Dear All,

He came to the office and demanded to inspect documents and insisted on talking to me.

Besides the usual ranting he wanted us to confirm that we do not entertain e mail communications which I agreed.I also told him to tone down his aggressive pitch if he wants to talk to me.

Here is my response to him.

Dear Shailender,

This is with reference to our telecon and your subsequent mail to me.

I confirm that all complaints need to be in writing as specified in Bye law 17.E mails are presently not acceptable.
Softwares are in the market to handle digital documentation and signatures so may be at a future date this can be looked at.

I suppose you are referring to sec 32 of the Co operative socities act and not the bye laws,This section specifies the documents that members can inspect.Please apply in writing with details of which of the specified documents you wish to inspect from the specified list..The office will then fix a time for you to inspect.

The other points in your mail  do not need to be commented on.

I notice that your tone continues to be caustic and accusative,This makes meaningful communication difficult. Communication is the key to problem resolution and I look forward to the day when we will be able to significantly improve this to our mutual advantage.

Hi Vijay,

As discussed during our call today you mentioned the following

SOCIETY OFFICE NOT ACCEPTING E MAILS-

a) eMails have been in India since 1993 and 'current caretaker team of 7 society members' inability to
respond over mails can not be pushed on 500+ members.

b) Why, who and since when it is decided that society office will not accept e mails from members and
force members to walk to discuss concerns with office ?

c) Why is this being brought to our notice now? is it because 2 weeks have passed since AGM MoM were
shared and now probably you are trying to find a reason how not to include the critical/ valid points
shared by members over eMail by giving this lame excuse.

d) Still as you said, please give us this point in writing as this is critical for us to have it in
writing from you.

BYE LAW UNDER WHICH MEMBERS HAVE THE RIGHT TO SEE DOCUMENTS

a) It was a sorry discussion between me, a member and you, an office holder (who has held office for
many years now) where you asked me to confirm the Bye Law under which I, a member has the right to see
documents in office during office hours

b) During SGM, Ms Sheetal Bhave, Secretary (even though her name STILL DOESN'T APPEAR IN MEMBER LIST
(PLEASE REFER THE MEMBERS' LIST UMESH SHARMA SENT TO SCEA, PUNE), she continues to sign as Secretary as
a part of current caretaker team), had told me in front of forum if I have ever read Society Bye Laws.
Looks like I have read more bye laws than the office holders

c) Please refer to Section 32 which is on 'Rights of members to see books' and confirm when can I come

Dear Vijay,

Don't see any reason why we should make him any wiser than he is by informing him the law. It is for him to realize this.

Should you however, decide to go ahead then I have changed the later part of the draft. You may like to consider this.

I would request that he should be allowed to inspect only photocopies since I fear that he might mutilate and destroy the originals, should he lay his hands on them.

We must recognize that he does not have welfare of the society in mind. He is working on his personal grudge. Any co-operation we do with this guy is only inviting more trouble. We should only do the minimum what is required by law and nothing more.

With your continued style of rude and offensive communication , it would not be possible for us to have any meaningful interaction, since we categorically refuse to take cognizance of your mail that use offensive narrative. You might like to consider a more polite language of communication should you wish to have our attention in future.

We are not making him wiser.I had asked him to quote the section under which he was seeking information and he qioted sec 32.
