Home Office, AIR BnB, and detached ADU in R2 semi-detached?

Hello All,

I live in NW DC in a semi-detached dwelling in an R2 zone.  I'm wondering if zoning would allow me to build a new detached ADU behind my house and rent or AirBNB an existing basement au-pair suite with a separate entry (no kitchen) and have a home office all by Right.

Any thoughts on this would be much appreciated.

p.s.: I appreciate the exchange on this forum about the new rear yard interpretation with regard to ADU's.

Hi Tim,
Quick reply (we can discuss more in detail via phone). You are only allowed ONE additional -separate- dwelling. How you decide to rent or use the main residence, is not regulated. So, you are allowed to do this:
  • Create a separate building (basement or detached) and rent (long or short term)
  • Keep the main use and use it for work, roommates or as a main residence.
It's easy to confuse ZONING regulations and BUSINESS regulations. Business licenses organize how you USE the space, ZONING regulations indicate SHAPES of buildings.
