenure.
 
It said there is a provision for “Facility Management of N7.034 billion in 2012; N5.751 billion in 2011.  A breakdown of these figures reveals that this is just an expense head where the leadership of the CBN dumps what ordinarily should have been accounted for as their Benefit-in-Kind for tax purposes. A closer look at the breakdown shows that it is just an expense heads used for fraudulent activities such as “Profit from sale of Diesel” indicating that the CBN at some point operates in downstream sector of Petroleum industry. 
 
My Comments: The report makes statements as above implying fraud has been committed but provides no evidence of the fraud actually committed. Secondly it appears to indict the entire leadership of CBN and not Mallam Sanusi in particular suggesting the deputy Governors and Executive Directors are all culpable. Is it not strange that only the Governor is suspended by the President?  Is this a witch-hunt?
 
“There are also breakdown such as “Currency issue Expense” of N1.58 billion and Sundry Currency charges of N1.678 billion under “CURRENCY ISSUE EXPENSES.”  As they are in 2011 so are similar expenses in 2012.  These are difficult to understand."
 
My Comments: All these do not indicate fraud but warrant further explanation, what is corruption here?
 
The CBN accounts revealed it paid Nigerian Security Printing and Minting Plc. N38,233 billion in 2011 for “Printing of Banknotes” whereas the entire Turnover of NSPM Plc. Group is N29,370 billion, the report noted.
 
My Comments: There is a need for clarification on the part of the Minting Company, if it received the said amount from CBN and is not reflected but how does that immediately translate to fraud and corruption on the Mallam’s part? Nothing of substance yet indicates that in those comments.
 
“It also therein claimed that it paid Air Charter, such as Emirate Airline N0.511 billion; Wing Airline, N0.425 billion and Associated Airline N1.025 billion to distribute currency by air nationwide. Emirate Airline does not fly local charter in Nigeria. Wing Airline is not registered with Nigeria Civil Aviation Authority and Associated Airline does not have a billion turn-over for 2011 because upon inquiry, the management claimed they have no financial statements and have not had any significant operations for the past two years, that will warrant preparation of financial statements.”
 
My Comments: I am puzzled as to how this translated to fraud and corruption on the Mallam’s part, where is the evidence? It is conjecture and assumptions based on non registration and non reporting by the airline.  Again no prima facie evidence of criminality but definitely worth investigating further or awaiting the Mallam’s response.
 
Other areas of fraudulent activities include:
The FRC report further said “Within the “Administrative expenses” is an item they referred to as “Loan write-off.” This accounts for loans supposedly given to staff and written off thereafter.  It came to a total of N3.855 billion in 2012.  There is the need to review the Board approval for this loan write-off if any.
 
My Comments: So was board approval obtained? It does not say, so how does this amount to a crime? When nothing so far is proved?
Part 2
 
Within the “Administrative expenses” is an item they referred to as “Fixed Assets Clearing Account.”  These are properties acquired by the CBN for which it does not expect to derive future economic benefits.  These properties are written off by the CBN on a yearly basis. It came to N4.076 billion in 2012; up from N1.324 billion in 2011.  This should not be mistaken for “Disposal of Fixed Assets Schedule.”
 
My Comments: Ineptitude maybe, but fraud, corruption, there is no evidence of these.
 
The report further said “Foreign Bank accounts that have been closed off-shore were still operational in the General Ledger for over six months after they have been confirmed as closed accounts by the off shore Banks. A thorough investigation will reveal how the balances in the now fictitious foreign accounts are treated.  It is also said that “There are long outstanding invoices that make up the liability account from as far back as 2005.  The External Auditors have to request, in their draft management letter, the management or whoever deems it fit to carry out a thorough investigation in this area to ensure items standing in this account are valid invoices.
 
My Comments: The report contradicts itself, it concludes there are fictitious foreign accounts here and then proceeds to suggest a thorough investigation is warranted. If it has established there is a fiction here then why proceed to investigate the fiction? I am still of the view, however, that explanations are warranted here by the leadership of CBN but that no evidence of fraud or corruption has been proved.
 
According to the report: The ”Know Your Customer” policy is not properly followed by the CBN to the extent that the CBN has an unknown customer account balance of N1.423 billion since 2008.  The CBN claimed that they are taking steps to obtain the required details regarding the address of the customer.
 
My Comments: The issue here pre-dates the Mallam’s time as CBN Governor so there is no case to answer.  Allegation of fraud or recklessness, am not sure arises here. 
 
According to the report, “Real time Gross Settlement Clearing Account, that is supposed to be reconciled on a daily basis, has long standing reconciling items that could not be substantiated.  The external audit revealed debit/credit balances of sundry foreign currencies without physical stock of foreign currencies in CBN Head Office account. At no point should one expect to have fictitious Naira balances without foreign currencies to back them up.  It is important to know who is or was with foreign currencies at the time.
 
My Comments: Sloppiness maybe? Questions to answer yes! But fraud or corruption? Not a chance in heaven!
