Re Minutes of the SGM dated 12th May 2016.
Item VII Legal cases.-c.Case filed by AWS Members with Deputy Charity Commisioner Thane.
Mr Umesh Sharma stated that following statement is incorrect in the minutes-"Mr Umesh Sharma stated that there was no sinking fund in the AWS.He was supported by Mr Vijay Sarup who added that Balance sheet of AWS does not show sinking fund"
The correct statement was that under the trust by laws there was no requirement of sinking fund and it is part of the General Reserve.It was further stated that if this fund is shown as sinking fund in ACHS balance sheet this amount can only be utilised with the clearance from joint registrar and not within the powers of the General Body which is not desireable.
It was further clarified by the Chairman that while the decision will be left to the Hon court the stand taken by the society will be pursued as part of maintaing continuity in the proccess.
Item XIII-Handing over taking over(Ho To) process.
At the outset it was pointed out by me that it is improper for the Chairman to place before the General Body a set of queries which were raised, without waiting for and evaluating the responses recieved.
:Regarding this para "Mr Vijay Sarup made a statement that old MC will not extend its support during re audit and society is free to take legal action....... is incorrect.
The correct position is that Chairman made a statement that reaudit will be the responsibility of the old committee(Some angry members also said cost should be recovered from old MC),To this I had responded that reaudit is the responsibility of the New MC and nowhere was a statement made that old MC will not extend support.
Kindly amend the minutes suitably.
