Wilful violation of Statutory Act and Notification of the Maharashtra Govt. by the DM Office, Nagpur - Protecting False/Invalid ST Caste Certificates.

It is to inform that the office of DM (Nagpur) has willfully disregarded the Maharashtra Act No. XXIII of 2001 and also disregarded the notification of dated 04/06/2003. The above Statutory Act and Notification provides that only the Tribe Caste Certificate Scrutiny Committee is empowered/authorized to verify the ST Caste Certificates, but the Assistant Superintendent (Grah Shakha) of DM Office, Nagpur has issued a Caste Certificate Verification Report (Ahwal) vide his letter dtd. 07/08/2014. On the basis of this verification (albeit unconstitutional), the department has informed me that the "Collector has verified the caste" whereas only the issuance of certificate has been verified on the basis of office records (Nond Pustika).
However, my only point is that if the ST Caste Certificates will be verified by the office of the DM itself (who has issued the certificate), then the purpose of the above Act and Notification and constitution of Tribe Caste Scrutiny Committee will be defeated, and in such a situation, the cases of false/fake/forged/invalid ST Caste certificates can not be identified by anyone and the above STATUTORY Act/Notification will become MEANINGLESS // REDUNDANT.
The Asstt.Supdt. (Grah Shakha) of DM Office, Nagpur has misused his official position and he has deliberately disregarded the CONSTITUTIONAL PROVISIONS of the Maharashtra Act No. XXIII of 2001. It is pertinent to note that it is mandatory to mention the name of signatory in the government correspondence, but in the instant case, the Asstt.Supdt. has not mentioned his name in his letter.
I've already sent my detailed written complaint (along with necessary documentary evidences) through Speed Post (EI052547579IN) and email on dtd. 05/09/2014 to the Div.Commr. (Nagpur) with a copy to the DM (Nagpur) and Director/Commissioner (Tribe Cert. Scrutiny Committee, Nagpur). A copy of the above complaint is attached with this message.
I, therefore, humbly request you to register your STRONG PROTEST with a demand of detailed inquiry in the above matter wherein the Statutory Act and Notification have been willfully disregarded by the DM Office (Nagpur). It seems that a heavy malpractice/corruption has been made under the table in above case.
