Gov. MP files reply..Gujarat asks for time..
The WP by the SS Dam affected was listed before
Hon’ble Justice Ramana, Justice Rastogi & Justice Gavai. The State of
Madhya Pradesh had filed an reply affidavit on 30.09.2019, wherein they have
categorically stated that since the R & R was not complete and several
applications were still pending adjudication before the Grivance Redressal
Authority (GRA), they have opposed filling up of reservoir to FRL. They have
also stated that the time line which was suggested as per safety guidelines,
has also been unilaterally infringed upon by filling up the reservoir by
15.09.2019.
When
the matter was taken up, Mr. Tushar Mehta, ASG, sought time even to respond to
Short Reply filed by State of Madhya Pradesh.
Mr.
Sanjay Parikh, Sr. Advocate appearing for the Petitioners submitted that the
issue of bringing down the level of reservoir waters needs to be urgently
considered.On this the Hon.Bench asked ASG to hold a meeting and consider this
aspect, on request of ASG, the said fact was not recorded in the order, but the
ASG assured that he would get the appropriate committee consider the issue.
The
matter is listed next for 15.10.2019. Adv. Abhimanue Shreshtha will continue to
assist Sr Counsel Mr Parikh for the petitioners.
